AN ORDINANCE PROVIDING FOR THE REGULATION OF
TRAFFIC IN THE CITY OF FORT WORTH BY AMEND-
ING CHAPTER 26 OF THE FORT WORTH CITY CODE
(1964) BY PROVIDING AND DEFINING A TRAFFIC
CONTROL SIGNAL LEGEND; AUTHORIZING THE CITY
TRAFFIC ENGINEER TO ERECT "YIELD" SIGNS AT
SUCH INTERSECTIONS AS HE MAY DESIGNATE; PRE-
SCRIBING THE NATURE OF "YIELD" SIGNS; PRO-
VIDING REGULATIONS FOR TRAFFIC IN INTERSEC-
TIONS WHERE FLASHING RED SIGNALS OR FLASH-
ING YELLOW OR AMBER SIGNALS ARE DISPLAYED;
PROVIDING REGULATIONS FOR PEDESTRIAN TRAFFIC
AT INTERSECTIONS WHERE "WALK," "DON'T WALK, "
OR "WAIT" SIGNALS ARE DISPLAYED; PROVIDING
PENALTIES; MAKING THIS ORDINANCE CUMULATIVE
OF ALL OTHER ORDINANCES AND SECTIONS OF THE
FORT WORTH CITY CODE REGULATING TRAFFIC;
REPEALING ALL ORDINANCES OR SECTIONS OF THE
CITY CODE IN CONFLICT HEREWITH; PROVIDING A
SEVERABILITY CLAUSE; AND PROVIDING AN EFFEC-
TIVE DATE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That Section 26-31, Traffic-control signal legend,
of Chapter 26 of the Fort Worth City Code (1964) is hereby
amended and after being amended same shall hereafter read
as follows:
"Sec. 26-31. Traffic-control signal legend,
"Whenever traffic is controlled by traffic-control
signals exhibiting different colored lights, or colored
lighted arrows, successively one at a time or in com-
bination, only the colors Green, Red and Yellow shall
be used, except for special pedestrian signals carrying
a word legend, and said lights shall indicate and apply
to drivers of vehicles and pedestrians as follows:
" (a) Green indication
111. Vehicular traffic facing a circular green
signal may proceed straight through or turn right
or left unless a sign at such place prohibits
either such turn. But vehicular traffic, includ-
ing vehicles turning right or left, shall yield
the right-of-way to other vehicles and to pedes-
trians lawfully within the intersection or an
adjacent crosswalk at the time such signal is ex-
hibited.
"2. Vehicular traffic facing a green arrow signal,
shown alone or in combination with another indi-
cation, may cautiously enter the intersection only
to make the movement indicated by such arrow, or
such other movement as is permitted by other indica-
tions shown at the same time. Such vehicular traf-
fic shall yield the right-of-way to pedestrians
lawfully within an adjacent crosswalk and to other
traffic lawfully using the intersection.
"3. Unless otherwise directed by a pedestrian con-
trol signal pedestrians facing any green signal, ex-
cept when the sole green signal is a turn arrow, may
proceed across the roadway within any marked or un-
marked crosswalk.
" (b) Steady yellow indication
"1. Vehicular traffic facing a steady yellow sig-
nal is thereby warned that the related green move-
ment is being terminated or that a red indication
will be exhibited immediately thereafter when vehic-
ular traffic shall not enter the intersection.
112. Pedestrians facing a steady yellow signal are
thereby advised that there is insufficient time to
cross the roadway before a red indication is shown
and no pedestrian shall then start to cross the road-
way.
" (c) Steady red indication
111. Vehicular traffic facing a steady red signal
alone shall stop at a clearly marked stop line, but,
if none, before entering the crosswalk on the near
side of the intersection, and, unless prohibited by
a traffic control sign, may then turn right or, if
the intersecting streets are both one-way streets and
left turns are permissible, may turn left, after
standing until the intersection may be entered safely,
yielding right-of-way to pedestrians lawfully within
an adjacent crosswalk and to other traffic lawfully
using the intersection. Traffic not so turning shall
remain standing until an indication to proceed is
shown.
112. Unless otherwise directed by a pedestrian con-
trol signal pedestrians facing a steady red signal
alone shall not enter the roadway.

" (d) In the event an official traffic-control
signal is erected and maintained at a place other
than an intersection, the provisions of this
section shall be applicable except as to those
provisions which by their nature can have no
application. Any stop required shall be made
at a sign or marking on the pavement indicating
where the stop shall be made, but in the absence
of any such sign or marking the stop shall be
made at the signal.
" (e) The motorman of any streetcar shall obey
the above signals as applicable to vehicles. "
SECTION 2.
That Section 26-34, Yield right-of-way signs--Authorized,
of Chapter 26 of the Fort Worth City Code (1964) is hereby
amended and after being amended same shall hereafter read
as follows:
"Sec. 26-34. Yield signs--Authorized.
"The city traffic engineer is authorized to
determine and designate intersections where a particu-
lar hazard exists and to determine whether vehicles
on one of the intersecting streets yield the right-
of-way to vehicles on the other street and to erect a
cYIELD1 sign at every place where need is determined
for such a sign. "
SECTION 3.
That Section 26-35, Same--Requirements, of Chapter 26
of the Fort Worth City Code (1964) is hereby amended and
after being amended same shall hereafter read as follows:
"Sec. 26-35. Same--Requirements.
"Every sign erected pursuant to Section 26-34
shall bear the message =YIELD. ' Such signs shall
at nighttime be rendered luminous by steady or in-
ternal flashing illumination, or by a fined flood
light projected on the face of the sign or by effi-
cient reflecting elements covering the entire face
of the sign. "

SECTION 4,
That Section 26-36, Flashing signals, of Chapter 26 of
the Fort Worth City Code (1964) is hereby amended and after
being amended same shall hereafter read as follows:
"Sec, 26-36, Flashing signals,
" (a) Flashing red signal. Traffic approaching
an intersection where a red signal is being displayed
in continuous flashes shall stop before entering the
nearest crosswalk at the intersection and shall pro-
ceed to enter the intersection with proper care to
avoid an accident,
" (b) Flashing amber or yellow signal„ Traffic
approaching an intersection where an amber or yellow
signal light is being displayed in continuous flashes
may proceed through an intersection or pass such
signal only with caution, "
SECTION 5,
That Section 26-38, Turning right on red signal, of
Chapter 26 of the Fort Worth City Code (1964) is hereby
deleted and the following is hereby ordained and substi-
tuted in its place and stead:
"Sec, 26-38, Pedestrian Control Signals,
"Whenever special pedestrian-control signals
exhibiting the words 'Walk, ' 'Don't Walk, ' or
'wait' are in place, such signals shall indicate
as follows:
" (a) Walk: Pedestrians facing such signal may
proceed across the roadway in the direc-
tion of the signal and shall be given the
right-of-way by the drivers of all vehicles.
" (b) Don't Walk or Wait: No pedestrian shall
start to cross the roadway in the direc-
tion of such signal, but any pedestrian
who has partially completed his crossing
on the 'Walk' signal shall proceed to a
sidewalk or safety island while the 'Don't
Walk' or 'Wait' signal is showing, "

SECTION 6.
That any person who shall violate any of the provisions
of this ordinance or any rule or regulation made by the City
Traffic Engineer pursuant thereto shall be guilty of a mis-
demeanor and, upon conviction thereof, shall be fined not
to exceed Two Hundred Dollars ($200.00) .
SECTION 7.
That this ordinance shall be cumulative of all other
ordinances regulating vehicular or pedestrian traffic in the
City of Fort Worth except in those instances where ordinances
or parts of ordinances are in conflict herewith, in which in-
stances, the terms of this ordinance shall prevail, and such
ordinances or parts of ordinances in conflict herewith are
hereby repealed.
SECTION B.
That should any section, article, provision or part of
this ordinance be declared to be unconstitutional and void
by a court of competent jurisdiction, such decision shall in
no way affect the validity of any of the remaining parts of
this ordinance unless the part held unconstitutional or void
is inseparable from and indispensable to the operation of
the remaining parts. The City Council hereby declares that
it would have passed those parts of this ordinance which
are valid and omitted any parts which may be unconstitutional
if it had known that such parts were unconstitutional at the
time of the passage of this ordinance.

SECTION 9.
That the effective date of this ordinance shall be
August 27, 1973,

Several phanges in state law necessitate the amendment of various
sections of Chapter 26 of the Fort Worth City Code (1964) . The
proposed ordinance which is attached contains the following pro-
visions.
1) Section 1: Amends Section 26-31, Traffic-control signal legend.
The primary change to this section is that "Vehicular traffic
facing a steady red signal alone shall stop at a clearly marked
stop line, . . . , and, unless prohibited by a traffic control
sign, may then turn right or, if the intersecting streets are
both one-way streets and left turns are permissible, may turn
left, after standing until the intersection may be entered
safely, ."
2) Section 2: Amends Section 26-34, Yield right-of-way signs --
Authorized.
The only change in this section is the replacing of the "Yield
right-of-way" wording with the presently accepted "Yield"
wording.
3) Section 3: Amends Section 26-35, Same -- Requirements.
As in 2 above, the only change is in the use of the word "Yield".
4) Section 4: Amends Section 26-36, Flashing Signals.
Several years ago the state law was changed to delete the re-
quirement that traffic must slow to a speed not in excess of
15 mph before entering the nearest crosswalk of an intersection
where an amber or yellow signal light was being displayed in
continuous flashes. This proposed amendment to the City Code
will remove the existing conflict with state law.
5) Section 5: Deletes Section 26-38, Turning right on ,red .signal,
and substitutes in its place Section 26-38, Pedestrian Control
Signals.

Section 26-38 prohibits a right turn on a red traffic signal
unless an official traffic sign or signal indicates that such
right turn may be made. The contents of this section will be
deleted by the adoption of this amendment and provisions in
conformity with the state law will be added with. respect to
pedestrian-control signals. Basically these additions indicate
the meanings of the words "Walk", "Don't Walk", or "Wait" when
used in special pedestrian-control signals.
Recommendation
It is recommended that Chapter 26, Sections 31, 34, 35, 36 and 38 be
amended by the adoption of the ordinance as described above.
