AN ORDINANCE AMENDING THE MEAT INSPECTION ORDINANCE, BEING
ORDINANCE NO. 2877 OF THE CITY OF FORT WORTH, BY ADDING THERE-
TO SECTION XII-A, PROVIDING FOR THE ADOPTION OF THE RULES AND
REGULATIONS AND STANDARDS FOR THE INSPECTION OF MEAT, MEAT
PRODUCTS AND MEAT FOOD PRODUCTS PROMULGATED BY THE COMMISSIONER
OF HEALTH OF THE STATE OF TEXAS, AS APPROVED BY THE STATE BOARD
OF HEALTH OF THE STATE OF TEXAS, TO ENABLE ANY ESTABLISHMENT IN
THE CITY OF FORT WORTH, TEXAS, IN WHICH MEAT, MEAT PRODUCTS AND
MEAT FOOD PRODUCTS ARE PREPARED OR PROCESSED FOR HUMAN CONSUMP-
TION, UPON MEETING SUCH STANDARDS, TO USE THE "TEXAS STATE AP-
PROVED MEAT FOR HUMAN FOOD" LABEL ON MEAT AND MEAT FOOD PRODUCTS
PREPARED OR PROCESSED BY SUCH ESTABLISHMENT; REPEALING ALL ORDI-
NANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING
A SAVINGS CLAUSE; FIXING A PENALTY FOR THE VIOLATION HEREOF;
AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION I.
That the Meat Inspection Ordinance of the Code of Ordinances of the
City of Fort Worth, being Ordinance No. 2877, be and the same is hereby
amended by adding thereto Section XII-A, which shall read as follows:
1. ADOPTION OF RULES AND REGULATIONS OF COMMISSIONERS OF HEALTH
AS APPROVED BY THE STATE BOARD OF HEALTH.
The rules and regulations and standards for the inspection
of meat, meat products and meat food products, promulgated by
the Commissioner of Health of the State of Texas under authority
of Article 4418d, Vernon's Annotated Civil Statutes, as approved
by the State Board of Health, State of Texas, as authorized by
Article 4476-3, Vernon's Annotated Civil Statutes, dated April,
1959, as amended by amendments dated December 14, 1959, are here-
by in all things adopted and made a part of this ordinance the
same as if set forth in full herein, and the provisions, standards,
rules and regulations contained therein are made mandatory re-
quirements for the inspection and labelling of meat and meat food
products produced, sold or offered for sale within the limits of
the City of Fort Worth with the "Texas State Approved Meat for
Human Food" label thereon. Any establishment desiring to sell
or offer for sale meat, meat products and meat food products in
the City of Fort Worth containing thereon the "Texas State Ap-
proved Meat for Human Food" label on such meat, meat products
and meat food products shall be governed by the specifications
and regulations promulgated by the Commissioner of Health as ap-
proved by the State Board of Health adopted herein, and all re-
quirements specified therein shall be complied with.
2. The City Council finds that the necessary facilities for inspec-
tion and for enforcement of such rules exist in the Department
of Health, City of Fort Worth, Texas.
SECTION II.
This ordinance shall be and is hereby declared to be cumulative of
all other ordinances of the City of Fort Worth providing for the inspec-
tion of meat, meat products and meat food products, and shall not operate
to repeal or affect any such ordinances or ordinance except insofar as
the provisions of such ordinances or ordinance are inconsistent or in con-
flict with the provisions of this ordinance, in which instance or in-
stances such conflicting provisions in said other ordinance or ordinances
shall be and are hereby repealed.
SECTION III.
If any section, subsection, sentence, clause or phrase of this ordi-
nance is for any reason held to be unconstitutional, such decision shall
not affect the validity of the remaining portions of this ordinance, and
all the remainder of this ordinance not so declared to be invalid shall
continue to be in full force and effect. The City Council of the City of
Fort Worth, Texas, hereby declares that it would have passed this ordi-
nance and each section, subsection, sentence, clause or phrase thereof
irrespective of the fact that any one or more sections, subsections, sen-
tences, clauses or phrases be declared unconstitutional.
SECTION IV.
Any person violating any of the provisions of this ordinance shall
be deemed guilty of a misCemeanor, and the person, or any employee, agent,
manager or officer thereof, who is guilty of violating any of the provi-
sions shall, upon conviction thereof, be fined in any amount not to exceed
Two Hundred Dollars ($200.00) for each offense, and every violation of
and each and every day's failure or refusal to comply with the said provi-
sion will constitute a separate offense.
SECTION V.
This ordinance shall be effective from and after its passage and
publication as provided by law.

Members of the City Council Re: State Approval of the City of
City of Fort Worth Fort Worth Meat Inspection
Program
Mrs. McKnight and Gentlemen:
Attached is a proposed amendment to Ordinance No. 2877 relating to the
City's meat inspection program, which will enable the City of Fort Worth
to participate in the municipal - State cooperative meat inspection pro-
gram. The state meat inspection law provides a section whereby a local
inspection program may be approved by the State Department of Health, and
thus entitle local meat processing establishments to use the "Texas State
Approved Meat for Human Food" label on their meat and meat food products.
The governing State statute is as follows:
"Section I.R. Adoption by Cities. The governing body of any city in the
State of Texas may make mandatory the provisions of this Act and the
inspection and labeling of meat and meat food products produced, sold,
or offered for sale within their respective Jurisdictions by adopting
any ordinance to that effect and by providing the necessary facilities
for inspection and for the enforcement of this Act."
The State Department of Health has advised the City of Fort Worth Health
Department that in order to qualify for the cooperative inspection program,
it will be necessary for the City Council to pass the attached amendment
to Ordinance No. 2877, adopting all rules and regulations as promogated by
tffe Texas State Board of Health.
A meeting was held on April 13, 1960, where the proposed municipal - state
cooperative meat inspection program was discussed. Nineteen wholesale
meat distributors and processors in Fort Worth were represented. The group
agreed that there would be submitted to the City Council the attached
amendment to the present meatinspection ordinance, whereby the City of
Fort Worth could participate in the municipal-state cooperative meat in-
spection program.
At the present time, three establishments, Superior Meat and Provision Co.,
Famous Chili Company of Texas, and the Fort Worth Packing Company have
made application to the City Health Department for use of the "Texas State
Approved Meat for Human Food" label on their products. Adoption of the pro-
posed ordinance attached will permit this to be done. The necessary inspec-
tions of these three plants can be accomplished with present personnel .

The Fort Worth Packing Company and the Superior Meat and Provision Company
each are now paying a $50.00 per month meat inspection fee. It is recom-
mended that the City Council approve a $50.00 a month inspection fee for
the Famous Chili Company of Texas. Should additional meat processors make
application for State approval in the future, it may be necessary to adjust
the fee schedule in order to finance additional personnel .
