HomeMy WebLinkAboutOrdinance 5693 ORDINANCE NO. � ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF OAKLAND AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF L FORT 4jQRTH, TEXAS; DECLARING THE CONTRACT WITH , } Y EIA ' - , (p , FOR THE CONSTRUCTION OF SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPRO- PRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract with WORTH CONSTRUCTION CC10ANY for the making and construction of certain street improvements on the hereinafter described portions of streets, avenues and public places in said City, to-wit: 1. OAKLAND BOULEVARDt From the north line of Bridge Street north approximately 165 feet, known and designated as Unit 1, project No. 104-35000-305. WHEREAS, by sundry proceedings heretofore passed by the City Council of the ri ty of Fort Worth, Texas, including Ordinance No. 5563 , a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues ,and public places and against the real and true owners thereof; and, WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. o and WHEREAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT; I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. II. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on'the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: III. When each of the certifiactes has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector as part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. V. This ordinance shall take effect and be in full force and effect from and after the date of its passage. A total of $180 in liquidated damages for this project is proposed. Project Cost and Financing Bid Price: $19,744.75 Construction Cost: $18,010.65 Less 6 Days Liquidated Damages at $30.00 per day 180.00 City's Final Contract Cost : $17,830.65 Partial Payments Previously Made: 3 Amount: $16,209.58 Final Payment Due: $1,621.07 Payment to be made from Project No. 104-35000-305 Deviation of Construction Cost from Bid Price: $1,734.10 underrun for the following reasons : 1) Extension of Miller-Oakland northward by adjacent lAnd owners eliminated the anticipated need for hot mix asphaltic concrete as a transition to the rural type road section north of Bridge Street. - $ $80.00 2) Fewer utility adjustments were required during con- struction than originally estimated. - 200.00 3) Variations between quantities estimated in the con- tract specifications and quantities measured and used at the job site account for the remaining underrun. - 954.10 Total Underrrun�Q i { $1,734.10 GE�i�t„C lii.{ya/ CITY SECRETARY fT. DATE REFERENCE SUBJECT: Final Payment, Intezeec Ion PAGE 12/19/66 NUMBER Improvements on Oakland Bvulev&rd at FP-395 Dallas-Fort Worth Turnpike —2 °f _2�' Compliance with Specifications During testing on this project, 3 corings were made with the following results : Exceeds Even With Under Specs But Below Paving Specs Specs Within Tolerance Tolerance Surface 2 1 0 0 Base 3 0 0 0 On this project, the average thickness of the base course is 4.5 inches com- pared with 4.0 inches specified and the average thickness of reinforced concrete surface is 7.41 inches thick compared with 7.0 inches specified. Tests made during construction of the sub-grade, base and pavement showed that materials used were in compliance with specifications. Recommendation It is recommended that the project be accepted by adoption of an ordinance and that final payment of $1,621.07 be authorized to Worth Construction Company.
