ORDINANCE NO. ��Y 3 ORDINANCE ACCEPTING IMPROV7MENTS ON A PORTION OF RODEO STRUT _ AND PORTIONS OF SUNDRY OTH-t STR KTTS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WCIRTH, TEXAS; DECLARING THE CONTRACT WITH _G FFICIAL RECORD roNSTRUCTION COMPANY FOR THE CONSTRUCTION OF SAID IMPROV71-CENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUAN , CITY SECRETARY EXECUTION AND DELIVERY OF CERTIFVATT�S IN EVIDENCE OF SPECIAL ASS S - MENTS LEV13D AFTER GIVING EFFECT TO SUNMY CREDITS REPYIN AUTHCRI T. {NORTH, TE1f. AND ALLOWED AGAINST SOME OF SAID ASSESSM-TNITS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ETMOLL THIS OPDi'?ANCE BY COPYING THE CAP- TION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FMT WCRTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING A"TD 2FMTIVE DATE. W'MEAS, the City of Fort Worth, Texas, has heretofore entered into a contract with M.nnF rr)NSTRUCTION COMPANY for the making and construction of certain street improvements on the hereinafter described portions of streets, avenues and public places in said City, to-wit; 1. Rodeo Street From 'nest Line Old Mansfield Rd. to 24t east of west Property line of Lot 13, Blk 1, Rolling Hills Addition, known and designated as Unit No. 1. 2. El Rancho Road From North line Rodeo Street to South line Sarah Jane Lane known and designated as Unit No. 2. 3, Montague Street From West line Erath Street to West line Shackle- ford Street known and designated as Unit No. 3. 4. Shackleford Street From North line Hwy. #287 to South line of Algerita Street known and designated as Unit No. 4. 5. Shackleford Street From South line Algerita Street to South property line of Lot 7, Blk 1, Glen Park Addition known and designated as Unit No. 5. 6. BurV Street From South line Rodeo Street to North line of Pioneer Street known and designated as Unit No. 6. 7. Fair Park Blvd. From North line Seminary Drive to South line Prince Street known and designated as Unit No. 7. 8. McClure Street From North line Seminary Drive to south line Prince Street known and designated as Unit No. S. 9. Flamingo Road From North line Kellis Street to South line Martin Street known and designated as Unit No. 9. WIMEAS, by sundry proceedings heretofore passed by the City Council of the City of Fort Worth, Texas, including Ordinance No. 4743 , a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, W=E S, the City Council of the City of Fbrt Worth, Texas, has, upon re— view, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 4743 , and WHMAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, TH7R^.FORE, BE IT ORDAI'T_TD BY TILP CITY COUNCIL OF TIE CITY OF FORT WORTH, TT.RAS, THAT: I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with re— ference thereto be, and it is hereby, found and declared fully completed and performed. II. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro— perty assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certifi— cates, toEether with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: III. When each of the certificates has been duly executed as hereinabove provid- ed, same shall be delivered to the Tax. Assessor-Collector as part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. V. This ordinance shall take effect and be in full force and effect from and after the date of its passage.
