HomeMy WebLinkAboutOrdinance 393 AN ORDINANCE PROVIDING FOR A BOND, LICENSE AND PERMIT FOR THE BUILDING OR RJR-BUILDING OR RE-PAIRING OF SIDEWALK, CURBS AND GUTTERS ON THE STREETS AND PUBLIC THOROUGHFARES s OF THE CITY OF FORT WORTH, FIXING PENALTIES FOR ITS VIOLATI0T, PROVIDING FOR FORFEITURE OF LICENSES, AND REPEALING ALL ORDINANCES IN CONFLICT WITH SAME. BE IT ORDAINED BY THE BOARD OF COMM18SIONERS OF THE CITY OF FORT WORTH, TEXAS: SECTION I. That hereafter, no person or persons, firm or corporation shall lay, construct, build, repair, or re-build any sidewalk, curb, curbing or gutter on any street, alley or thoroughfare within said City, without first applying to the Commissioner of Streets & Public Property of said City for a license to do such work, and having; made and executed a Bond to said City in the sun of 1000*00, and having paid a license fee of $2,00, and having obtained a Permit* Prom the Citj!4gi4aga ! -41A City to a E„ do such work. + SECTION II. � �} The license hereinabove mentioned, shall be issued by the a " . ,'1114 Commissioner of Streets & Public Property, and before the is- suanoe of same, the applicant shall file in the office of the City Secretary a Bond in the sum of $1000.00, conditioned that said applicant will indemnify and save harmless the City of Fort 1A11X1# EII1AA3 Worth from any and sal daai�6ge,s of every character, . arising from or caused directly or indirectly by any negligence in the doing of such work, or from any imperfect or inadequate work doge by the applicant, and will maintain said work in a good and during and workmanlike state of repair fora period of two years from and after Its oompletion and acceptance by the City. The applicant shall also state, in his application for license, his place of business and the name under which the business is to be transacted, and shall notify the City Secre- tary immediately, of any and every change in address or style of his firm. Y All such Bonds shall be subject to the approval of the Board of lommiseioners of said City, and shall run for a period of one year from their date. SECTION III. After such license is issued, as hereinabove provided, the licensee shall obtain a Permit from the City Engineer of said City for doing any such work as hereinabove set forth, and M plans and specifications, grades and lines for said work, and all such work shall be teas according to plans and specifica- �.-..�.-u.��,�._.e %ions, grades and lines� and shall at all times, be subject to the inspection and approval of said City Engineer, or other persons designated for such work by him. .2-� Said licensee ta=s p eta l,hia name, together with o, date of completion on each piece of work cdnetructed by him. Immediately upon the completion of each and every such work, the Contractor shall apply for and obtain from the City Engineer a certificate, stating in substance, that such work has been oom- pleted according to the plane and specifications, grades and lines given by him. SECTION IV. Any person or persons, firm or corporation violating any of the provisions of the preceding sections hereof, shall be deemed guilty of a misdemeanor and upon conviction, shall be fined in any sum not to exceed $200.00 and in addition thereto, upon the final conviction for any such violation, said conviction shall of itself constitute and be a recision and cancellation of the license held by such person or persons, firm or corporation so convicted, and in such event, no new license shall be issued for a period of one year. SECTION V. All Ordinances or ,parts of Ordinances in conflict herewith are hereby repealed. SECTION VI. - This Ordinance shall take effect and be in force from and after its passage and publication, as required by law. ordinance No.393.Cont'd.
