AN ORDINANCE CREATING A WATERWORKS DEPARTMENT,
PROVIDING FOR THE APPOINTMENT OF A DIRECTOR,
PROVIDING FOR ADMINISTRATION AND REGULATION
OF SUCH DEPARTMENT; AND NAMING AN EFFECTIVE
DATE.
WHEREAS, on April 8, 1975, a majority of the elec-
torate of the City of Fort Worth voting in a Charter amend-
ment election found and determined that Sections 1 through 3,
inclusive, of Chapter XIV, Water Works Department, of the
Charter of the City of Fort Worth be amended so that said
chapter shall hereafter read and be as follows:
"CHAPTER XIV.
WATERWORKS DEPARTMENT
"The City Council shall provide by ordi-
nance for the establishment and regulation of
a waterworks Department, which department shall
have jurisdiction and control over the water
and sanitary sewerage systems of the City of
Fort Worth.";
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS:
SECTION 1.
That Chapter 37, Article I, of the Code of the City
of Fort Worth, Texas (1964) , as amended, be and the same is
hereby amended by adding thereto a new section designated
as Sec. 37-la, which section shall read and be as follows:
"Sec. 37-1a. Waterworks Department; Estab-
lishment and Organization. There is hereby
established a Waterworks Department, which de-
partment, under the supervision of the Director
of the Waterworks Department, shall be respon-
sible for planning, constructing, operating
and maintaining water and sanitary sewerage
systems serving the City of Fort Worth and
such others as the City Council may approve
and direct. Such responsibility of said
Waterworks Department shall include, but not
be limited to: engineering for the planning,
design and construction of water and sewer
facilities; developing programs for expendi-
tures for capital improvements of such water
and sewerage systems; providing for estab-
lishment of appropriate business procedures,
personnel and equipment to insure adequate
record keeping, billing and collection of
charges for services rendered; developing
rate structures for services rendered to in-
sure adequate revenue for the full financing
of all necessary expenses of carrying out all
Waterworks Department responsibilities; pro-
viding personnel, equipment and material as
necessary to construct, reconstruct, operate
and maintain water and sanitary sewer systems' ,
piping, pumping and treating facilities; and
such other undertakings as may be deemed ap-
propriate by the City Council. The department
shall be under the supervision of the Director
of the Waterworks Department, who shall be
appointed by the City Manager. The salary of
the Waterworks Director shall be in accordance
with the compensation plan of the City."
SECTION 2.
That this ordinance shall be in full force and ef-
fect from and after the date of its passage, and it is so
ordained.

On April 8, 1975, a majority of the electorate of the City of Fort Worth
voted in a Charter Amendment Election to amend Sections 1 through 3, in-
clusive, Chapter XIV, Water Works Department of the City Charter.
Such amendment called for the Waterworks Department to be regulated by
ordinance. Attached is an ordinance prepared by the City Attorney, which
is revised from the proposed ordinance previously submitted to describe
more fully the scope of operation of the department.
Recommendation
It is recommended that the City Council approve the ordinance as prepared
by the City Attorney.
