HomeMy WebLinkAboutOrdinance 2690 ORDINANCE NO. 2- AN ORDINANCE RECEIVING AND ACCEPTING THE WORK OF IMPROVING THE FOLLOWING STREET AND PORTIONS THEREOF, TO-WIT: DEXTER STREET FROM THE EASTERLY LINE OF CLOVER LANE TO THE WESTERLY LINE OF SLITTER STREET, IN THE CITY OF FORT WORTH, TEXAS; AUTHORIZING AND DIRECTING THE EXECUTION AND ISSUANCE OF SPECIAL ASSIGNABLE ASSESSMENT CERTIFICATES TO BROWN & ROOT, INC. THE CONTRACTOR PERFORM- ING SAID WORK, AND PR6VIDING THAT THIS ORDINANCE SHALL TAKE EFFECT IMMEDIATELY UPON ITS PASSAGE AND APPROVAL. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, DULY ASSEMBLED: SECTION I. That the work of improving the following street and portions thereof in the City of Fort Worth, Texas, to-wit: DEXTER STREET FROM THE EASTERLY LINE OF CLOVER LANE TO THE WESTERLY LINE OF SUTTER STREET, by raising, grading, filling, widening, paving, repaving, or repairing same, and by constructing, reconstructing or realigning combined concrete curbs and gutters where determined necessary by the Director of Public Works, and by constructing or reconstructing such other drains, drainage structures, incidentals and appurten- ances thereto as deemed necessary and adequate by the Director of Public Works, and as provided for by the plans and specifica- tions for such improvements; said paving consisting of the con- struction or reconstruction of a three (3) inch compacted gravel base and the construction or reconstruction of a three and one-half (3*) inch hot mix asphaltic concrete base course on said founda- tion course, and the construction thereupon of a wearing surface of one and one-half (1*) inch .hot mix asphaltic concrete surface course, all of the materials, types and widths as shown on and provided for in the plans and specifications, and all of said improvements having been performed and completed in full com- pliance with all the terms and provisions of the contract dated September 13, 1948, between the said City of Fort Worth, Texas, and Brown & Root, Inc. , approved by Ordinance of the City Council of said City dated August 18, 1948, and said plans and specifications therein contained; and said Director of Public Works having measured, examined, and caused to be tested the finished improvements by the means and in the nammer provided by the terms of said contract and the plans and specifications therein contained, and said Director of Public Works having found that such improvements have been constructed and completed in full compliance with all provisions of said contract and said plans and specifications, and said Director of Public Works having approved and accepted said work and improvements, and having heretofore issued his Certification of Completion and Final Acceptance, and so certified to the City Manager and to said City Council and recommended that said City Council accept and receive said work and the improvements as constructed and completed by said Brown & Root, Inc., and said work and improve- ments having been found by the City Manager of said City of Fort Worth, Texas, to have been performed and completed in full compliance with said contract and said plans and specifications therefor, and having been accepted by said City Manager, said work and improvements are hereby found by said City Council to have been performed and completed by said Brown & Root, Inc. in full compliance with the terms and provisions of said contract and said plans and specifications therefor, and same are hereby accepted and received by said City Council of the City of Fort Worth, Texas. SECTION II: That the Mayor and City Secretary of the City of Fort Worth, Texas, are hereby authorized and directed to execute and issue to Brown & Root, Inc. special assignable assessment certificates evidencing the assessments levied against the properties improved abutting upon the above described street and against the real and true owners thereof, which, by the terms of 2. i said contract, the City of Fort Worth, Texas, has agreed and obligated itself to issue and deliver to said Brown & Root, Inc. in accordance with the provisions of the Final Assessment Ordinance and other proceedings heretofore had and adopted by said City Council; said Special Assessment Certificates shall be executed in the name of said City by its Mayor and City Secretary, and impressed with the seal of said City, and dated as of the date hereof, and such officers are hereby authorized and directed to execute said certificates in their official capacities on behalf of said City, and deliver same to said Brown & Root, Inc. SECTION III: This Ordinance shall take effect and be in full force from and after its passage. PASSED and APPROVED, this the day of , 191+9. MA OR OF THE CITY OF FORT WORTH, TEXAS.
