AN ORDINANCE CLOSING AND VACATING THE TEN FOOT STORM DRAIN EASEMENT EXTENDING ACROSS LOT 3, BLOCK 1, MIDTOWN CHURCH OF CHRIST ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, FROM HIGHWAY I-35-W TO OAKHURST SCENIC DRIVE; AND PROVIDING FOR THE REVERSION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LAND. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the following described storm drain easement be and the same is hereby extinguished, vacated, closed and perm- anently abandoned as an easement: An easement 10 feet in width and 250 feet in length crossing Lot 3, Block 1, Midtown Church of Christ Addition, as shown on plat recorded in Vol. 388-91, page 3, of the Tarrant County Plat Records, and being more particularly described as follows: Being 5 feet on either side of the center- line which begins at a point in the west line of said Lot 3 at a distance of 328 feet south, 1 de- gree 23 minutes 20 seconds east from the northwest corner of said Lot 3 and being in the easterly right of way line of Interstate Highway 35-W and thence Buns northeasterly across said Lot 3 to a point in the east line of said lot a dis- tance of 135-2/10 feet southeasterly from the northeast corner of said Lot 3. SECTION 2. That the interest of the City of Fort Worth in the fee to the land in said easement above described is hereby re- leased and shall revert to the adjacent owner of the fee as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. Christ Addition, has requested that the City vacate an easement 10' in width and 250' in length crossing Lot 3, Block 1, Midtown Church of Christ Addition from HighwiLy I-35-W to Oakhurst Scenic Drive, as shown on the attached map. The subject easement, acquired by dedication, is unused and contains no improvements. City departments and private utility companies have reviewed this re- quest and have no objections provided the vacated easement is replatted with abutting properties, and a 15' drainage easement, centered on the relocated swale, is dedicated when the property is replatted. A satis- factory replat has been submitted to the City staff. The City Plan Commission has reviewed this request and recommends that an ordinance be adopted vacating subject easement as requested. Recommendation: It is recommended that an ordinance be adopted vacating subject easement as recommended by the City Plan Commission.
