AN ORDINANCE DISCONTINUING TERRITORY FROM WITHIN THE CORPORATE LIMITS OF
THE CITY OF FORT WORTH; RELINQUISHING TERRITORY FROM THE EXTRATERRITORIAL
JURISDICTION OF FORT WORTH; CONSENTING TO THE ANNEXATION OF SAID TERRITORY.
BY THE CITY OF EVERMAN, TEXAS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION I
THAT the hereinafter described territory within the corporate limits of the City
of Fort Worth be and the same is hereby discontinued as a part of the City of
Fort Worth; said territory being described by metes and bounds as follows:
Being Lot 3, Block 5, Columbine Park Addition and portions of Block 32 of
the Shelby County School Land Survey, Abstract No. 1375, situated about 10
miles southeasterly from the Courthouse of Tarrant County, Texas, and being
more particularly described by metes and bounds as follows:
BEGINNING at a point for the northeast corner of Lot 3, Block 5, Columbine
Park Addition.
THENCE south, along and with the east line of Lot 3, Block 5, Columbine
Park Addition 100 feet to a point for its southeast corner, being also the
northeast corner of Tract 32-A-1 (City Tax Records), Block 32, Shelby
County School Land Survey.
THENCE continuing south, along and with the east line of Tract 32-A-1 a
distance of 63.93 feet to a point for its southeast corner, being also the
northeast corner of Tract 32-D (City Tax Records), Block 32, Shelby County
School Land Survey.
THENCE continuing south, along and with the east line of Tract 32-D, 203.88
feet to a point for its southeast corner in the north right-of-way line of
Everman-Kennedale Road (County Road No. 1051 ).
THENCE continuing south 50 feet to a point for corner in the south right-
of-way line of Everman-Kennedale Road.
THENCE west, along and with the south right-of-way line of Everman-Kenne-
dale Road 255 feet to a point for corner.
THENCE north 50 feet to a point for the southwest corner of Tract 32-A,
(City Tax Records) Block 32, Shelby County School Land Survey, in the east
right-of-way line of Southway Drive.
THENCE continuing north, along and with the west line of Tracts 32-A and
32-A-1 and along and with the west line of Lot 3, Block 5, Columbine Park
Addition and along and with the east right-of-way line of Southway Drive
370 feet to a point for the northwest corner of Lot 3, Block 5, Columbine
Park Addition.
THENCE east, along and with the north line of Lot 3, Block 5, Columbine
Park Addition 254.4 feet to the place of beginning and containing approxi-
mately 2.447 acres of land of which 0.292 acres is in Everman-Kennedale
Road.
SECTION II
THAT the City of F®rt Worth hereby relinquishes all extraterritorial jurisdic-
tional authority over the hereinabove described territory pursuant to the pro-
visions of the Municipal Annexation Act (Article 970a, Revised Civil Statutes of
Texas as amended); ano consent is hereby given to the City of Everman, Texas to
annex the hereinabove described territory.
SECTION III
THAT this ordinance shall and does hereby amend every prior ordinance in direct
conflict herewith, but as to all other ordinances or sections of ordinances not
in direct conflict herewith, this ordinance shall be and the same is hereby made
cumulative.
SECTION IV
THAT if any section, subsection, clause, sentence, phrase, or word of this ordi-
nance is for any reason held void or unconstitutional, by a court of competent
jurisdiction, such invalidity shall not affect the validity of the remaining
sections, subsections, clauses, sentences, phrases or words except as the same
are inseparable from and indispensable to the remaining portions of the ordi-
nance.
SECTION V
THAT this ordinance shall become effective and shall be in full force and effect
from and after its passage and it is so ordained.

A RESOLUTION
WHEREAS, two property owners adjacent to the City
of Everman, Mr. Andy Booth and Mr. A. E. Thomas, have
petitioned the City of Everman to come into Everman' s
city limits; and
WHEREAS, these two property owners are currently
in the city limits of the City of Fort Worth; and
WHEREAS, the City of Fort Worth finds it burden-
some to furnish services to these property owners;
NOW, THEREFORE, the City of Everman pledges to
furnish services, such as water, sewer, garbage, Police
and Fire protection if the City of Fort Worth will de-
annex the property described in the attached petitions.

Mr. Andy J. Booth and Mr. A. E. Thomas, owners of four lots in the Fort Worth
city limits adjacent to Everman have petitioned to be annexed by Everman. This
project was initially started by the request of Mr. Booth who has constructed
a residence on one of the lots. The property is furnished water, sanitary
sewer and garbage services by the City of Everman.
Because consideration of only the one lot would have made a very awkward
city limit line adjustment, three additional lots were added to the study
to square up the area as shown on the attached map. The two owners of the
four lots feel they are more properly a part of the Everman urban area and
have petitioned to be annexed by Everman. Everman has adopted a Resolution,
a copy of which is attached, pledging to furnish municipal services to the
four lots if they are de-annexed from Fort Worth.
City operating departments have not stated any objection to these lots being
de-annexed from Fort Worth because Everman is in a better position to furnish
same services at the present time.
The Fort Worth Plan Commission has recommended that the four lots as shown
on the attached map be de-annexed from Fort Worth contingent on Everman
agreement to provide services and consent of the landowners.
The Everman agreement to provide services is evidenced by the adopted
Resolution and all four lots are represented by the owner's petition for
annexation to Everman.
An ordinance providing for de-annexation of the four lots from Fort Worth
will be available for Council consideration at its regular meeting.
Recommendation
It is recommended that the Council adopt the Ordinance de-annexing four
lots from Fort Worth as shown on the attached map.
