AN ORDINANCE REGULATING THE PARKING OF MOTOR VEHICLES
UPON THE STREETS AND PUBLIC THOROUGHFARES OF THE CITY
OF FORT WORTH BY REQUIRING THE LOCKING OF THE IGNITION
THEREOF; PROVIDING THAT CERTAIN FACTS SHALL CONSTITUTE
PRIMA FACIE EVIDENCE OF THE VIOLATION HEREOF; PROVIDING
THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL OTHER
ORDINANCES; PROVIDING A SAVINGS CLAUSE; PROVIDING A
PENALTY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
Section 1.
No person driving or in charge of a motor vehicle within the limits of
the City of Fort Worth, Texas, shall allow or suffer such motor vehicle to be
left unattended unless and until the ignition key to such motor vehicle shall
be first removed therefrom and the ignition thereof shall be fixed in a locked
position. Provided, however, that this ordinance shall not be applicable to
trucks, buses or commercial motor vehicles.
Section 2.
When any motor vehicle subject to the terms of this ordinance shall be
parked or left unattended and the ignition key to such motor vehicle shall be
left in the ignition of such vehicle, such fact shall constitute prima facie
evidence of the violation of this ordinance by the owner of such vehicle.
Section 3.
This ordinance shall be cumulative of all other ordinances of the City
of Fort Worth except in those instances where such ordinances are in conflict
herewith, in which instances the terms of this ordinance shall prevail.
Section 4.
Should any section, article, provision or part of this ordinance be
declared to be unconstitutional and void by a court of competent jurisdiction,
such decision shall in no way affect the validity of any of the remaining parts
of this ordinance unless the part held unconstitutional or void is inseparable
from and indispensable to the operation of the remaining parts. The City Council
hereby declares that it would have passed those parts of this ordinance which are
valid and omitted any parts which may be unconstitutional if it had known that
such parts were unconstitutional at the time of the passage of this ordinance.
Section 5.
Any person who shall violate any of the provisions of this ordinance
shall be guilty of a misdemeanor and, upon conviction thereof, shall be fined
not to exceed Two Hundred Dollars ($200.00). Each day's violation hereof shall
be a separate offense.
Section 6.
This ordinance shall take effect and be in full force and effect from
and after the date of its passage and publication as provided by law.
