AN ORDINANCE AMENDING ORDINANCE NO. 7434 OF THE
CITY OF FORT WORTH, TEXAS (1977) BY AMENDING
CHAPTER 7, HEATING SYSTEMS SECTION 706(b) BY
ADDING EXCEPTION NUMBER 3; PROVIDING EXISTING
BUILDINGS OF ENUMERATED CATEGORIES FREE FROM
HOURLY RATED CONSTRUCTION MAY HAVE THE USE OF
THE CORRIDOR AS PART OF A DUCT SYSTEM; PROVIDING
FOR PRODUCTS OF COMBUSTION DETECTORS INSTALLATION;
PROVIDING CIRCULATING AIR SYSTEMS; PROVIDING
APPROVED AIR RELIEF SYSTEMS TO ROOMS; BY AMENDING
CHAPTER 12, COOLING, SECTION 204(b) BY ADDING
EXCEPTION NUMBER 3; PROVIDING EXISTING BUILDINGS
OF ENUMERATED CATEGORIES FREE FROM HOURLY RATED
CONSTRUCTION MAY HAVE THE USE OF THE CORRIDOR AS
PART OF A DUCT SYSTEM; PROVIDING FOR PRODUCTS OF
COMBUSTION DETECTORS INSTALLATION; PROVIDING
CIRCULATING AIR SYSTEMS; PROVIDING APPROVED AIR
RELIEF SYSTEMS TO ROOMS; PROVIDING PENALTIES FOR
VIOLATIONS; PROVIDING SEVERABILITY; PROVIDING
FOR REPEAL OF CONFLICTING ORDINANCES AND CODE
PROVISIONS; PROVIDING A SAVINGS CLAUSE; PRO-
VIDING FOR PUBLICATION IN PAMPHLET FORM; PRO-
VIDING FOR PUBLICATION; PROVIDING FOR ENGROSSMENT,
ENROLLING AND FILING; PROVIDING FOR AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
That Section 706(b) , Chapter 7 to Ordinance 7434 of the
City of Fort Worth (1977) , be and the same is hereby added
to read as follows:
"Exception No. 3
"Existing buildings of A-3, E, H-4 (office
area) , B-2 and B-4 (office area) occupancy where
hourly rated construction does not exist may
have the use of the corridor as an integral
part of a duct system when:
"a. Products of combustion detectors are
installed in an approved location so
as to provide detection for each
inhabited room or exit way. The
detector shall be connected to the
circulating air system controls.
"b. The circulating air system shall be
designed and controlled so as to
reverse the air flow from the corridor
into the inhabited room using all outside
air, when activated by the products of
combustion detectors.
"c. An approved air relief shall exist so as
to assure a constant flow from the corridor
into the inhabited room.
"d. Any other approved system that will accom-
plish the intent of the above sub-section
(a) (b) and (c) ."
SECTION 2.
That Section 1204(b) , Chapter 12 to Ordinance 7434 of the
City of Fort worth (1977) , be and the same is hereby added
to read as follows:
"Exception No. 3.
"Existing buildings of A-3, E, H-4 (office
area) occupancy where hourly rated construction
does not exist may have the use of the corridor
as an integral part of a duct system when:
"a. Products of combustion detectors are
installed in an approved location so
as to provide detection for each
inhabited room or exit way. The
detector shall be connected to the
circulating air system controls.
"b. The circulating air system shall be
designed and controlled so as to
reverse the air flow from the corridor
into the inhabited room using all out-
side air, vlien activated by the products
of combustion detectors.
"c. An approved air relief shall exist so
as to assure a constant flow from the
corridor into the inhabited room.
"d. Any other approved system that will
accomplish the intent of the above
sub-section (a) (b) and (c) ."
SECTION 3.
That it shall be unlawful for any person to construct,
enlarge, alter, repair, move, improve, convert, equip, use
or maintain any heating, comfort cooling, refrigeration,

ventilating or exhaust systems or other miscellaneous Heat
Producing appliances in said city or cause the same to be
done, contrary to or in violation of any of the provisions
of this code.
Any person violating any of the provisions of this
Code shall be deemed guilty of a misdemeanor, and each such
person shall be guilty of a separate offense for each day
or portion thereof during which any violation of any of the
provisions of this code is committed, continued or permitted,
and each violation shall be punishable by a fine not to exceed
$200.00.
SECTION 4.
That it is hereby declared to be the intention of the
City Council that the sections, paragraphs, sentences, clauses
and phrases of this ordinance are severable, and if any phrase,
clause, sentence, paragraph or section of this ordinance shall
be declared void, ineffective or unconstitutional by the valid
judgment or final decree of a court of competent jurisdiction,
such voidness, ineffectiveness or unconstitutionality shall
not affect any of the remaining phrases, clauses, sentences,
paragraphs and sections of this ordinance, since the same
would have been enacted by the City Council without the incor-
poration herein of any such void, ineffective or unconstitutional
phrase, clause, sentence, paragraph or section.
SECTION 5.
All other prior ordinances and City Code sections of the
City of Fort Worth in conflict herewith are hereby repealed
but only insofar as such ordinances and code sections are in
conflict with the provisions of this ordinance.

SECTION 6.
That all rights and remedies of the City of Fort Worth,
Texas, are expressly saved as to any and all violations of the
provisions of Ordinance 6408 or Ordinance 7083 or any other
ordinance affecting heating, comfort cooling or ventilation
systems which have accrued at the time of the effective date
of this ordinance; and as to such accrued violations and all
pending litigation, both civil and criminal, whether pending
in court or not, under such ordinances, same shall not be
affected by this ordinance but may be prosecuted until final
disposition by the courts.
SECTION 7.
That the City Secretary of the City of Fort Worth, Texas,
is hereby authorized to publish this ordinance in pamphlet form
for general distribution among the public, and this ordinance
as so published shall be admissible in evidence in all courts
without further proof than the production of said pamphlet, as
provided in Section 3, Chapter XXVI of the Charter of the City
of Fort Worth, Texas.
SECTION 8.
That the City Secretary of the City of Fort Worth, Texas,
is hereby directed to publish the caption, penalty clause and
effective date of this ordinance for five (5) days in the
official newspaper of the City of Fort Worth, Texas.
SECTION 9.
That the City Secretary of the City of Fort Worth, Texas,
is hereby directed to engross and enroll this ordinance by
copying the caption and penalty clause of same in the minutes
of the City Council of the City of Fort Worth, Texas, and by

filing the ordinance in the ordinance records of said city.
SECTION 10.
That this ordinance shall be in full force and effect
from and after the date of its passage and publication as
required by law and it is so ordained.

On September 27, 1977 fM&C G-3583) , the City Council adopted Ordinance No. 7634
specifying the 1976 Uniform Mechanical Code and local amendments thereto as
the Mechanical Code of the City of Fort Worth.
The Mechanical Code prohibits the use of a corridor as an integral part of a
duct system in any building having 30 or more occupants.
This requirement is too restrictive for system modifications in existing
buildings where the corridor construction does not have an hourly rating.
Buildings in this category include many of the schools being air conditioned
under the Fort Worth School Bond Program and many office buildings and small
assembly buildings. To make these buildings conform to the new code would
place undue expense on the owners.
The Mechanical Board of Appeals and the Building Inspection staff recommend
an amendment to Ordinance No. 7634, adding an exception to Chapter 7, Heating
Systems, Section 706(b) and to Chapter 12, Cooling, Section 1204(b) , to read
as follows:
"Exception #3
Existing buildings of A-3, E, H-4 (office area) , B-2 and B-4 (office
area) occupancy where hourly rated construction does not exist may
have the use of the corridor as an integral part of a duct system
when:
a. Combustion detectors are installed in an approved location so
as to provide detection for each inhabited room or exit way.
The detector shall be connected to the circulating air system
controls.
b. The circulating air system shall be designed and controlled
so as to reverse the air flow from the corridor into the in-
habited room using all outside air, when activated by combustion
detectors.
c. An approved air relief shall exist so as to assure a constant
flow from the corridor into the inhabited room.
d. Any other approved system that will accomplish the intent of
the above sub-sections (a) (b) and (c) ."
Recommepdation
It is recommended that an ordinance be adopted amending the Mechanical Code
of the City of Fort Worth as described above.
