AN ORDINANCE APPROPRIATING REVENUE OF THE
CITY IN EXCESS OF ITS TOTAL ESTIMATED IN-
COME AS SET FORTH IN THE ANNUAL BUDGET FOR
THE PURPOSE OF HIRING AN AVIATION CONSULT-
ANT AND TO PAY COSTS AND EXPENSES IN THE
PREPARATION AND PRESENTATION OF EXHIBITS AND
TESTIMONY AND SUCH OTHER COSTS AND EXPENSES
AS MAY BE NECESSARY IN THE MATTER OF THE AP-
PLICATION OF SOUTHWEST AIRLINES CO., DOCKET
76-10, BEFORE THE TEXAS AERONAUTICS COMMIS-
SION; PROVIDING A SEVERABILITY CLAUSE; MAKING
THIS ORDINANCE CUMULATIVE OF PRIOR APPROPRI-
ATION ORDINANCES; REPEALING ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That the City Manager of the City of Fort Worth shall
be provided with such revenue as may be secured from the
various sources included in Ordinance No. 7206 and in the
Budget of the City Manager; and, in addition thereto there
is hereby appropriated an additional sum of Fifteen Thousand
and No/100 Dollars ($15,000.00) of excess revenue and/or
unappropriated surplus to select, engage and pay for the
services of aviation consultants, the preparation and pre-
sentation of exhibits and testimony in the matter of the
Application of Southwest Airlines Co., Docket 76-10, before
the Texas Aeronautics Commission in which Southwest Airlines
do. seeks authority to expand its operations to and from
Love Field-Dallas to E1 Paso, Lubbock, Midland-Odessa,
Corpus Christi and Austin in addition to its present service
to and from Love Field-Dallas to Houston, San Antonio and
Harlingen. The City Manager shall also be authorized to
pay such other costs and expenses necessary in the City
presentation before the Texas Aeronautics Commission and
in the courts.
SECTION 2.
Should any part, portion, section or part of a section
of this ordinance be declared invalid or inoperative or void
for any reason by a court of competent jurisdicition, such
decision, opinion or judgment shall in no way affect the
remaining portions, parts, sections or parts of sections of
this ordinance, which provisions shall be, remain and continue
to be in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance
No. 7206, but all other ordinances and appropriations for
which provision has been heretofore made are hereby expressly
repealed if in conflict with the provisions of this ordinance.
SECTION 4.
That this ordinance shall take effect and be in full
force and effect from and after the date of its passage, and
it is so ordained.

On May 24, 1976 (M&C C-3415) , the City Council approved the City Attorney's
request for assistance in the matter of the application of Southwest Air-
lines for a Texas Aix Carrier Certificate of Public Convenience and Neces-
sity, Docket 76-10, and authorized a contract with R. Dixon Speas Associates
for such services. The Council was advised that the total cost of the
contracted service could not then be determined, but an appropriation of
$25,000 from the Airports Fund Reserves was authorized to finance the initial
service.
The City has been billed for services rendered through June 30, 1976, in the
amount of $24,500. It is requested that an additional sum of $15,000 be
appropriated to cover the expenses of R. Dixon Speas Associates, Inc. , since
June 30, 1976, and the unbudgeted expenses of the City Attorney.
Sufficient funds are available in the Airports Fund Reserves for this addi-
tional appropriation. An ordinance has been prepared appropriating these
reserves for this purpose.
Recommendation
It is recommended that the City Council approve increasing the Airports
budget in the amount of $15,000 and that this amount be transferred from
Airports Fund Reserve.
