AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE
WATER AND SEWER CAPITAL PROJECTS FUND, FROM AVAILABLE FUNDS, IN THE
AMOUNT OF $1,184,109.00, FOR THE PURPOSE OF FUNDING THE EMERGENCY
SANITARY SEWER REPAIR WORK PERFORMED ON TRINITY RIVER STREAMBANK
EROSION AFFECTING TWO 90-INCH SANITARY SEWER MAINS; PROVIDING FOR A
SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR
ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2018-2019 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water
and Sewer Capital Projects Fund in the amount of$1,184,109.00, from available funds, for the Emergency
Sanitary Sewer Repair Work Performed on Trinity River Streambank Erosion Affecting Two 90-inch Sanitary
Sewer Mains.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair
the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall
be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 23392-09-2018 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

SEWER LINES EMERGENCY REPAIRS
This memorandum Is to supplement the October 17, 2018 emergency memorandum- resulting In
City Secretary Contract No. 61472 with Circle C Construction Company ("Circle C ") for
emergency services to reinforce and repair the existing sheet pile cutoff walls to prevent further
failure of the Trinity River slope bank to allow a specialty contractor (Humphrey and Morton) to
construct permanent river bank stabilization and to install piping for emergency bypass pumping.
The initial estimated overall amount of the emergency work was $1,510,000 and of that, the
amount of reinforcing the sheet piling was$200,000.
It has been determined that additional sheet piling and.grading improvements are needed in order
to secure an exposed 'river bank wall surface that could collapse on work crews during
construction of the permanent repairs, it is anticipated that the additional work may cost up to
$700,000.00.
A change order will be processed to the existing contract with Circle C and actual costs will be
reconciled at the end of the project

RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water and Sewer Capital Projects Fund
in the amount of$1,184,109.00 from available funds;and
2. Ratify the Emergency Agreement with William J.Schultz,Inc.d/b/a Circle C Construction Company,City Secretary No.51472,in the final
amount of$1,184,108.99 for emergency sanitary sewer repair work performed on the Trinity River Streambank erosion affecting two 90-inch
sanitary sewer mains the City's twin 90-inch sanitary sewer mains.(City Project No. 102345)
DISCUSSION:
The emergency work performed on the City's twin 90-inch sanitary sewer mains M-280-B and M-338-B was necessary to prevent failure of the
slope bank of the portion of the Trinity River behind which both 90-inch mains are located.The contract provided for the reinforcement of previously
installed sheet pile cutoff wall that became unstable after heavy rains and the installation of a new sheet pile cutoff wail to secure a newly
composed riverbank in close proximity to the two 90-inch mains.
It was beyond the City's ability to perform repairs of this complexity.The Water Department engaged William J.Schultz,Inc.d/b/a Circle C
Construction Company for the emergency sanitary sewer repair work performed on the Trinity River Streambank erosion affecting two90-inch
sanitary sewer mains.
The attached City Manager Memo dated October 17,2018 and January 2,2019 supplemental memorandum authorized City Secretary Contract
No.51472, and Change Order 1 thereto, for the emergency work up to$1,200,000.00.The total construction cost was$1,184,108.99,which is
fair and reasonable for the work performed.
Sanitary Sewer Overflows are a threat to the health and safety of the City of Fort Worth.Chapter 2,Article I,Section 2-9 of the City's Code of
Ordinances and Section 252.022 of the Local Government Code exempts from normal bidding requirements expenditures that are necessary to
preserve or protect public health or safety of the municipality's residents;and procurements that are necessary because of unforeseen damage to
public machinery,equipment,or property.
This project was located in COUNCIL DISTRICT 4.
A Form 1295 is not required because:This contract legally does not require City Council approval.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance,funds
will be available in the current capital budget,as appropriated,of the Water and Sewer Capital Projects Fund.The Fiscal Year 2019 Water
Operating Budget includes appropriations of$35,856,873.00 for the purpose of providing Pay-As-You-Go funding for Sewer Capital Projects.
After this transfer for Fiscal Year 2019,the balance will be$8,021,085.00.
