HomeMy WebLinkAboutOrdinance 1890 ORDINANCE NO 1$q 0 AN ORDINANCE PROVIDING FOR THE SUEIISSION TO THE QUALIFIED ELECTORS, WHO OWN TAXABLE PROFERTY IN THE CITY OF FORT WORTH, TEXAS AND WHO HAVE DULY RENDERED THE SANG FOR TAXATION, A PROPOSITION FOR THE ISSUANCE OF NEGOTIABLE COUPON BONDS OF SAID CITY IN THE AGGREGATE SUM OF TWO HUNDRED FIFTY THOUSAND DOLLARS ($250,000.00) FOR THE PURPOSE OF MAKING PERMANENT IMPROVENtMM IN SAID CITY BY CONSTRUCTING, BUILDING, EQUIPPING AND IMPROVING PLEASURE GROUNDS, PARKS AND PLAYGROUNDS AND SECURING AND AOgUIRING THE NECESSARY LANDS AND SITES THEREFOR, AND INCLUDING IN SUCH IMPROVEMENTS, BUILDINGS TO HOUSE AND KEEP LIVE STOCK FOR EKHIBITICK PURPOSES AND BUILDINGS FOR PUBLIC Eiv'=AMENTS, EXHIBITING AGRICULTURE, LIVE STOCK AND COMMERCIAL PRODUCTS, SAID BONDS TO BE IN SUCH DENOMINATIONS AS MAY BE DETERMINED BY THE CITY COUNCIL, MATURING WITHIN FORTY (40) YEARS FROM THE DATE THEREOF, BEARING INTEREST FROM THE DATE THEREOF AT A RATE NOT TO EXCEED FOUR PER CENT (4%) PER ANNUM, PAYABLE SWI-ANNUALLY, EXPRESSED IN COUPON NOTES ATTACHED TO THE BONDS, LEVYING A SUFFICIENT TAX TO PAY THE INTEREST ON SAID BONDS AND CREATING A SINKING FUND SUFFICIENT TO REDEEM SAID BONDS AT TO MATURITY THEREOF, AND CALLING A SPECIAL ELECTION FOR THE PURPOSE TO BE HELD IN THE CITY OF FORT WORTH, TEXAS, ON TUESDAY, THE WM DAY OF JANUARY, A. D. 1936. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION I. That a special election be held in the City of Fort Worth, Texas, on Tuesday, the 28th day of Tannery, A. D. 1936 at the polling places herein- after described, between the hours of seven o'clock a. m., and seven o'clock p. m., at which election the following proposition for the issuance of bonds for the City of Fort Worth, Texas, shall be submitted to the qualified electors, who own taxable property in said City and who have duly rendered the same for taxation: I. Shall the City of Fort Worth, Texas, through its City Council, issue its negotiable coupon bonds in the principal sum of Two Hundred Fifty Thousand Dollars ($250,000.00), for the purpose of making permanent improve- ments in said City by constructing, building, equipping and improving pleasure grounds, parks and playgrounds for the City of Fort Worth, Texas, and for securing and acquiring the necessary lands and sites therefor, and including in such improvements, buildings to house and keep live stock for exhibition purposes and buildings for public entertainments, exhibiting agriculture, live stock and commercial products, said bonds being payable serially as may be determined by the City Council, so that the last maturing bonds shall become payable within forty (40) years from the date thereof, bearing interest at a rate not to exceed four per cent (4%) per annum from the date thereof, payable semiwannually, and levy a sufficient tax to pay the interest on said bonds and create., a sinking fund sufficient to redeem said bonds at the maturity thereof? SECTION II. That said election shall be held under the provisions of the Charter of the City of Fort Worth, Texas, the Constitution and laws of said State, insofar as same may be applicable, and qualified voters, who own taxable property in said City and who have duly rendered the same for taxation, shall be allowed to vote upon said proposition. SECTION IV. All voters who favor the proposition to issue the pleasure grounds, parks and playgrounds bonds shall have written or printed upon their ballots the words: "FOR the issuance of Pleasure Grounds, Parks and Playgrounds Bonds," and those opposed shall have written or printed upon their ballots the words: "AGAINST the issuance of Pleasure Grounds, Parks and Playgrounds Bonds." SECTION V. The way and manner of holding this election, the notice to be given therefor, the polling places, the personnel of the officers who are to hold the same and all details connected with the holding of the election shall be determined and arranged by the City Council and proper notice of such matters shall be given in a proclamation by the Mayor. SECTION VI. The City Secretary is hereby ordered and direoted to prepare ballots and stamp same "Official Ballot", on which ballots shall be printed the proposi- tions as set forth above. SECTION VII. That all of said bonds shall be in such denominations as may be determined by the City Council and shall mature serially in the regular order in which they are numbered, making the last bonds mature within forty (40) years from the date thereof, unless the City Council, in the exercise of its discretion, shall otherwise provide for such maturity, and said bonds shall be sold at not less than per and shall bear interest at a rate not to exceed four per cent (4%) per annum, payable semi-annually. SECTION 9III. That in the event said bonds are authorized at the special election hereby ordered, the City Council of the City of Fort Worth may issue for sale any part or portion of said amount at such time and times as in the judgment of the City Council it determines that a lawful interest and sinking fund may be provided for to take care of and discharge any part or portion of the bonds so issued for sale; it being the purpose of this section to make clear that the City Council of the City of Fort Worth may not be required to issue the full amount of any series of bonds, as herein submitted, but may issue for sale any portion of the same at such time and times as it deems advisable under the authority hereby conferred at the said election. SECTION IX. That the City Secretary shall furnish election officials said ballots, together with any other forms or blanks, in accordance with the Charter of the City of Fort Worth and the laws of the State of Texas, insofar as same are applicable. SECTION X. A copy of this ordinance, signed by the Mayor of the City of Fort Worth, Texas, and attested by the City Secretary, shall serve as a proper notice of said election. SECTION XI. The City Secretary is hereby authorized and directed to cause said notice of the election to be posted up in each of the election precincts of the City, and also at the City Hall, not less than fifteen (15) days before the date of said election. SECTION XII, That the notice of said election shall be published on the same day in each of two (2) successive weeks in a newspaper of general circulation published in said City, the date of the first publication to be not less than fourteen (14) days prior to the date set for said election, as provided by Article 704 of the Revised Civil Statutes of 'texas and other appropriate provisions. SECTION XIII. This ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. Mayor of the City of Fort Worth, Texas.
