AN ORDINANCE AMENDING ORDINANCE NO. 3011, BEING AN
ORDINANCE TO REGULATE AND RESTRICT THE LOCATION AND CITY SECRETARY
USE OF BUILDINGS, STRUCTURES, AND LAND FOR TRADE,
INDUSTRY, RESIDENCE, OR OTHER PURPOSES, THE HEIGHT, FT. WORTH, TEX.
NUMBER OF STORIES AND SIZE OF BUILDINGS AND OTHER
STRUCTURES, THE SIZE OF YARDS AND OTHER OPEN SPACES,
OFF-STREET PARKING AND LOADING AND THE DENSITY OF
POPULATION,- AND FOR SAID PURPOSES TO DIVIDE THE
MUNICIPALITY INTO DISTRICTS OF SUCH NUMBER, SHAPE,
AND AREA AS MAY BE DEEMED BEST BY FIXING DEFINITE
USES OF THE BUILDINGS HEREINAFTER ERECTED IN SAID
DESCRIBED AREAS FROM THE USES AS SHOWN ON THE MAPS
CONTAINED IN SAID ORDINANCE NO, 3011E PRESCRIBING A
SAVINGS CLAUSE, PROVIDING A FINE OF NOT LESS THAN
$5,00 NOR MORE THAN $200,00 FOR EACH OFFENSE, AND
THAT EACH DAY THAT A VIOLATION IS PERMITTED TO EXIST
SHALL CONSTITUTE A SEPARATE OFFENSEa AND NAMING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION Ia
That Section 1 of Ordinance No, 3011, previously amended by Ordinance No, 3230, Defi-
nitions, be amended by amending or adding definitions in proper sequence so that they
shall be in alphabetical order and hereafter read as follows:
8GA, BOARDER, LODGER OR ROOMER: - Person occupying one or more rooms in a resident-
ial structure or portion of such structure occupied
as a single housekeeping unit as permitted in this ordinance, other than apart-
ment, hotel or motel, for which compensation is required,
16-A, DORMITORY° A building containing sleeping rooms for persons who are generally
engaged in the same daily activities, usually students,
16-B, DRIVE-IN RESTAURANT° Any eating establishment where prepared food, meals,
or beverages are dispensed for consumption outside the
building,
17-D, EMPLOYEE PARKING- For the purpose of this ordinance, requirements for employee
parking shall be based on the maximum number of employees
that will be on the 'Job at any one time,
18-B, FRATERNITY OR SORORITY HOUSES A building containing the general facilities
and sleeping rooms for members of a fraternity
or sorority,
22-A, GROSS FLOOR AREA- For any building shall be measured by taking the outside
dimensions of the building at each floor level, except
that portion of the basement used only for utilities or storage, and any
areas within the building used for off-street parking,
25-A, HOSPITAL, GENERAL: An institution providing in-patient medical or surgical
care for the acutely sick or injured, who are generally
confined for relatively short periods of time, Included as an integral part
of the institution are such related facilities as laboratories, out-patient
departments, educational facilities, food services, and staff offices,
25-B. HOSPITAL, LONG TERM: An institution 'providing in-patient medical
treatment of an intensive and specialized
nature for the chronically ill, who are generally confined for
periods of time exceeding 30 days. Long term hospitals include
homes for alcholic, narcotic, or psychiatric patients, and insti-
tutions for patients with a contagious disease, such as tuberculosis
sanitariums.
29-R. KENNEL: Any building,, lot, or premises on or in which four (4) or more
dogs or cats (at least eight weeks of age) are kept, or any
building, lot, or premises where dogs or cats are housed or accepted for
boarding, for which renanwration is received.
39-A. MIOTFL: A building or group of buildings, not .more than two stories in
height, containing individual sleeping or living units, specially
designed for the convenience of transicntmotorists, and arranged so that
the autos are parked adjacent to the individual rooms by the guests them-
selves.
39-B. MOTOR HOTEL: A building or group of buildings containing individual
sleeping or living units, specially designed for the
convenience of transientmotorists, but which furnishes services and
facilities ordinarily furnished by hotels, such as bellboys, a central
lobby, and attendant parking. A Motor Hotel shall be subject to the
same regulations as a Motel.
39-C. NURSING AND CARE. HOME: An institution providing meals and resident
care and services for persons who are generally
admitted for periods of time exceeding 30 days. Such service includes
custodial or attendant care, but may or may not provide for routine
and regular medical and nursing services. Nursing and care homes in-
clude homes for the aged, and convalescent and rest homes.
39-D. OFF STREET: Off the right-of-way of a public street or place.
41-A. PARKING SPACE: A minimum off-street parking space for passenger
automobiles shall be considered to be nine (9) feet
in width and eighteen (18) feet in length, not including maneuvering
space. See Section 19, A, l,of this Ordinance for details.
41-8. PHILANTHROPIC OR FLEENIOSYNARY INSTITUTIONS: An organized body or
society for promoting a
charitable, benevolent, or educational objective, and the building
or buildings for carrying on the work of such an organization. This
shall include a community center (public), welfare or health center.
42-A. PRIVATE. CLUB: An association of persons meeting regularly for their
mutual benefit or for the promotion of some common pur-
pose, supported jointly through payment of membership dues, all members
having the right to vote on club policies and business.
46-A. STAFF MEMBER: For colleges and universities shall include persons, other
than teachers, directly involved in the regular educational
or administrative procedures of the college, and including all office
personnel.
50-A. STUDENT, COLLEGE OR UNIVERSITY: Any regularly enrolled individual
carrying twelve (12) or more semester
hours for credit.
50-B. STUDENT, HIGH SCHOOL: Any regularly enrolled individual pursuing a
course of study leading to graduation.
SECTION 2.
The zoning regulations and districts, as herein established, have been made in
accordance with a comprehensive plan for the purpose of promoting health, safety,
morals, and the general welfare of the community. They have beer Jesigned to lessen
congestion in the streets; to secure safety from fire, panic, flood, and,.other dangers;
to provide adequate light and air; to prevent overcrowding of land; to avoid undue con-
centration of population; to facilitate the adequate provision of transportation, water,
sewerage, parks and other public requirements. They have been made after a full and
complete public hearing with reasonable consideration, among other things, of the
character of the district and its peculiar suitability for the particular uses and
with a view of conserving the the value of buildings and encouraging the most appro-
priate use of land throughout the community.
SECTION 3.
This ordinance shall be cumulative of all other ordinances of the City of Fort
Worth affecting zoning and shall not repeal any of the provisions of said ordinance
except in those instances where Provisions of those ordinances are in direct conflict
with the provisions of this ordinance.
SECTION 4.
Should any section, clause or provision of this ordinance be declared by the
Court to be invalid, the same shall not affect the validity of the ordinance as a
whole or any part thereof, other than the part so declared to be invalid.
SECTION 5.
Any person, firm or corporation who violates, disobeys, omits, neglects or
refuses to comply with or who resists the enforcement of any of the provisions of
this ordinance shall be fined not less than Five and No/100 Dollars ($5.00) nor
more than Two Hundred and No/100 Dollars ($200.00) for each offense. Each day that
a violation is permitted to exist shall constitute a separate offense.
SECTION 6.
This Ordinance will take effect and be in full force and effect from and after
its passage and publication as required by law,
