AN ORDINANCE PERMITTING ALICE R. BITTICK, A FEME SOLE,
HER HEIRS AND ASSIGNS, TO LEAVE THE EXISTING BUILDING
FOR A MAXIMUM DISTANCE AS IT IS NOW LOCATED IN COLLEGE
AVENUE ALONG THE WEST LINE OF THE WEST ONE-JMIRD OF
LOT 1, BLOCK 3, COLLEGE HILL ADDITION TO THE CITY OF
FORT WORTH, TARRANT COMM, TEXAS, AND THE STEPS AS THEY
ARE NOW LOCATED IN PENNSYLVANIA AVENUE ALONG THE NORTH
LINE OF SAID PORTION OF SAID LOT 1, BLOCK 3, COLLEGE HILL
ADDITION; AND PROVIDING THAT THIS ORDINANCE SHALL BECOME
EFFECTIVE IMMEDIATELY.
WHEREAS, Alice R. Bittick is the owner of the West one-third of
Lot 1, Block 3, College Hill Addition to the City of Fort Worth, Tarrant
County, Texas, along the west line of which a property encroachment exists
in College Avenue, and along the north line of which a property encroach-
ment exists in Pennsylvania Avenue; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That Alice R. Bittick, a feme sole, the owner of said lamd above
described and the improvements situated thereon, and her heirs and assigns,
be permitted to leave the existing building for a maximum distance of ap-
proximately four inches as said building now exists in College Avenue for
a distance of approximately forty feet along the west line of the West one-
third of said Lot 1, Block 3, College Hill Addition, and that the portion
of the steps encroaching in and upon Pennsylvania Avenue along the north
line of the West one-third of Lot 1, Block 3, College Hill Addition, be per-
mitted to remain in said Pennsylvania Avenue; and that said improvements
on said above described property be allowed to stand during the life of
said building as the same is now constructed, provided, however, that in
the event such building be demolished or major alterations and repairs be
made to said building in the future, said building and that portion of the
steps presently located in Pennsylvania Avenue shall be reconstructed or re-
paired so as not to encroach upon either College Avenue or Pennsylvania
Avenue and so as to be in compliance with the then existing ordinances, rules
and regulations of the City of Fort Worth, Texas. It is specifically agreed
and understood that the City of Fort Worth shall never be held liable for
any suits, causes of action or claims for damages by reason of the existence
of such encroachments in and upon College and Pennsylvania Avenues; and the
said Alice R. Bittick, her heirs and assigns, in consideration of the grant-
ing of such permission, agrees to indemnify and save whole and harmless
the said City of Fort Worth from any and all costs, expenses or damages
arising out of any claim or cause of action, whether real or asserted, as
a result of said encroachments being permitted to remain in said streets.
SECTION 2.
This this ordinance shall take effect and be in full force and ef-
fect from and after the date of its passage.
