AN ORDINANCE AMENDING SECTION 37-26.1 OF CHAPTER 37 OF THE CODE OF THE CITY OF FORT WORTH (1964) , AS AMENDED, BY AMENDING SUB- SECTIONS (d) AND (e) BY INCREASING FRONT FOOTAGE CHARGES FOR SERVICE CONNECTIONS; PROVIDING THAT THIS ORDINANCE SHALL BE CUM- ULATIVE OF ALL OTHER ORDINANCES OR PROVI- SIONS OF THE CODE OF THE CITY OF FORT WORTH; REPEALING ALL ORDINANCES OR PROVISIONS OF THE CODE OF THE CITY OF FORT WORTH IN CON- FLICT HEREWITH; PROVIDING A SAVINGS CLAUSE; AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Subsections (d) and (e) of Section 37-26.1-Front Footage Charges for Service Connections-of Chapter 37 of the City of Fort Worth (1964) , as amended, be and the same are hereby amended to read as follows: "Sec. 37-26.1. Front footage charges for service connections. "(d) The amount of the front footage charge to be made for each service connection to a water main under this section shall be Ten Dollars and Ninety Cents ($10.90) per front foot. " "(e) The amount of the front footage charge to be made for each service connection to a sani- tary sewer main under this section shall be Seven Dollars and Forty Cents ($7.40) per front foot. " SECTION 2. That this ordinance shall be cumulative of all provisions of ordinances of the Code of the City of Fort Worth (1964) , as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such Code, in which event conflicting provisions of such Code are hereby repealed. SECTION 3. That all rights or remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions of Chapter 37 of the Code of the City of Fort Worth, Texas (1964) , as amended, which have accrued at the time of the effective date of this ordinance; and as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such chapter or other ordinances, same shall not be affected by this ordi- nance but may be prosecuted until final disposition by the courts. SECTION 4. That it is hereby declared to be the intention of the City Council of the City of Fort Worth, Texas, that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable and if any section, paragraph, clause, or phrase of this ordinance shall be declared void, ineffective or uncon- stitutional by the valid judgement or final decree of a court of competent jurisdiction, such voidness, ineffectiveness or un- constitutionality shall not affect any of the remaining sections, paragraphs, sentences, clauses or phrases of this ordinance since the same would have been enacted by the City Council without the incorporation herein of any such void, ineffective or unconsti- tutional section, paragraph, sentence, clause or phrase. SECTION S. The next revision is to be effective April 1, 1979. These new charges are to be equal to 80% of the on—site front foot costs for water and sanitary sewers constructed by contracts let from March 1, 1978, through February 28, 1979. Where City forces are utilized to construct extensions to serve new developments or to serve single customers, the charge per foot of water or sewer extension constructed has been set as equal to double the applicable front foot charge. On this basis, the Community Facilities Policy should be amended to provide water and sewer extension charges for facilities constructed by City forces as follows: Current Charge Proposed Charge Facility -- -Per--Foot--- - -Per-Foot-- Water $19.60 $21.80 Sanitary Sewer $14.20 $14.80 Similar recomputations and revisions of front foot and extension charges will be made each quarter, with the next changes to be based on costs for the period of June 1, 1978, through May 31, 1979. It is necessary to provide for an orderly transition from the old front foot charges and the old extension charges to the proposed front foot charges and implementation of the new extension charges to be effective April 1, 1979. The following recommendations have been prepared to meet that requirement. Rec-ommendations: It is recommended that: 1. An ordinance be approved, effective April 1, 1979, amending Section 37-26.1 of Chapter 37 of the Fort Worth City Code to increase front foot charges DATE REFERENCE SUBJECT: Proposed Changes in Front Foot PAGE NUMBER Charges for Water and Sanitary 3�'�.3; �9 C-4098 Sewer Connections 2 2 °' for water service connections from $9.80 per front foot to $10.90 per front foot and to increase front foot charges for sanitary sewer service connections from $7.10 per front foot to $7.40 per front foot; 2. The Water and Sanitary Sewer Installation Policy be amended to incorporate these front foot charge changes and increase the charge per foot of extensions constructed by City forces from $19.60 per foot to $21.80 per foot for water facilities and to increase the charge from $14.20 to $14.80 per foot for sanitary sewer facilities; and 3. Such charges become effective April 1, 1979, ,including all developer projects on which bids have not been received by that date and all City forces extension projects not authorized for construction by that date.
