COUNTY OF TARRANT §
WHEREAS, the City of Fort Worth ("City") and AMEC Earth and Environmental, Inc.
("Engineer") made and entered into City Secretary Contract No. 30743 (the "Contract") which was
authorized by the City Council by M&C C-20292 on September 21, 2004;
WHEREAS,the Contract involves engineering services for the following project:
Comprehensive Storm Water Management Study
WHEREAS, on April 19, 2005, via M&C C-20666, the City Council authorized additional
funding for said Contract in the amount of$ 740,000.00 for Phase II Services, which increased the
maximum funding for all work and services to $1,037,348.00;
WHEREAS, M&C C-20666 authorized a contract for Phase II Services (Implementation of
Storm Water Utility) which was memorialized as Amendment No. 1 to said Contract, in the amount
of$695,024.00 (City Secretary Contract No. 31879);
WHEREAS, Amendment No. 2 in the amount of $40,600 for additional engineering
services (survey and drainage calculations) was administratively executed because sufficient funds
were appropriated under M&C C-20666; and
WHEREAS, it has become necessary to execute this final Amendment No. 3 to said
Contract to include an increased scope of work and revised maximum fee.
NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized
representatives, enter into the following agreement that amends the Contract:

Article I of the Contract is amended to include the additional services specified in the
proposal letter dated May 7, 2007, a copy of which is attached hereto and incorporated herein. The
cost to the City for the additional services to be performed by the Engineer totals $6,

Article II of the Contract is amended to provide for an increase in the max mt ;
paid to Engineer for all work and services performed under the Contract, as amen Pd,
total fee paid by the City for all work and services shall not exceed the sum of $1,043,645.50.

All other provisions of the Contract which are not expressly amended herein shall remain in
full force and effect.

Dear Don:
As we discussed in January, AMEC Earth and Environmental, Inc. provided, at the request of
the City, additional services related to the review of the residential tiering system and start-up of
the City's new Storm Water Utility. The description and costs for these additional services are
as outlined below:
1.) Calculate impervious area for a sample of residential building footprints to compare findings
with the original process of tiering residential properties by using livable square footage and
number of garage spaces. Summarize and review findings with the City. Provide additional
follow-up information on multi-story impacts.—Cost for this additional service -$4000.00
2.) One-day on-site visit by Jean Haggerty and Elizabeth Treadway to perform project review
including discussion of program priorities, rate structure, public education, and implementation
issues. Follow-up information provided on the original rate work, federal exemptions, and
budget issues.—Cost for this additional service- $2297.50,

DISCUSSION:
The City's current Storm Water Drainage Program, developed in the 1960's and revis
address channel erosion and all aspects of flooding impacts downstream of developn

On January 14, 2004, the City issued a Request for Statement of Qualifications (RFQ
Storm Water Management Study. In response, City staff received eight Statements c
February 12, 2004.
On June 9, 2004, a Consultant Selection Committee composed of City staff from the '
Public Works, Department of Engineering, Environmental Management, Parks and C(
Water Department, reviewed all Statements of Qualifications and selected three cons
consideration and interviews.
On June 25, 2004, the Consultant Selection Committee interviewed the top three con
