AN ORDINANCE ORDERING AN ELECTION OF THE QUALIFIED
VOTERS OF THE CITY OF IO RT WORTH, TEXAS, ON TUESDAY,
THE 2ND DAY OF APRIL, A. D. 1957, FOR THE PURPOSE
OF ELECTING NINE COUNCILMEN FOR SAID CITY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS;
SECTION I.
That in compliance with the Charter of the City of Fort Worth and in
accordance with the laws and Constitution of the State of Texas, an election
be and the same is hereby called and ordered for the first Tuesday after the
first Monday in April, A. D. 1957, the same being the 2nd day of said month,
at which election all qualified voters may vote for the purpose of electing
nine councilmen.
SECTION II.
That the City Secretary of said City shall prepare ballots to be used
in said election and shall stamp same "Official Ballot", on which ballot shall
be printed the names of the candidates for the position of councilmen. The
places of the different councilmen shall be designated on the official ballot
as Member of Council, Place No. 1, 2, 3, 4, 5, 6, 7, 8 and 9, respectively.
SECTION III.
_ That no person's name shall be placed upon the official ballot as a
candidate for the position of a member of the City Council unless such person
has filed his sworn application, as provided by the laws of Texas, with the
Mayor and the City Secretary at least thirty (30) days prior to the election
date, and it must also appear on the face of said application the number of
the place that said candidate is seeking.
SECTION IV.
That it shall further appear to the said City Secretary, before said
candidate's name is entered on said ballot, that he has filed an affidavit
of loyalty with the Mayor and the City Secretary, as required by Article 6.02
of the Election Code of the State of Texas.
SECTION V.
That in the event that there are two or more candidates for the same
position and place as a member of the City Council, the position of such can-
didates' names on the ballot shall be determined by placing them on such ballot
in the alphabetical order of their surname.
SECTION VI.
That each voter shall vote for his choice for candidate for each place
as a member of the City Council by placing an "X" in the square beside the
name or by scratching or marking out all other names in that race, and shall
vote for one candidate only for each place.
SECTION VII.
That any candidate receiving a majority of all the votes cast for the
office for which he is a candidate shall be elected to such office. In the
event of a tie or in the event that no candidate receives a majority of all
the votes cast for any one or more of the respective offices, the Mayor, on
the first day after the completion of the official count of ballots, shall
issue a call for a second election, as required by law, to be held on the
second Tuesday following the issuance of such call, at which second election
the two candidates receiving the highest number of votes for any such office
or offices, as the case may be, in the first election at which no one was
elected by receiving a majority of all the votes cast for all candidates for
such office or offices shall again be voted for.
SECTION VIII.
That the polls shall be kept open from seven o'clock a. m., until seven
o'clock p.m., and that due return be made to the City Council showing the num-
ber of votes .cast for and the number of votes cast against each candidate for
each of the positions of city councilmen respectively.
SECTION IX.
That this ordinance, signed by the Mayor and attested by the City Se-
cretary, shall constitute the proclamation of the Mayor calling and ordering
said election, and that such notice shall be published in a newspaper of gen-
eral circulation in the City of Fort Worth once a week for four weeks prior
thereto, and that the said City Secretary is hereby directed to post or cause
to be posted said proclamation at least twenty (20) days before said election
in each voting precinct.
SECTION X.
That the polling places for this election and the personnel of the officers
who are to hold the same, except insofar as they may be changed by the City
Council of said City, shall be as follows:
