ORDINANCE NO. 7-/ /3 AN ORDINANCE AMENDING ORDINANCE NO. 7965, VACATING, ABANDONING AND CLOSING WHITE LAKE ROAD EAST IN THE 6400 BLOCK, A WIDTH OF 80 FEET, FROM THE EAST RIGHT-OF-WAY LINE OF BRENTWOOD STAIR ROAD EAST TO THE WEST RIGHT-OF-WAY LINE OF TURNPIKE RAMP (I-30) , TOGETHER WITH TWO PUBLIC OPEN SPACE EASEMENTS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Ordinance No. 7965 of the City of Fort Worth be and the same is hereby amended and, after having being so amended shall hereafter be and read as follows: "SECTION 1. "That White Lake Road East in the 6400 block, a width of 80 feet, from the east right-of-way line of Brentwood Stair Road east and to the west right- of-way line of Turnpike Ramp (I-30) , together with two public open space easements out of Lots 1 and 2, Block 1, Dugger Medical Park Subdivision to the City of Fort Worth, Tarrant County, Texas, according to Plat Recorded in Volume 388-127, Page 58, Plat Records, Tarrant County, Texas, and White Lake Road East adjacent to said Lots 1 and 2, described by metes and bounds as follows: BEGINNING at a point in the West line of Inter- state Highway 30 Exit Road said point being S. 020 - 08' W. 20.0 feet from the northeast corner of said Lot 2, Block 1; THENCE N. 420 - 05' W. 28.4 feet to a point; THENCE N. 670 - 24' W. 304.1 feet to a point; THENCE S. 380 - 06 ' W. 23.2 feet to a point in the East line of Brentwood Stair Road, said point being on a curve to the right having a radius of 907.43 feet; THENCE Northwesterly, along said corner 2.2 feet to the end of said curve; THENCE N. 160 - 25' W. continuing along the East line of Brentwood Stair Road 102 .4 feet to a point for corner; THENCE S. 670 - 24' E. 371.0 feet to a point in the West line of Interstate Highway 30 Exit Road; THENCE S. 020 - 08' W. along said West line 100.0 feet to the POINT OF BEGINNING. be and the same are hereby vacated, abandoned and permanently closed as street right-of-way and public open space easements. "SECTION 2. "That the fee to the land in said right-of-way and public open space easements is hereby released and shall revert to the adjacent owners as provided by law, SAVE AND EXCEPT that easements are retained for any and all existing utilities." SECTION 2 . That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3. That this ordinance shall take effect and be in full force and effect from and after the date of its passage and it is so ordained. City of Fort Worth, Texas Mayor and Council Communication DATE REFERENCE SUBJECT: Vacation Of Street & TWO Public PAGE NUMBER Open Space Easements: Bugger 10/2i79 PZ-935 Medical Park, Lots 1 and 2, Blcc ' °f�- 1 (V-79-22) On August 28, 1979, the City Council adopted Ordinance No. 7965 which vacated, abandoned and closed White Lake Road East in the 6400 Block , a width of 50 feet, from the east right-of-way line of Brentwood Stair Road East to the west right- of-way line of the Turnpike Ramp (I-30), together with two public open apace easements. During final review of the required replat of the vacated right-of-way with aubtting property, additional information from the surveyor responsible for the replat documented that White Lake Road East was actually dedicated with a right- of-way width of 80 feet rather than 50 feet as initially indicated. All interested parties concerned with this question have been contacted and have raised no objections to the request to vacate the .additional 30 foot or right- of-way,_Iprovided the vacated right-of-way is replatted with the adjoining pro- perty and retained as a drainage and utility easement. A satisfactory replat showing 80 feet of right-cf-way for White Lake Road East, vacating same and also vacating the two subject public open space easements has been submitted. Recommendation It is recommended that an ordinance amending Ordinance No. 7965 be adopted vacating both open space easements and the 80-foot-wide White Lake Road East right=of-way as previously recommended by the Plan Commission.
