HomeMy WebLinkAboutOrdinance 7091 ORDINANCE NO. _!1 0 9 I AN ORDINANCE AMENDING CHAPTER 37 OF THE FORT WORTH CITY CODE (1964), WHICH CHAPTER REGULATES THE FURNISHING OF WATER AND SEWER SERVICE, BY INCREASING CHARGES; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES AND PROVISIONS OF THE FORT WORTH CITY CODE IN CONFLICT HEREWITH; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 . That Section 37-23 of Chapter 37 of the Fort Worth City Code is hereby amended, and, after being so amended, same shall read as follows: Sec. 37-23. To be read monthly; bills; customer charges. (a) Meters shall be read monthly and the customer notified in writing or otherwise of the amount of water and/or sewer service charges against him for such month. Such notice may be furnished by depositing a bill for water and/or sewer service charges in the United States mail directed to the last known address of the cus- tomer. Unless such water and/or sewer service charges are paid within ten (10) days from the date of the bill , an additional charge of four Dollars ($4.00) for processing the delinquent account will be made for notification and the water may be turned off or the sewer service line disconnected. In cases where the water has been turned off or the sewer service line disconnected, such water will not be turned on again until the total amount due is paid (including the Four Dollar ($4.00) charge for field action taken on the deliquent account), plus an additional fee of Four Dollars ($4.00) for locking and/or removing the water meter; the sewer line shall not be reconnected until said total amount due and an additional fee of Five Dollars ($5.00) for disconnecting such line have been paid. In such cases where the water has been turned off and the water service line or meter installation is broken, removed, destroyed or otherwise damaged, an additional fee of Ten Dollars ($10.00) shall be collected from the customer before water and sewer service will be restored. (b) In cases where the water meter is already in place or for any reason is installed prior to the payment of the meter deposit by the customer, the deposit must be made within seven (7) calendar days from the date of application for service. If the meter deposit is not received by the City Waterworks Department within such period, a Four Dollar ($4.00) processing charge shall be made against the customer and the water service may be turned off. (c) For all customers requesting a transfer of service, a Seven Dollar ($7.00) transfer charge shall be made. (d) For all work done in setting a meter or activating a water service, where the request is made after normal working hours, a Five Dollar ($5.00) after-hour charge shall be made. (e) For all customers requesting the setting of a meter or activating of a water service, a $3.50 charge shall be made. (f) For all Return Checks from the bank requiring field action a $4.00 charge shall be made. (g) For all Return Checks from the bank a charge of $3.50 shall be made for handling that check. (h) For all accounts that were discontinued due to being delinquent or due to a return check, a $3.50 charge shall be made for resetting or turning on the water service. -2- SECTION 2. This ordinance shall repeal every prior ordinance and provision of the Fort Worth City Code in conflict herewith but only insofar as the portion of such prior ordinance or provision shall be in conflict, and as to all other ordinances or provisions of the Fort Worth City Code not in direct conflict herewith, this ordinance shall be and is hereby made cumulative. SECTION 3. That all rights or remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions of Chapter 37 of the Code of the City of Fort Worth (1964), as amended, and of any other ordinance affecting water and sewers which have accrued at the time of the effective date of this ordinance; and, as to such accrued violations and all pending litigations, both civil and criminal , whether pending in court or not, under such chapter and/or other ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. SECTION 4 That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordi- nance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared void, ineffective or unconstitutional by the valid judgment or final decree of a court of competent jurisdiction, such voidness, ineffectiveness or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incor- poration herein of any such void, ineffective or unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5. A violation of any of the above rules and regulations of the City Waterworks as set out herein, or a doing or causing to be done by any person or persons, firm or association, of any of the things or acts forbidden or made unlawful in any of such rules and regulations, shall be deemed to constitute a violation under the terms of this ordinance and an offense, and shall be punish- able as such; and for each and every violation of the terms of this ordinance, the person, firm, association or corporation shall , upon conviction thereof in the Corporation Court, be fined not to exceed Two Hundred Dollars ($200.00), and each violation and each day there is a failure to comply with the terms of this ordinance shall constitute a separate offense. -3- SECTION 6. This ordinance shall be in effect and be in full force and effect from and after the date of its passage and publication as required by law, and it is so ordained. In addition, the Public Works Department has. reviewed the cost of street repairs after water and sewer taps are installed. The studies indicate a need to revise current charges to better reflect actual costs. The service charges are- for services rendered that are not used by the majority of water customers. I. Charges for Special Services Presently a $3.00 charge is made for all special services covered by ordinance. To more fairly charge each customer involved'in the services, a study was made to determine costs of the respective special service concerned. Sanitary Sewer Taps The City Code requires that the installation cost of a sanitary sewer tap be paid by the customer. The current sanitary sewer tap charges for taps and services installed by City forces were established by ordinance on August 18, 1969, (M&C G-1417) . The City does not own or maintain the service lateral from building structure to the sewer main. Revenue from the tapping charges should recover the full cost of the new service activity. Last fiscal year 635 sewer taps were installed by City forces. City policy provides for water and sewer taps to be installed ahead of assessment paving projects in residential zoned areas. This cost is borne by the City and is collected when the lots are developed. An additional $30 is charged if the service is activated after the street has been improved. The portion of the City Code dealing with the assessment paving charges for sanitary sewer taps is being revised to conform with the assessment paving charge section dealing with the water taps. C. Water Tap Charges Charges for new water tap installation were established by ordinance effective August 18, 1969, (M&C G-1417) . A tabulation of average costs and revenue is shown on Attachment-A. Taps made by City crews are generally scattered throughout the City and are not usually made in large numbers at one location. Street Repair Charges Street repair charges are made- to recover the cost of cuts made in the street during the time new water taps and sewer taps are installed. A review of present cost indicates that street repairs for sewer and water taps are approximately the same and current charges are not adequate. A tabulation of costs, present charges and repair costs are shown on Attachment B.
