HomeMy WebLinkAboutOrdinance 7892 ORDINANCE !Z If 11 Az%L AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE, ORDINANCE NO. 3011, AS AMENDED, SAME BEING AN ORDINANCE REGULATING AND RESTRICTING THE LOCATION AND USE OF BUILDINGS, STRUCTURES, AND LAND FOR TRADE, INDUSTRY, RESIDENCE OR OTHER PURPOSES, THE HEIGHT, NUMBER OF STORIES AND SIZE OF BUILDINGS AND OTHER STRUCTURES, THE SIZE OF YARDS AND OTHER OPEN SPACES, OFF-STREET PARKING AND LOADING, AND THE DENSITY OF POPULATION, AND FOR SUCH PURPOSES DIVIDING THE MUNICIPALITY INTO DISTRICTS OF SUCH NUMBER, SHAPE AND AREA AS MAY BE DEEMED BEST SUITED TO CARRY OUT THESE REGULATIONS AND SHOWING SUCH DISTRICT AND THE BOUNDARIES THEREOF UPON "DISTRICT MAPS", PROVIDING FOR INTERPRETATION, PURPOSE AND CONFLICT; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENAL CLAUSE; AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Ordinance No. 3011 be and is hereby amended so that permitted uses in the hereinafter described area be altered, changed, and amended as follows: Z-79-9 Lots 33, 34, and 35, Block 6, North Meadowbrook Estates Addition, 7t.h Filing (6800-08 Brentwood Stair Road) Recommended from "C-R" Restricted Apartment to "ER" Restricted Commercial. Z-79-10 BEING 14.52 acres of land out of the J. B. Johnson Survey, Abstract No. 855, in the City of Fort. Worth, Tarrant County, Texas, and being a part of a tract of land conveyed to Gifford-- Hill Company, Inc. , by deed recorded in Volume 1083, Page 3 of the Deed Records of Tarrant County, Texas, and being described by metes and bounds as follows: BEGINNING at a concrete monument in the East line of the said Gifford-Hill Co. , Inc. , tract of land in the Northerly line of Randol Mill-Hurst Precinct Line Road (Co. No. 3035) , said point also being in the West, line of the "Fourteenth Tract" conveyed to Gravel Mining Company by deed recorded in Volume 2076, Page 406, D.R.T.C.T. , and also being by deed call approximately 790 feet Westerly and 161 feet Southerly from the most. Easterly corner of the said J. B. Johnson Survey; THENCE, N 540 20' 36" W, along the Northerly line of the said Precinct. Line Road, a distance of 1303.81 feet to a nail the beginning of a curve to the right; THENCE, in a Northerly direction, with the Easterly line of the said Precinct Line Road, along the arc of a circular curve to the right.b having a radius of 291.32 feet and through a central angle of 60 041 , a distance of 305.41 feet to a nail the end of said curveand in the South line of Trinity Blvd. ; THENCE s 840 22' 41" E, along the South line of Trinity Blvd. , a distance of 1170.96 feet to an iron pipe in the West line of the said Gravel Mining Company tract, of land; THENCE S 00 52' 33" E, along the said West line, a distance of 911.03 feet to the place of beginning and containing 632,816.42 square feet. or 14.52 acres of land. (Being the South East Corner of Trinity Blvd. and Randol Mill- Hurst Precinct, Line Road) Recommended from Unzoned to "I" Light Industrial z-79-13 Lots 17, 18, 19, 20, 21 and 22, Block 27, Worth Heights Addition (3700-20 S. Freeway) Recommended from "E-R" Restricted Commercial to "E" Commercial z-79-16 Lots 2-A, 2-B, 3-A, 5 and 7, Block 13, Alta Mere Addition (3000 Block Marquit.a Drive) Recommended from "A" One-Family to "I" Light Industrial SECTION 2. That the zoning regulations and districts, as herein established, have been made in accordance with the comprehensive plan for the purpose of promoting the health, safety, morals and general welfare of the community. They have been designed to lessen congestion in the streets; to secure safety from fire, panic, flood and other dangers; to provide adequate light and air; to prevent overcrowding of land, to avoid undue concentration of population; to facilitate the adequate provisions of transportation, water, sewerage, parks and other public requirements. They have been made after a full and complete public hearing, with reasonable consideration, among other things, of the character of the district and its peculiar suitability for the particular uses and with a view of conserving the value of building and encouraging the most, appropriate use of land throughout the community. SECTION 3. That this ordinance shall be cumulative of all other ordinances of the City of Fort Worth affecting zoning and shall not repeal any of the provisions of such ordinances, except in those instances where provisions of such ordinances are in direct conflict with the provisions of this ordinance. SECTION 4. That all rights or remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations or Ordinance No. 3011 or of any amendments thereto of said City of Fort Worth, Texas, that have accrued at the time of the effective date of this ordinance; and, as to such accrued violations, the court shall have all of the powers which existed prior to the effective date of this ordinance. SECTION 5. It. is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared void, ineffective or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such voidness, ineffectiveness or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or section of this ordinance, since the same would have been enacted by the City Council without the incorporation herein of any such void, ineffective or unconstitutional phrase, clause, sentence, paragraph or section. SECTION 6. That, any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not less than Five Dollars ($5.00) , nor more than Two Hundred Dollars ($200.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 7. That this ordinance shall become effective and be in full force and effect from and after the date of its passage and publications, as required by law, and it is so ordained.
