HomeMy WebLinkAboutOrdinance 23826-09-2019 Ordinance No.23826-09-2019 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WRMC MUSEUM LOT PROJECT, IN THE AMOUNT OF $300,000.00 IN THE PUBLIC EVENTS CAPITAL FUND, WITH $250,000.00 COMING FROM AVAILABLE FUNDS AND $50,000.00 COMING FROM TRANSFERRED FUNDS; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2018-2019 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the WRMC Museum Lot project in the amount of $300,000.00 in the Public Events Capital Fund, with $250,000.00 coming from available funds and $50,000.00 coming from transferred funds. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 23392-09-2018 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. DISCUSSION: The purpose of this M&C is to take actions to provide funding for the rehabilitation of the City-owned parking lot,commonly known as the Gendy/Harley Parking Lot. Actions include making adjustments in the Municipal Parking Fund operating budget to make$50,000.00 available for a transfer to the Public Events Capital Fund and appropriating a total of$300,000.00 in the Public Events Capital Fund, including the transferred funds,for the project. Rehabilitation of the parking lot is proposed in conjunction with capital improvements being funded by the National Cowgirl Museum and Hall of Fame, Inc. ("Cowgirl Museum")in the same vicinity and in preparation for use during events associated with the Dickies Arena. The City of Fort Worth has leased the parking lot located at the northeast corner of Harley Street and Montgomery Street,specifically 1600 Gendy Street,to the Museum of Science and Natural History since December of 2012. The execution of the second amendment to that lease(CSC No. 43957-A2)on June 24,2019,removed a portion of that parking lot from the lease agreement, reduced the rental price accordingly,and terminated the lease agreement effective October 1,2019. Also,on June 26,2019,execution of the third amendment of the land lease agreement(CSC No.52487)between the City and the Cowgirl Museum approved a plan for South Plaza Improvements, including the design,construction and installation of a screening wall with decorative mural,additional green space and hardscape improvements. The Cowgirl Museum raised funds from private donors for the design,construction, and installation of these improvements and is responsible for ongoing maintenance per the lease agreement. These South Plaza Improvements include the conversion of approximately 50 of the 250 parking spaces in the Gendy/Harley Parking Lot,which prompted the need for the amendment to the parking lease with the Museum of Science and Natural History. Construction on the South Plaza Improvements began the first week in August,and November 13,2019,is the target date for completion. In conjunction with these two lease amendments,the City initiated design work for the rehabilitation of the Gendy/Harley Parking Lot and executed an agreement with Dunaway Associates, L.P. (CSC No.52548)administratively on July 15,2019,for engineering related design services in the amount of$17,187.00 for rehabilitation of the remaining 200 spaces in the parking lot. It is anticipated that minor drainage improvements, milling,and overlaying the remaining 200 parking spaces of the existing hot-mix asphalt parking lot,as well as grading at the Harley entrance to tie into the South Plaza Improvements will cost approximately$300,000.00 of which $250,000.00 is available in the Public Events Capital Fund and$50,000.00 is provided by the Municipal Parking Fund upon approval of the recommendation herein. Construction work on the parking lot is proposed to begin the first week of October 2019,and to be completed by the South Plaza Improvements target date of November 13,2019. No additional operating fiscal impact to the City is anticipated from the rehabilitation of the Gendy/Harley Parking Lot. A Form 1295 is not required because: This MSC does not request approval of a contract with a business entity. FISCAL INFORMATION I CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinances,funds will be available as appropriated in the Public Events Capital Fund.
