AN ORDINANCE CLOSING AND VACATING THE UTILITY EASEMENT LYING BETWEEN LOT 1 AND LOTS 19, 20 AND 21, BLOCK 11, RIDGLEA HILLS ADDITION; THE UTILITY EASEMENT LYING BETWEEN LOTS 1 AND 2, BLOCK 11, RIDGLEA HILLS ADDITION; THAT PORTION OF THE UTILITY EASEMENT LYING BETWEEN LOTS 19 AND 20 IN BLOCK ll IN SAID AD- DITION, WHICH EXTENDS FROM THE SOUTH LINE OF LOT "A" ON THE PLAT FILED WITH AND APPROVED BY THE CITY PLAN COMMISSION ON DECEMBER 2, 1952, TO THE WESTERLY LINE OF LOT 1 OF THE OLD PLATTING OF SAID BLOCK 11; AND THAT PORTION OF THE UTILITY EASEMENT LYING BETWEEN LOT 2 AND LOT 19 OF BLOCK 11, RIDGLEA HILLS ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS; AND PROVIDING FOR THE REVERSION OF THE FEE TO SAID LAND. WHEREAS, it appears to the City Council of the City of Fort Worth that a portion of Block 11 of Ridglea Hills, an addition to the City of Fort Worth, Tarrant County, Texas, has been replatted and is now legally described and designated as Lots "A" and "B," Cavitt's Subdivision of a part of Block 11, Ridglea Hills, said portion of said Block 11 so replatted consisting of the area formerly designated as Lots 1 and 21 and part of Lots 2, 19 and 20, Ridglea Hills Addition, said replatting being shown upon the plat filed for record with the City Plan Commission of the City of Fort Worth and approved by it on December 2, 1952; and, WHEREAS, by virtue of said replatting, it appears to the City Council of the City of Fort Worth that that certain easement for public utilities extending from the northeast corner of Lot 21, Block 111 Ridglea Hills Addition as originally platted, in a southeasterly direction along the com- mon boundary lines of Lot 1, Block ll,and Lot 21, Block 11, and Lot 1, Block ll, and Lot 20, Black 11, and Lot 1, Block 11, and Lot 19, Block 11 to the northeast corner of Lot 2, Block 11; extending in an easterly direc- tion along the north line of Lot 2, Block 11, being the common boundary line of Lots 1 and 2; and also extending in a southerly direction along the west line of Lot 2, Block 11, being the common boundary line of Lots 2 and 19 and Lots 2 and 18, to a point 2.8 feet south of the northeast corner of Lot 18 in Block 11; and that certain easement for public utilities extend- ing in a southwesterly direction from the easement hereinabove described along the common boundary lines of Lots 19 and 20 in Block 11 to the south line of Lot "A," as shown on the aforesaid plat approved by the City Plan Commission of the City of Fort Worth on December 2, 1952, should be abandoned and vacated as easements for public utilities, such easements never hav- ing been used by public utilities, and that it is to the best interest of the public that such easements be extinguished, abandoned and vacated as public utility easements and the fee to the land in said easements re- vert as provided by law; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the public utility easements hereinabove described, such ease- ments being located in Lots "A" and `B," Cavitt`s Subdivision of a portion of Block 11, Ridglea Hills Addition to the City of Fort Worth, Tarrant County, Texas, be and the same are hereby extinguished, vacated, closed and permanently abandoned as easements for public utilities. SECTION 2. That the fee to the land in said easements above described is here- by released and will revert to the owners as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. �APPROVED AS TO FORM: Assistant City Attorney
