HomeMy WebLinkAboutOrdinance 792 ORDINANCE NO. 792 AN ORDINANCE AMENDING SECTIONS CNE AND T6A OF ORDINANCE NO. 643, REGULATING THE CUTTING INTO BUILDING ON, AND OBSTRUCTING STREETS, ALLEYS, SIDEWALKS AND DRIVEWAYS IN THE CITY OF FORT WORTH, TEXAS. BE IT ORDAINED BY THE BOARD OF OOMNISSIONERS OF THE CITY OF FORT WORTH: Section 1.- That Sections one and two, of Ordinance No. 643, be and the same are hereby amended so as to be and read hereafter as follows; "Section 6.-That hereafter no persons or person, firm or corporation, shall lay, construct, build, repair or rebuild any sidewalks, curbs, gutter or driveway on any street alley, or thoroughfare within said City without first having obtained from the City Engineer, a license to do such work; having made and executed a bond to said City in the sum of Twenty five hundred ($2500.00) dollars; having paid a license fee of One Hundred ($100.00) dollars, and having obtained a permit from the City Engineer of the City to do such work. "Section 7; REQUISITE OF LICENSE AND BOND: The license hereinbefore men- tioned shall be issued and approved by the City Engineer, and before the issuance of same, the applicant shall file in the office of the City Engineer, a statement of his qualifications, together with a surety company bond of Twenty-five hundred, ($2500.00) dollars, conditioned that said applicant will indemnify and save harmless the City of Fort Worth from any and all damages of every character arising from, or caused directly or indirectly by any negligence in the doing of said work, or for any imperfect cr inadequate work done by the applicant, and that he will maintain said work in a good and work- manlike state of repair for and during a period of two years from and after its completion and acceptance by the City. Said statement of qualifications approved by the City Engineer, together with bond, license number and date of issuance shall be filed by said City Engineer with the City Secretary. "The applicant shall also state in his application for license, his place of business and the number under which the business is to be transacted, and shall notify the City Engineer immediately of any and every change of address or style of his firm. All such bonds shall be subject to the approval of the Board of Commissioners of the said City, and shall run for a period of one year from date, or until revoked, as hereinafter provided." "Said licensee shall not permit the use of said license by any person, firm or corporation not in his employ, for the purpose of doing any work covered by this Ordinance, nor shall he sublet any work for which a license is issued to him, to any other person. "Said licensee shall notify the City Engineer of the date on which he intends to start operaticne on any new work or contract. "Said licensee shall stamp his name, together with the year in which the work is completed on each piece of work constructed by him with a stamp having letters not less than one-half (J) inch nor greater than one (111) inch in size, and making an impression approximately one eighth (1/80) inch in depth." "Section 2; Any person or persons, firm or corporation violating any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined in the sum of not to exceed Two Hundred ($200.00) dollars, and in addition thereto, upon the final conviction for any such violation, said conviction shall of itself constitute and be a rescission and cancellation of the license held by such person or persons, firm or corpo- ration so convicted, and in such event no new license shall be issued for a period of one year. Section 3;- All Ordinances or parts of Ordinances in conflict herewith are hereby repealed. Section 4.- This Ordinance shall take effect and be in force and effect from and after its passage and publication as required by law. APPROVED AS TO FORM: CORPORATION COUNSEL.
