AN ORDINANCE APPROVING AND ADOPTING ESTIMATES OF THE COST OF IMPROVE- MENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS ON A PORTION OF NEVILLE STREET AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; FIXING TIME AND PLACE FOR HEARING TO THE OWNERS OF ABUTTING PROPERTY AND TO ALL OTHERS INTERESTED; DIRECTING THE CITY SECRETARY TO GIVE NOTICE OF SUCH HEARING; AND DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL AND BY FILLING THE COMPLETE ORDINANCE IN THE APPROPRIATE ORDINANCE RECORDS OF THE CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Fort Worth, Texas,has heretofore ordered that each of the hereinafter described portions of streets, avenues and public places in the City of Fort Worth, Texas, be im- proved by raising,grading and filling same and by constructing thereon the following, to-wit: 1. NEVILLE STREET: From the north line of Pershing Avenue to the . south line of Camp Bowie Boulevard, known and designated as Unit No. 1, Project No. 097-24000-143, a 6 inch hot mix asphaltic concrete surface on a 30 foot roadway. 20 GEDDES AVENUE: From the west line of Penticost Street to the east line of Eldridge Street, known and designated as Unit No. 2, Project No. 097-24000-143, a 6 inch hot mix asphaltic concrete surface on a 36 foot roadway. 3. ELDRIDGE AVENUE: From the north line of Geddes Avenue to the north line of Donnelly Avenue, known and designated as Unit No. 3, Project No. 097-24000-143, a 6 inch hot mix asphaltic concrete surface on a 30 foot roadway. 4. ELDRIDGE AVENUE: From the north line of Donnelly Avenue to the south line of Curzon Avenue, known and designated as Unit No. 4, Project No. 097-24000-143, a 6 inch hot mix asphaltic concrete surface on a 30 foot roadway. . 5, WELLESLEY AVENUE: From the east line of Hulen Street to 210 feet east, known and designated as Unit No. 5, Project No. 097-24000-143, a 6 inch hot mix asphaltic concrete surface on a 30 foot roadway. 6. LISBCN STREET: From the west line of Clymer Street to 150 feet west, known and designated as Unit No. 6, Project No. 097-24000-143, a 6 inch hot mix asphaltic concrete surface on a 30 foot roadway. 7. RUTLEDGE STREET: From 180 feet east of Landers Street to the west line of Trinity Avenue, known and designated as Unit No. 7, Project No. 097-24000-143, a 9 inch hot mix asphaltic concrete surface on a 40 foot roadway. 8. KENLEY STREET: From the north line of the East-West Freeway to the south line of Calmont Avenue, known and designated as Unit No. 8, Project No. 097-24000-143, a 6 inch hot mix asphaltic concrete surface on a 30 foot roadway. 9. KE LEY ST-E3T: From the north line of Calmont Avenue to the south line of Eirchman Avenue, known and designated as Unit No. 9, Project No. 097-24000-143, a 6 inch hot mix asphaltic concrete surface on a 30 foot roadway. 10. From Wichita Street to 011ie Street, known and designated as Unit 10B, Project No. 097-24000-143, a 12 inch hot mix asphaltic concrete surface on a 7 inch gravel base on a 40 foot roadway. 2 z together with combined concrete curbs and gutters on proper grade and line where same are not already so constructed, together with storm sewers and drains and other necessary incidentals and appurtenances; all of said improvements to be constructed as and where shown on the Plans and in strict accordance with the Plans and Specifications therefor; and contract therefor has been made and entered into withTESAS BITULITHIC CO. ; and WHEREAS, the City Council of the City of Fort Worth, Texas, has caused the Public Works Director to prepare and file estimates of the cost of such improvements and estimates of the amounts per front foot proposed to be assessed against abutting property and the owners thereof, and such estimates have been ex- amined. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: 1. Such estimates be, and they are hereby adopted and approved. II. It is hereby found and determined that the cost of improvements on each portion of street,avenue and public place hereinafter described, with the amount or amounts per front foot proposed to be assessed for such improvements against abutting property and the owners thereof, are as follows, to-wit: 1. A hearing be given and held by and before the City Council of the City of Fort Worth,Texas,to all own- ing or claiming any property abutting upon said portions of streets, avenues and public places,as well as to all owning or claiming any interest in any such property. Such hearing shall be given and held on theZ th day of ;6AUKrY:: , 1966_, at 9:30 A-R• , in the Council Chamber in the City Hall in the City of Fort Worth, Texas, and the City Stcretary is hereby directed to give notice of the time and place of such hearing and of other matters and facts in accordance with the terms and provisions of an Act passed at the First Called Session of the Fortieth Legislature of the State of Texas, and known as Chapter 106 of the Acts of said Ses- sion, now .benig shown as Article 1105b of Vernon's Texas Civil Statutes.Such notice shall be by advertisement at least three times in a newspaper published in the City of Fort Worth,Texas,the first publication to be made at least ten days before the date of said hearing.Said notice shall comply with and be in accordance with the terms and provisions of said Act. The City Secretary is further directed to give personal notice of the time and place of such hearing to all owning or claiming any property abutting on said portions of streets,avenues and public places,as well as to all owning or claiming any interest in any such property. Such personal notice shall be given by the City Secretary mailing said notice postage prepaid, to the respective owners of record of the properties to be assessed, and to any person owning or claiming any interest in said properties,to the last known address of said owner or persons. It shall not be necessary for the City Secretary to mail said notices to any owner or other person claiming an interest in the property to be assessed when the addess of such owner or other person claiming an interest in the property to be assessed is unknown to the City Secretary and cannot be determined by the City Secretary after reasonable investigation. In this connection the City Secretary shall prepare and file with these proceedings a list of the properties to be assessed, the names of those persons own- ing or claiming any interest in said properties to whom the notice was mailed, together with the last known address of the respective owners and those persons owning or,claiming any interest in said property. The City Secretary shall certify that each of the parties named in said list whose address was known to him, was mailed a copy of the notice of hearing and shall further certify the date or dates on which said notice was mailed. A copy of the notice shall be attached to such certificate. The certificate of the City Secretary will be conclusive evidence of the facts therein recited. Failure of the City Secretary to give notice of hearing by mail as herein provided for, or failure of the owners or other persons interested to receive said notice,shall in nowise invalidate said hearing or any assessments levied pursuant to said hearing, but notice of hearing shall be sufficient, valid and binding upon all owning or claiming such abutting property or any interest therein when same shall have been given by newspaper advertisement as first hereinabove provided. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council and by filing the complete ordinance in the appropriate Ordinance Records.of this City. . One petitioned unit, No. 7 - Rutledge Street, was requested by all the owners living on the street, but less than 50 per cent of the owners of all abutting property. A railroad, which opposes the project, owns property on the south side of Rutledge Street. Owners of ten parcels on the north side of the street are evenly divided for and against the paving, and one of the two owners living on the street now opposes the paving as indicated on the post card survey. Rutledge Street, located par- allel to and one block south of Vickery Boulevard, is paved for approximately DATE REFERENCE SUBJECT: Assessment Paving at 10 Locations PAGE NUMBER on the West Side 12/27/65 C-627 Project No. 097-24000-143 .- Of 4 one-half of the block. The remainder is graveled and because of industrial activity in the area is heavily traveled and dusty. The number of units initiated by the City is higher than usual' because this type of work was delayed earlier in 1965 to insure adequate funds for peti- tioned projects. The following units were initiated by the City for the following reasons : Unit 1, Neville Street: The intersection improvements at the intersection of Camp Bowie, Merrick and Pershing have made it necessary for traffic moving east on Pershing to enter Camp Bowie on Neville, which is a short block to the east of the intersection. On September 28, 1964 (M&C G-699) the Council granted authority to prepare plans and specifications for this unit. Units 3 and 4, Eldridge Street: These units were initiated in connection with the petition to pave Geddes Avenue, Unit 2. Paving these two blocks of Eldridge Street will provide paved access from Geddes Avenue north to south service road of the freeway. See Attached A-2. Unit 5, Wellesley Avenue and Unit 6, Lisbon Street: The paving of these units will complete the paving within each block, the major portion being already paved. Each unit is a very short section which will provide continuous paving within the block. Unit 8, Kenley Street: This unit was initiated in connection with the peti- tion to pave Kenley Street, Unit 9. Paving this unit will provide continu- ous paving on Kenley Street north of the West Freeway Service Road. Unit 10, Seminary Drive: Seminary Drive west of Wichita Street to Mansfield Highway was originally a 30 foot county road. The area has become highly developed and commercial in character. As new buildings were erected, the City made plans for a 60 foot street and obtained additional right-of-way by purchase and dedication. Paving tie-ins were made to extend the roadway 15 feet to each side as new curb and gutter was installed. One parcel of additional right-of-way was acquired on December 13, 1965 (M&C L-915), and independent appraisals are now being acquired prior to negotiating for a piece of right-of-way at Riverside Drive. All other right--of-way has been donated or dedicated. Paving Seminary Drive will up-grade the street by replacing the present inferior roadway which is basically a county type penetration asphalt street with temporary widening of 15 feet on each side with a permanently paved 60 foot roadway. Seminary Drive from Mansfield Highway to Wichita Street is included in the 1965 Capital Improvement Program (A-190) as an assessment paving project.
