ORDINANCE NO. ��� ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF Norma Street AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT WITH SRO Asphalt, Inc., Arlington, Tex. FOR THE CONSTRUCTION OF SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPRO- PRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract with SRO Asphalt, Inc., Arlington,,Texas for the making and construction of certain street improvements on the hereinafter described portions of streets, avenues and public places in said City, to-wit: 1. NORMA STREET: From the east line of Hughes Street to 228' East, known and designated as Unit 1, Project No. 104-24000-158. 2. KING COURT: From the east line of Weiler Blvd. to 275' East, known and designated as Unit 2, Project No. 104-24000-158. 3. KIPLING STREET: Deleted by City Council November 7, 1966, (M & C No. G-1014). 4. BIRDELL COURT: From the North line of Fitzhugh Street to the south line of Ramey Avenue, known and designated as Unit 4, Project No. 104-24000-158. 5. COTTEY STREET: From the east line of Dillard Street to the west line of Burger Street, known and designated as Unit 5, Project No. 104-21+000-158. 6. COTTEY STREET: From the west line of Burger Street to the west line of Stalcup Road, known and designated as Unit 6, Project No. 104-24000-158. 7. JACKSON STREET: From the north line of Wilbarger Street to the south line of Childress Street, known and designated as Unit 7, Project No. 104-24000-158. 8. KELROY STREET: From the east line of Trentman Street to the west line of Miller Street, known and designated as Unit 8, Project No. 104-24000-158. The making and construction of street improvement in this unit only as set out and described in Ordinance No. 5670 adopted November-7, 1966, is hereby abandoned,]avo the assessments levied in 9*Ad Ordinance Against property abutting this unit only and all prior proceedings in connection with same are hereby cancelled as provided for in Sec. 10, Art. 1105b, of the Revised Civil Statute of Texas as amended. WHEREAS, by sundry proceedings heretofore passed by the City Council of the 4',Lty of Fort Worth, Texas, including Ordinance No. _2670 , a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each, of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice a_nd equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. .- 5670 .. and WHEREAS., the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT- I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. The Mayor, be, and he is hereby, directed to issue and execute in the name cf the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows. J t R III. When each of the certifiactes has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector as part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. Asphalt Inc. Contract awarded: October 24, 1966 (M&C C-824) Work Order issued: January 9, 1967 Wor� Order effective: January 18, 1967 Dupe of final inspection and approval: April 14, 1967 Working time bid: 61 working days Working time used: 54 working days Project Cost and Financing Bid price: $64,991.05 Revised bid price: $42,516.75 Kipliag Street (Unit 3) was deleted by the City Council at the benefit hearing on November 7, 1967 (M&C 6-1014) , when it became evident that a majority of the property owners had changed their attitude and opposed the paving improvements. Kelroy Street (Unit 8) was deleted from the contract when it was determined by the Water Department that a 54 inch water transmis- sion main is proposed for construction in Kelroy Street in the near future, but could not schedule the line installation ahead of the proposed street improvements. Kelroy Street will be paved in a future project after work is completed on the water transmis- sion main. Final Contract cost: $44,105.26 Partial payments previously made: 3 Amount: $39,277.13 Final payment due: $4,828. 13 Payment to be made from Project No. 104-24000-158 Deviation from Bid price: $1,588.51 over-run - variations between quantities measured and used at the job site account for the dif- ference.
