HomeMy WebLinkAboutOrdinance 6089 ORDINANCE NO. � ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF ODOM ROAD AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT WITH AUSTIN ROAD & WORTH CONSTR. CO. & C. COHEN FOR THE CONSTRUCTION OF SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPRO- PRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract with AUSTIN ROAD & WORTH CONSTR. CO. & C. COHE$or the making and construction of certain street improvements on the hereinafter described portions of streets, avenues and public places in said City, to-wit: 1. ODOM ROAD From 50 feet west of the west line of Old Denton Road to the west line of I. H. 35W, known and designated as Unit 1, Project No. 104-24000-168. 2. OLD DENTON ROAD From the north line of Odom Road to 1,581 feet north, known and designated as Unit 2, Project No. 104-24000-169. V, WHEREAS, by sundry proceedings heretofore passed by the City Council of the pity of Fort Worth, Texas, including Ordinance No. 5901 , a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 59M , and WHEREAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; .and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. II. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on'the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: s zzz. When each of the certifiactes has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector as part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. Project Description Name: Odom Road, Old Denton Road and Little Fossil Creek Bridge: Construction Unit I, Odom Road from Old Denton Road to 135W Unit II, Old Denton Road from Odom Road north 1668 feet Unit III, Old Denton Road from 1668 feet north of Odom Road to IH 820 Unit IV, Little Fossil Creek Bridge on Old Denton Road Contractor: Austin Road, Worth Construction Company and C. Cohen, Inc. Contract Awarded: December 4, 1967 (M&C C-1110) Work Order Issued: December 5, 1967 (Partial Work Order for Units III and IV, Work Order for Units I and II was issued July 12, 1968) Work Order Effective: December 11, 1967 Date of Final Inspection and Approval: January 24, 1969 Working Time Bid: 240 Working Days Working Time Used: 163 Working Days Project Cost and Financing Original Bid Price: $308,830.20 Final Contract Cost: 302,633.92 Partial Payments Previously Made: 13 Amount: $272,370.53 Final Payment Due: $ 30,263.39 Final payment will be made from Project Account Numbers 104-24000-168, 104-24000-169, 104-28000-611 and 104-36000-202. Deviations from Bid Price: An under-run of $6,196.28 occurred due to minor variations between quantities estimated in the contract specifications and quantities actually measured and used at the job site. Compliance with Specifications During testing on this project, 41 corings were made with the following results Exceeds Even with Under Specs but Below Specs Specs Within Tolerance Tolerance Unit I, Odom Road Paving 7 0 2 0 Sub grade 9 0 0 0 On Unit I the average thickness of the pavement is 8.25 inches as compared to the 8 inches specified, and the average thickness of the lime stabilized subgrade is 8.10 inches as compared to the 8 inches specified. DATE REFERENCE SUBJECT: Final Payment - Odom Road, Old PAGE NUMBER Denton Road, and Little Fossil 2 2 4/28/69 FP-625 Creek Bridge of Exceeds Even with Under Specs but Below Specs Specs Within Tolerance Tolerance Units II and III, Old Denton Road Paving 25 7 0 0 Subgrade 14 18 0 0 On Units II and III the average thickness of the pavement is 7.46 inches as compared to the 7 inches specified, and the average thickness of the lime stabilized subgrade is 8.03 inches as compared to the 8 inches specified. Unit IV, Little Fossil Creek Bridge Tests made during construction show that materials used were in compliance with contract specifications. Recommendations It is recommended that the above project be accepted by the adoption of an ordinance and that final payment of $30,263.39 be authorized to Austin Road and Worth Construction Co. and Chas.
