HomeMy WebLinkAboutOrdinance 3091 x f F ORDINANCE NO, AN ORDINANCE AMENDING CHAPTER 26 OF THE CODE OF THE CITY OF FORT WORTH, 1950, ADOPTED UNDER ORDINANCE NO. 2870, BY ADDING TO THE SAID CHAPTER 26 A SECTION DESIGNATED AS "SECTION 38, ARREST WITHOUT WARRANT"; PROVIDING FOR THE ARREST OF PERSONS FOUND IN SUSPICIOUS PLACES AND UNDER CERTAIN CIRCUMSTANCES WITHOUT WARRANT; PROVIDING A SAVING CLAUSE IN-THE EVENT THAT ANY PART OF THE ORDINANCE SHOULD BE DECLARED UNCONSTITUTIONAL; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,TE%AS: SECTION 1 That Chapter 26 of the Code of the City of Fort Worth, 1950, be amended by adding thereto an additional section designated as "Section 38, Arrest Without Warrant", reading as follows: SECTION 38 ARREST WITHOUT WARRANT It shall be the duty of all policemen to arrest without warrant all persons found in suspicious places and under circumstances which reasonably show that they have been guilty of some felony or breach of the peace, or who threaten to or are about to commit some offense against the laws. SECTION 2 Should any part, section, sub-section, paragraph, sentence, elause or phrase contained in this ordinance be held to be unconstitutional, such hold- ing shall not affect the validity of the remaining portion of the ordinance, but in all respects said remaining portion shall be and remain in full force and effect; and the City Council hereby declares that it would not have passed the unconstitutional part had it known it was invalid and that it would have passed the remaining part tha£ is no v .-"- SECTION 3 That this ordinance shall be cumulative of all providions of the Code of the City of Fort Worth, 1950, said Code having been adopted under Ordinance No. 2870, and any other ordinance of the City of Fort Worth relating to offenses 3 t and arrest without warrant except in those instances wherein the provisions of this ordinance are in direct conflict with such other ordinances, in which instances said conflicting provisions of other ordinances and the Code of the City of Fort Worth, 1950, are hereby repealed. SECTION 4 This ordinance shall become effective and be in full force and effect as of the date of its passage by the Council.
