HomeMy WebLinkAboutOrdinance 7992 ORDINANCE NO. 9 9 Z AN ORDINANCE VACATING, ABANDONING AND CLOSING A 5 FOOT WIDE UTILITY EASEMENT ABUTTING THE SOUTH PROPERTY LINE OF BLOCK 10R, FROM THE WEST PROPERTY LINE (LONE STAR BOULEVARD) OF BLOCK 1OR TO THE WEST PROPERTY LINE OF LOT 1, BLOCK 10R, MARK IV INDUSTRIAL PARK, A DISTANCE OF 1272.0 FEET, PROVIDING FOR A REVERSION OF FEE OF SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS. SECTION 1. That a 5 foot utility easement located in Block 10R, Mark IV Industrial Park abutting the south property line of said Block 10R, from the west property line (Lone Star Boulevard) of said Block 1OR to the west property line of Lot 1, Block 10R, Mark IV Industrial Park, a distance of 2172 .0 feet, be and the same are hereby vacated, abandoned and permanently closed as utility easements. SECTION 2. That the fee to the land in said utility easement is hereby released and shall revert to the owner of said Black 1OR as pro- vided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage it is so ordained. The subject utility easement, acquired by dedication, is not in use and contains no public utility facilities. Reviewing City departments and private utility companies have raised no objec- tions to the requested vacation provided the vacated 5' utility easement is replatted with the abutting property. A satisfactory replat has been submitted. Recommendation It is recommended that an ordinance be adopted vacating the 5' utility easement.
