HomeMy WebLinkAboutOrdinance 2789 ORDINANCE 90. 2 7R AN ORDINANCE REGULATING PARKING OF WrOR VEHICLES IN AREAS SET ASIDE BY PUBLIC SERVICE CONCERNS AND UTILITIES FOR THE CONVENIENCE OF THE PUBLIC; FIX- ING A MAX TIME FOR SUCH PARKING; AUTHORIZING AND DIRECT THE TRAFFIC ENGINEER TO ENFORCE PARKING REGULATIONS; PROVIDING FOR A PENALITY FOR THE VIOLATION HEREOF OF A SUM OF MONEY NOT TO EXCEED $100.00; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Public Service Concerns, Public Service Utility Com- panies, Terminal Companies, Railroads and other quasi public corporations and public concerns serving the public and charged with public duties find their facilities greatly impaired by.members-of the public arbitra- rily parking motor vehicles for an unreasonable length of time and in such manner as to interfere with the general public's use and enjoyment of certain property set aside for the use and benefit of the public in relation to the service rendered by such various Public Service Concerns, Public Service Utility Companies, Terminal Companies, Railroads and other quasi public corporations and public concerns; and WHEREAS, the promiscuous and unwarranted parking upon property owned or controlled by such Public Service Corporations and Concerns creates a nuisance which requires that some regulation be imposed so that the public health, safety, confort and convenience will be subserved; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That any area way, park way, traffic way, or parking space owned or controlled by any Public Service Concern, Public Service Utility Company, Terminal Company, Railroad or other quasi public corporation or public concern designed for the temporary parking of patrons of such public concern, utility or corporation, be and the same is hereby sub-' jected to the following control and regulations That no person, firm or corporation or any person having control _ k of any motor vehicle, or vehicle of any kind, shall park upon or in any such space owned or controlled by a public Service Corporation or Public Service Concern mentioned herein for a longer period than two (2) hours, which said time is fixed as a reasonable length of time in which any per- son may so occupy any private property owned or controlled by such public service corporation or public concern set aside and designed for use of the public having business to transact with such public service corpora- tion or public service concern. SECTION 2. That the Traffic Engineer of the City of Fort Worth, in order to expedite and regulate the flow of vehicular traffic through and within the area described in Section 1 hereof be, and he is hereby authorized and directed as follows: (a) To determine and designate spaces within the area for exclusive use as bus stops, taxi-cab stands, and passenger and freight loading zones, and to mark the same with appropriate signs and markings. (b) To determine and designate within the area certain por- tions thereof which shall not be used for the parking of vehicles and to mark such spaces with appropriate signs or markings. (c) To designate certain traffic lanes and portions thereof within the area on which vehicles may be prohibited from being driven except in one direction and to designate the direction in which driving is prohibited and that which driving is per- mitted, and to install appropriate signs and markings designat- ing such one way traffic lanes. SECTION 3. Every regulation, designation, delineation, or determination promulgated by the traffic engineer pursuant to the authority granted here- under shall be described in writing or by a map of the area and filed with the City Secretary. Such writing or map shall constitute a public record, and all persons shall be charged with notice of the contents of same. Each and every failure of any person, firm, or corporation to observe or comply with any such regulation promulgated by the traffic engineer of the City of Fort north shall be deemed a violation of this ordinance. SECTION 4. Any person, firm or corporation-violating any of the provisions of this ordinance shall, upon conviction thereof, be fined a sum of money not to exceed $100.00, and each day's violation thereof will constitute a separate offense. SECTION 5. Should any section, provision or part of this ordinance be declared unconstitutional and void by a court of competent jurisdiction, such decision shall in no way affect the validity of any of the remaining parts of this ordinance, unless the part held unconstitutional or void is inseparable from and indispensable to the operation of the remaining parts. The City Council hereby declares that it would have passed those parts of this ordinance which are valid and omitted any parts which may be uncon- stitutional if it had known that such parts were unconstitutional at the time of the passage of this ordinance. SECTION b. This ordinance shall take effect and be in full force and effect from and after the date of its passage and publication as provided by law.
