AN ORDINANCE AMENDING ORDINANCE NO. 3011, BEING AN ORDINANCE TO REGULATE AND TO RESTRICT THE LOCATION AND USE OF BUILDINGS, STRUCTURES, AND LAND FOR TRADE, INDUSTRY, RESIDENCES, OR OTHER PURPOSES; THE HEIGHT, NUMBER OF STORIES AND SIZE OF BUILDING; AND OTHER STRUCTURES: THE SIZE OF YARDS AND OTHER OPEN SPACES; OFF-STREET PARKING AND LOADING AND THE DENSITY OF POPULATION; AND FOR SAID PURPOSES TO DIVIDE THE MUNICIPALITY INTO DISTRICTS OF SUCH NUMBER, SHAPE AND AREA AS MAY BE DEEMED BEST BY FIXING DEFINITE USES OF THE BUILDINGS HEREINAFTER ERECTED IN SAID DESCRIBED AREAS FROM THE USES AS SHOWN ON THE MAPS CONTAINED IN SAID ORDINANCE NO. '3011 ; PRE- SCRIBING A SAVINGS CLAUSE; PROVIDING A FINE OF NOT LESS THAN $5.00 NOR MORE THAN $200.00 FOR EACH OFFENSE, AND THAT EACH DAY THAT A VIOLATION IS PERMITTED TO EXIST SHALL CONSTITUTE A SEPARATE OFFENSE; AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Ordinance No. 3011 be amended so that the following described uses in the hereinafter described area be altered, changed and amended as follows to wit: Z-67-151 Being a portion of the J. J. Scott Survey, Abstract No. 1449, situated about nine miles south from the Courthouse of Tarrant County, Texas, and being more particularly described as follows: beginning in the west right-of-way line of U. S. Highway 81 (south) (I-35W), 98 ft. west and 438.8 ft. south from the northeast corner of the J. J. Scott Survey, Abstract No. 1449; thence west 2540.8 feet to a point in the Fort Worth Corporate Boundary; thence South 2200.0 feet along said corporate boundary to a point in the south line of said J. J. Scott Survey; thence east 2540.8 feet along the south line of said J. J. Scott Survey to the west right-of-way line of said Highway No. 81; thence north along said right-of-way line of Highway No. 81 to a point for corner, said point being 98 feet west and 1920.2 feet south from the northeast corner of the J. J. Scott Survey; thence west along a line 1920.2 feet south of and -parallel to the north line of said J. J. Scott Survey a distance of 1500 feet to a point for corner; thence north along a line 1500 feet west of and parallel to the west right-of-way line of Highway 81 to a point for corner, said point being 920.2 feet south of the north line of the J. J. Scott Survey; thence east along a line 920.2 feet south of and 'parallel to the north line of the J. J. Scott Survey to the west right-of-way line of said Highway 81; thence north along the west right-of-way line of said Hi hway 81 to the point of beginning and containing approximately 93.89 acres. �U. Scott Survey, Abstract No. 1449 situated about nine miles south from the Courthouse of Tarrant County, Texas, and being more particularly described as follows: beginning in the west right-of-way line of U. S. Highway 81 (south) (I-35W), 98 feet west and 920.2 feet south from the northeast corner of the J. J. Scott Survey, Abstract No. 1449; thence south along the west line of said Highway No. 81 a distance of 1000 feet to a point for corner; thence west along a line 1920.2 feet south of and parallel to the north line of the J. J. Scott Survey a distance of 1500 feet to a point for corner; thence north along a line 1500 feet west of and parallel to the west right-of-way line of said Highway No. 81 a distance of 1000 feet to a paint for corner; thence east along a line 920.2 feet south of and parallel to the north line of said J. Renfro Surveys, situated about nine miles from the Courthouse of Tarrant County, Texas, and being more particularly described as follows: beginning at the intersection of the west right-of-way line of U. S. Highway No. 81 (south) (I-35W) and the south right-of-way line of County Road No. 1078; thence north along the west right- of-way line of Highway No. 81 (south) (I-35W) 2225 feet, M/L to a point in the south line of the J. J. Scott Survey Abstract No. 1449; thence west along said survey line 2540.8 feet M/L to the S. W. corner of said J. J. Scott Survey, said point also being in the Fort Worth Corporate Boundary; thence south along said Fort Worth Corporate Boundary to the south right-of-way line of County Road No. 1078; thence east along the south right-of-way line of County Road No. 1078 to the point of beginning and containing approximately 130 acres. S. Highway No. 81 (south) (I-35W) and the centerline of State Farm to Market Highway No. FM 1059, said point being 98 feet west from the northeast corner of the M. P. Scott Survey, Abstract No. 1447. Thence south along the west right-of-way line of U. S. Highway No. 81 (south) (I-35W) 3218.6 feet; thence west 2540.8 feet to a point in the west line of the J. J. Scott Survey, Abstract No. 1449, said point also being in the Fort Worth Corporate Boundary; thence north along said corporate boundary a distance of 640 feet M/L to an angle point in said boundary; thence west along said corporate boundary to the west right-of-way line of the M.K. & T. RR; thence northerly along the west line of the M. K. & T. RR to the center line of State Farm to Market Highway No. FM 1059; thence east along the centerline of sait! Highway FM 1059 to the point of beginning and containing approximately 232.0 acres. (S.W. corner U. S. Hwy. 81 and F.M. Hwy #1059) FROM "UNZONED" AND "B" TO "A-G" Being a portion of the J. Asbury Survey, Abstract No. 47 and a portion of the G. Hernandez Survey, Abstract No. 753 situated about seven miles south from the Courthouse of Tarrant County, Texas and being more particularly described as follows: beginning in the north line of Lot 6, Block A, Highland Terrace Addition as said Block appears upon the map of record in Volume 388-8, Page 87 of the Deed Records of Tarrant County, Texas, said point being 308 feet west from the southwesterly right-of-way line of U. S. Highway No. 81 (south) (I-35W). Thence westerly along the northerly line of Block A, Highland Terrace Addition, and along said line produced westerly, approximately 1560.0 feet to its intersection with the easterly right-of-way line of the M.K. and T. RR; thence northeasterly along said right-of-way line approximately 1830.0 feet to the south line of a tract zoned "K" Heavy Industrial by Ordinance No. 5370 adopted May 17, 1965; thence east along the south line of said tract approximately 590.0 feet to a point 350.0 feet west from the south- westerly right-of-way line of old-U. S. Highway No. 81 (south), said point being in the southwesterly line of an "I" Light Industrial District estab- lished by Ordinance No. 4288 adopted May 13, 1960, said District line being 300.0 feet southwesterly from the perpendicular to the southwesterly right- of-way line of old U.S. Highway No. 81 (south); thence along said "I" Light. Industrial District line; southeasterly approximately 580.0 feet and north- easterly 40.0 feet and southeasterly approximately 1235.0 feet to the place of beginning and containing approximately 43.0 acres. (North of Stratton Street) FROM "UNZONED" TO "A-G" f , SECTION 2. The zoning regulations and districts, as herein established, have been made in accordance with the comprehensive plan for the purpose of promoting health, safety, morals and the general 4elfare of the community. They have been designed to lessen congestion in the streets; to secure safety from fire, panic, flood and other dangers; to provide adequate light and air; to prevent overcrowding of land; to avoid undue concentration of population; to facilitate the adequate provisions of transportation, water, sewerage, parks and other public require- ments. They have been made after a full and complete public hearing with reasonable considera- tion among other things, of the character of the district and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. SECTION 3. This ordinance shall be cumulative of all other ordinances of the City of Fort Worth affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances are in direct conflict with the provisions of this ordinance. SECTION 4. Should any section, clause or provision of this ordinance be declared by the court to be in- valid, the same shall not affect the validity of the ordinance as a whole or any part thereof, other than the part so declared to be invalid. SECTION 5. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not less than Five and No/100 Dollars ($5.00) no more than Two Hundred and No/100 Dollars ($200,00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 6. This ordinance will take effect and be in full force and effect from and after its passage and publication as required by law. APPROVED AS TO FORM AND LEGALITY: .
