HomeMy WebLinkAboutOrdinance 5290 � aT+ ORDINANCE NO. f O AN ORDINANCE PROVIDING THAT THE EIGHT FOOT ALLEY IN BLOCK 5, MULKEY'S SUBDIVISION OF BLOCK 1, FIELDS WELCH ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, BE ABANDONED, VACATED AND CLOSED; PROVIDING FOR THE REVERSION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LAND; REPEALING ALL OR- DINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,, TEXAS: SECTION 1. That the eight foot alley in Block 5 of Mulkey's Sub- division of Block 1, Fields Welch Addition to the City of Fort Worth, Tarrant County, Texas, between the west line of Galveston Avenue and the east line of St. Louis Avenue, be and the same is hereby vacated, closed and permanently aban- doned as an alley or public thoroughfare of any kind or char- acter whatever. SECTION 2. That the interest of the City of Fort Worth in the fee to the land in said portion of the alley is hereby released and shall revert to the adjacent owner of the fee as provided by law, save and except that the full width of the alley is retained as an easement for any and all existing utilities. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. City of Fort Worth, Texas Mayor and Council Communication DATE REFERENCE SUBJECT: Requested Closing - East-West PAGE NUMBER Alley in Block 5, Mulkey's Subdivision 1 12/7/64 PZL120 of Block 1, Fields Welch Addition 1of Kemble Brothers Furniture Company, owner of all lots in Block 5, Miulkey's Subdivision, has requested the closing of the alley bisecting the block from the east line of St. Louis Avenue to the west line of Galveston Avenue, as shown on the attached plat. Closing the alley and replatting the block to eliminate interior lot lines will permit redevelopment of the block as the site of a new commercial building. A recommendation by the Zoning Commission for re-zoning the north half of the block "G" Commercial (the south half is now zoned "G") will be considered by the City Council on December 14, 1964, during the regular zoning hearing. Private utility companies and the Public Works, Traffic Engineering, Water, and Planning Departments have reviewed the request and do not object to the proposed closing, provided an 8 foot wide strip in the alley is retained as an easement for an existing 10 inch sanitary sewer line. The property owner has been notified of the existence of the sanitary sewer and has agreed to install cast iron sewer in accordance with standard policies, if the pro- posed building is constructed over the easement. On November 12, 1964, the City Plan Commission reviewed the request and recommended adoption of an ordinance abandoning the alley as requested, pro- vided the easement is retained for the existing sanitary sewer line.
