HomeMy WebLinkAboutOrdinance 6389 ORDINANCE NO, ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF BURTON HILL ROAD AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT WITH GLADE, INCORPORATED FOR THE CONSTRUCTION OF SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPRO- PRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE, WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract with GLADE. INCORPORATED for the making and construction of; certain street improvements on the hereinafter described portions of streets, avenues and public places in -said City, to-wit: BURTON HILL ROAD From Santa Clara Drive to 1000' south, known and designated as Unit 1, Project No. 104-22000-108. WHEREAS, by sundry proceedings heretofore passed by the City Council of the City of Fort Worth, Texas, including Ordinance No. 6339 a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 6339 , and WHEREAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; .and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. II. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: III. When each of the certifiactes has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector as part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying_ the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the. appropriate Ordinance Records of said City: V. This ordinance shall take effect and be in full force and effect from and after the date of its passage. PASSED AND APPROVED THIS day of s 19 APPROVED AS TO FORM AND LEGALITY: City Attorney PROJECT NO. 104-22000-108: BURTON HILL ROAD FROM SANTA CLARA DRIVE TO 1000FEET SOUTH, to be improved by constructing a seven-inch thick hot-mix asphaltic concrete pavement on a six-inch thick lime stabilized subgrade, with seven-inch high concrete curbs and eighteen- inch wide concrete gutters, so that the finished street will consist of one thirty-two foot wide roadway, and by constructing four foot wide concrete sidewalks and six-inch thick concrete driveways where specified. Four foot wide concrete sidewalks will also be constructed along the north side of the street in Northcrest Addition (immediately east of the paving) from Lot 1, Block 9, through Lot 11, Block 1. Project Description Name: Paving of Burton Hill Road from Santa Clara Drive to 1,000 Feet South, Project No. 104-22000-108 Contract Awarded: June 29, 1970 (M&C C-1769) Work Order Issued: August 3, 1970 Work Order Effective: August 13, 1970 Date of Final Inspection and Approval: September 24, 1970 Working Time Bid: 40 Working Days Working Time Used: 16 Working Days Project Cost and Financing Original Bid Price: $36,527 Final Contract Cost: $36,816.10 Partial Payments Previously Made: 2 Amount: $33,134.49 Final Payment Due: $3,681.61 Payment to be made from Project Account No. : 104-22000-108 Deviation from Bid Price: The final cost of this project is $289.10 over the original bid price. This cost difference can be attributed to minor variations between quantities estimated on the contract documents and quantities actually measured and used at the job site. A bond fund transfer in the amount of $750 from Arterial Streets Unspecified to the project account will provide the necessary additional funds for the cost of construction and inspection engineering costs. Compliance with Specifications During testing on this project, 4 corings were made with the following results: Exceeds Even with Under Specs but Below Specs Specs Within Tolerance Tolerance Paving 3 1 0 0 Sub-grade 2 2 0 0 On the entire project, the average thickness of the hot-mix asphaltic con- crete paving is 7.81 inches as compared to the 7.00 inches specified; and the average thickness of the lime stabilized sub-grade is 6.06 inches as compared to the 6.00 inches specified. Tests made during construction show that materials used were in compliance with contract specifications.
