An Ordinance regulating the temporary obstruction nS partions
of Streets, alleys and sidewalks for building purposes providing
r for permits therefor, fixing the penalty for the violation of t*
provisions of same and repealing all ordinances and parts of
ordinances in conflict herewith.

OF FORT WORTH:
Sec, L Hereafter aLy person or persons, firm or corporation
desiring to temporarily occupaany portion of any public street,
alley or sidewalk within the City of Fort :north for the purpose
of lacing thereon materials or ruboish for or from building
operations or for any: excavation of any area under such street,
�.11ey or sidewalk or for any purpose whatever connected with the
f erection, removal, alteration, or repair of any building or other
structure shall apply to the Commissioner of Streets and Public

q s-for a permit for such temporary occupation as aforesaid,

and it shall be unlawful to occupy or obstruct any street, alley
or sidewalk, as aforesaid, without a written permit therefor from
the Commissioner of Streets and Public^�,whioh permit shall
not be issued until the person, persons, firm or corporation
applying therefor shall have first :presented a building permit
therefor issued by the City Ungineer together with a bond approved
by the Board of Commissioners in such sum as shall be fixed by
said koommi ssioner of Streets and Public , -d conditioned that
the principal therein will discharge all claimsof every character
arising from or occasioned by such occupancy of ouch street,
sidewalk, or alley or by reason of damages or injuries sustained
by person or property because of such occupancy of such street,
alley or sidewalk or the construction or repair of such building
or the making of such excavation,and discharge all judgments
obtained together with all costs attached thereto, against the

City of Fort Worth by reason of any such claiziAinjury or damage
sustain*4 and every person or persons, firm or corporation carry-
ing-on any such excavation or building operation. shall keep all
streets, alleys and sidewalks adjacent to such excavations,
building operations carried on by them in e: clean and orderly
condition and unobstructed except as provided herein during such
operations and at the expiration of the time stipulated in the
permit aforesaid, they shall restore all such streets, alleys
and sidewalks to as good condition as they were before the
beginning of such operations.
Sec. 2. A violation of any of the provisions of this
ordinance shall upon final conviction thereof constitute and
work a forfeiture of all rights and privileges gianted by the
y permit hereinbefore mentioned.
Sec. 3. Permits for tem
porary street occupancy, as herein
fa provided wball be issued bg the Commisaioner.of- gtreeta
and Public shall be in writing, and shall be for a
period of time, not to exceed 90 days, such as said Commissioner
of Streets and Public bu4444s4., ay deem expedient, provided
that such time may be extended by the Board of Commissioners of
the City of Fort Worth, such permits shall specify how much of
the street, sidewalk or alley shall be obstructed, which amount of
obstruction shall be within the discretion of said Commissioner
of Streets and Public^ � provided that not more than one
half of any alley, nor more than two thirds of any sidewalk nor
more than one fourth of any street shall be so obstructed.
Sec. 4. whenever any portion of any street. alley or
sidewalk shall be obstructed under a permit as hereinbefore provid-
ed the sidewalk and driveway thereon shall be protected by a
covering which, shall be sufficient to protect the public
from dangers attendant upon such building, and a driveway and
r sidewalk sufficient in the opinion of the Commissioner of Streets
:.ud P4blio i�I,�to accomodate the public shall be kept in
good condition for travel, and a failure to comply with the pro-
Visions of this Section of this ordinance shall immediately work
a forfeiture of the permit given thereinunder and all the rights
and privileges granted therein. r
See. b. Any person or persons violating any of the provisions
of this ordinance shall be guilty of a misdemsan4v and upon
conviction shall be punishedbby a fine in any cum not to exceed

42cru; and e_ah day of such violation shall constitute a separate
offense and be punishable as such.
Sea. 6. All ordinances and parts of ordinances in
conflict herewith are hereby repealed.
This ordinance shall take effect and be in force from and
W7 after ita passage and publication as required by law.
