AN ORDINANCE DISCONTINUING TERRITORY FROM WITHIN THE CORPORATE LIMITS OF THE CITY OF FORT WORTH; PROVIDING THAT THIS ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN DIRECT CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the hereinafter described territory within the corporate limits of the City of Fort Worth be and the same is hereby discontinued as a part of the City of Fort Worth; said territory being more particularly described by metes and bounds as follows: BEING the Ella Young Lake Worth Addition, Epps Subdivision and unsub- divided portions of the J. Wilcox Survey, No. 33, Abstract No. 1716, and the J. Wilcox Survey No. 34, Abstract No. 1717, situated in Tarrant County, Texas, about 8 miles northwesterly from the Tarrant County Courthouse and being more particularly described by metes and bounds as follows: BEGINNING at a point for corner in the north line of the J. Wilcox Survey No. 33, Abstract No. 1716, a distance of 1,240 varas west from its northeast comer. Wilcox Survey No. 33, Abstract No. 1716. THENCE south 88 degrees, 33 minutes east along and with the north line of the said Wilcox Survey 1,709.9 feet to the place of beginning and con- taining approximately 0.293 square miles of land. SECTION 2. THAT this ordinance shall and does hereby amend every prior ordinance in direct conflict herewith, but as to all other ordinances or sections of ordinances not in direct conflict herewith, this ordinance shall and the same is hereby made cumulative. SECTION 3. That it is hereby declared to be the intent of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, para- graphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after its passage, and it is so ordained. APPROVED AS TO FORM AND LEGALITY: S. G. The Council referred the Z , petition to the staff for investigation and report. Val.S The area requested for deannexation is the same area annexed by Ordinance No. 6460 on May 13, 1971, as shown on the attached Exhibit "A", and embraces the Ella Young Lake Worth Addition, Epps Subdivision and unsubdivided por- tions of the J. Wilcox Survey, Abstract No.' 1716. The area consists of approximately 187 acres or about 0.293 square miles of land. This area, located on the west side of Lake Worth, lies north and south of Jacksboro Highway and is generally bounded on the east, south and north by City-owned property and on the west by Rankin Road. The west right-of-way line of Rankin Road is the common boundary line between the City of Fort Worth and the Town of Lakeside. This area was furnished most City services immediately upon annexation in 1971, and the services have continued up to the present date. City of Fort Worth water and sewer lines have not been installed because there has been no request from the property owners for installation of such facilities under standard policies. There have been objections by the residents of the area concerning the high rates for water charged by the City of Lakeside. On August 12, 1974 (M&C G-2476) , a proposal to purchase the City of Lakeside's water system located in the Ella Young Addition was not ap- proved by the City Council. With the exception of water and sewer, City of Fort Worth services to the area have been provided at a- level equivalent to or higher than those provided in other comparable areas. The attached report was considered by the Plan Commission at its regular meetings on September•24 and October 29, 1975. In the review and analysis of this matter, the Commission found the following: Effect of Requested Deannexation on City 1. City would lose zoning and building inspection controls over develop- ment. 2. Area would still fall within Fort Worth's extraterritorial jurisdiction, therefore, would continue to be subject to requirements for platting and development contained in the Subdivision Ordinance. 3. City would lose approximately $19,167 in ad valorem tax yield which it is felt does not pay the cost of services now being rendered by the City. 4. City would not have to make extraordinary future capital improvement expenditures to provide water and sewer service to the area. Their water and sewer problems would not be solved. 2. They would lose all services now being rendered by the City. 3. They would not have to pay City taxes. The Commission concluded that the cost of services to this area will always exceed tax revenue received, therefore, it is not now nor will it ever be an economic asset to the City. Because of the apparent negative cost benefit ratio to the City and the fact that a majority of property owners (see attached Exhibit "C") within this area signed the deannexation petition, the Commission voted unanimously to recommend to the City Council that the area be deannexed as requested. Staff Comments on Plan Commission Findings (1) The indicated loss of $19,167 in tax revenue would not be offset by an accompanying reduction in City expenses, since it would not be feasible to reduce staffing nor departmental budgets because of the deannexation. Cost-revenue analysis, while being an important criterion for consider- ing annexation-deannexation decisions, is not the only matter that must be evaluated in arriving at a decision. (2) The residents of the Ella Young Addition would still have the oppor- tunity to utilize and enjoy certain City facilities and services such as parks, libraries, fire protection, etc. All services would not be lost as indicated in #2 above, "Effect of Requested Deannexation on Ella Young Area Property Owners". There is no effective way to prevent use of these facilities and services by persons residing outside the City. Therefore, Ella Young residents would continue to receive the benefits of these services but would be contributing nothing to their upkeep should the area be deannexed. Should the City Council' choose to deannex the petitioned area, it is pro- posed that a triangular portion of the J acksboro Highway and Rankin Road, as included in the area outlined on Exhibit "B", also be deannexed since the areas adjacent would no longer be within the City of Fort Worth. An ordinance providing for deannexation of the area in question has been prepared and is available for Council consideration. Recommendation The Plan Commission recommends that the area outlined on Exhibit "B" be deannexed.
