HomeMy WebLinkAboutOrdinance 7793 ORDINANCE NO. 7 :7 G} AN ORDINANCE VACATING ALL 10 FOOT UTILITY EASEMENTS DEDICATED WITHIN BLOCKS 1, 2, 3 and 4 COLDWELL ACRES ADDITION AS RECORDED IN VOLUME 388-Y, PAGE 132, PLAT RECORDS, TARRANT COUNTY, TEXAS; VACATING ABANDONING AND CLOSING THE 7700 AND 7800 BLOCKS OF DOREEN AVENUE, COLDWELL STREET AND WEST ELIZABETH LANE SAVE AND EXCEPT THOSE PORTIONS OF THE RESPEC- TIVE STREETS CROSSED BY CURTIS DRIVE RIGHT-OF-WAY; PROVIDING FOR THE REVERSION OF THE FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That all ten foot (10' ) utility easements dedicated and lying within Blocks 1, 2, 3 and 4 of the Coldwell Acres Addition according to the plat thereof recorded in Volume 388-Y at Page 132, Plat Records of Tarrant County, Texas, be and the same are hereby vacated, abandoned and permanently closed as easements for utility purposes. SECTION 2. That the 7700 and 7800 blocks of DOREEN AVENUE, COLDWELL STREET AND WEST ELIZABETH LANE, the same being more particularly described as: DOREEN AVENUE from the East right-of-way line of Cherry Lane 480' East to the West right-of-way line of Curtis Drive and from the East right-of- way line of Curtis Drive 390' East to the West right-of-way line of Reagan Drive a width of 50' ; COLDWELL STREET from the North right-of-way line of West Elizabeth Lane North and curving to the East 450' to the west right-of-way line of Curtis Drive and from the East right-of-way line of Curtis Drive 390' East to the West right-of-way line of Reagan Drive a width of 50' ; and WEST ELIZABETH LANE from the East right-of-way line of Cherry Lane 430' East to the West right- of-way line of Curtis Drive a width of 30' and from the East right-of-way line of Curtis Drive 440' East to the West right-of-way line of Reagan Drive a width of from 30' to 251 ; be and the same are hereby vacated, abandoned and permanently closed as right-of-way for streets. SECTION 3. That the fee to the land in said utility easements is hereby released and shall revert to the adjacent owners as pro- vided by law, SAVE AND EXCEPT that easements are retained for any and all existing utilities. SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. That this ordinance shall take effect and be in full force and effect from and after the date of its passage and it is so ordained. TEXAS FILE ROWNSON City of Fort Worth, Texas HERCHERT,'tANTEIRRE BAILIFF PAIGE Mayor and Council Communication WITH K' DATE REFERENCE SUBJECT:Sheet and Easement Vacation: PAGE WILKES NUMBER �$%29/78 PZ-871 Hays Covington SL�rve Tract 9-B-2• 1 Of1 Coldwell Acres, Blocks ift REED Alta Mere Addition, Block 34, Lots 1-R and 13; Block 33, Lots 1 & 13 7700-7800 blocks Doreen Avenue, Coldwell Avenue & West Elizabeth Lane (V-78-19 & V-78-26) Cherry Lane Development Company, with consent of all other abutting owners, has requested that the City vacate Doreen Avenue in the 7700 and 7800 blocks a width of 50' and a length of 870' from Reagan Drive west to Cherry Lane; vacate West Elizabeth Lane in the 7700 and 7800 blocks a width of 25' to 30' and a length of 870' from Reagan Drive west to Cherry Lane, and vacate Coldwell Street in the 7700 and 7800 blocks a width of 50' and a length of 840' from West Elizabeth Lane north and east to Reagan Drive, all three not to include that portion crossed by Curtis Drive right-of-way, as shown by the attached map. The same applicant, being the owner of the subject property, further has requested that the City vacate all 10' utility easements dedicated within Blocks 1, 2, 3 and 4 of the Coldwell Acres Addition accordine to a plat recorded in Volume 388-Y, Page 132, Plat Records of Tarrant County, Texas, as shown by a second attached maps The City Plan Commission has reviewed the requested street vacations and has recommended approval subject to conditions. Staff now is satisfied that these conditions have been met, The requested easement vacations have been reviewed by City departments and private utility companies, and they have no objections. Recommendations It is recommended that an ordinance be adopted vacating the subject streets and easements as requested.
