HomeMy WebLinkAboutOrdinance 4091 4 � ORDINANCE NO. �� AN ORDINANCE AMENDING PARAGRAPH V OF ORDINANCE 4072 PASSED ON THE 27TH DAY OF MARCH, 1959, SO AS TO AUTHOR- IZE THE CITY ENGINEER (PUBLIC WORKS DIRECTOR) TO INCLUDE IN THE ESTIMATE OF THE COST OF THE IMPROVEMENTS BEING PREPARED BY HIM THE COST OF CERTAIN WORK AND MATERIALS TO BE PERFORMED PURSUANT TO BID ITEMS 2.3 THROUGH 2.24 OF THE BID OF LEWIS AND LEWIS AND TO CREDIT THE AMOUNTS TO BE PAID BY THE CITY FOR SUCH WORK AND MATERIALS AGAINST THAT PORTION OF THE COST OF SUCH IMPROVEMENTS WHICH THE CITY IS REQUIRED TO PAY UNDER APPLICABLE LAW WHEREAS, the City Council of the City of Fort Worth has heretofore by Ordinance 4072 duly passed and enacted on the 27th day of March, 1959, accepted the bid of LEWIS AND LEWIS for the construction-\of certain street improvements, and accepted the bid of FIRST OF TEXAS CORPORATION to act as Fiscal Agent for the City in connection with such improvements, and authorized the City Man- ager to enter into contracts with LEWIS AND LEWIS and with FIRST OF TEXAS CORPORATION, and appropriated funds for the purpose of satisfying said contracts; and WHEREAS, in Paragraph V of said ordinance, the Public Works Director (City Engineer and the Fiscal Agent were instruct- ed to begin the preparation of an engineer's estimate of cost of the street improvements in each unit and a property owners' roll; and WHEREAS, the Public Works Director (City Engineer) was, in Paragraph V of said ordinance, instructed to include no part of the Fiscal Agent's fee nor any part of bid items 2.3 through 2.24 in the costs to be assessed against the owners of abutting proper- ties and their properties; and WHEREAS, it is the desire of the City Council that in computing the percentage of the cost of the improvements which is to be paid by the City of Fort Worth, that the amount to be paid by the City for payment of the work and materials to be done pur- suant to bid items 2.3 through 2.24 of the bid of Lewis and Lewis may at the option of the Public Works Director (City Engineer) be credited against that portion of such cost which the City is re- quired to pay under applicable law; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH: That the last sentence of Paragraph V of Ordinance 4072 be and the same is hereby amended to read as follows: "In repar- ing such estimate the City Engineer {Public Works Director shall include no part of the fee of the Fiscal Agent nor any part of the cost of engineering but he may include the cost of the work and materials called for in bid items 2.3 through 2.24, contained in the bid of Lewis and Lewis. The City shall pay the entire cost of the work and materials embodied in such bid items, but the City Engineer (Public Works Director) may at his option credit the cost of such items to be so paid by the City against that portion of the cost of the improvements which the City is required to pay under applicable law." Except as herein specifically amended, Ordinance 4072 shall continue in full force and effect, and the provisions thereof are hereby ratified and confirmed.
