HomeMy WebLinkAboutOrdinance 1994 ORDINANCE NO. AN ORDINANCE REPEALING ORDINANCE N0. 1577 AND AMENDING SECTION 31-1 OF BUILDING CODE ORDINANCE NO. 1389, PERTAINING TO THE WRECKING OF BUILD- INGS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH: SECTION I That Ordinance No. 1577 be repealed and that Section 31-1 of Chapter 31, Building Code Ordinance No. 1389 of the City of Fort Worth shall hereinafter read as follows: Chapter 31 Section 31-1 GENERAL PROVISIONS Paragraph 31-1-1. Permits and Fees. A special permit shall be required for the wreck- ing of any building within the City Limits of the City of Fort Worth. The permit fee for same shall be Two Dollars ($2.00) for the first 2,500 square feet of floor area or fraction thereof, and fifty cents ($0.50) for each addi- tional 1,000 square feet of floor area or fraction thereof. Exception: No permit fee shall be required for the wrecking of buildings outside the limits of Fire Zones Number One and Number Two as defined by the Building Code, or for the wrecking or razing of buildings which have been found to be unsafe and the removal of which have been requested by the Building Commissioner in writing. Paragraph 31-1-2. Where buildings to be wrecked are adjacent to streets or public places then the sidewalks in front of same shall be protected by covered passageways. Such passageways shall be constructed at least 4 feet in width and 8 feet in height and shall be covered with solid plank. Passageways shall be kept well lighted and in good state of repair. No wrecked material shall be placed upon the floor of any building in the course of demolition which, will cause overloading of said floors, but the materials shall be lowered to the ground immediately upon displace- ment. Blasting, pulling, or throwing of masonry walls will not be permitted except in emergencies and then the work shall be done under special permit and under the direct supervision of the Building Commissioner. No materials shall be thrown from building to the sidewalks or pavement but shall be conveyed to the ground by properly constructed chutes. All dusty and loose materials shall be thoroughly wetted before demolition and shall be kept wetted until removed from the premises. Paragraph 31-1-3. The Building Commissioner shall have the right to stop the wrecking or tearing down of any building or structure within the City when the same is being done in a reckless or careless manner, or in violation of any ordinance, or in such a manner as to endanger life or property, to order any and all persons engaged in said work to stop and desist therefrom. When such work has been ordered stopped by the Building Commissioner, it shall not be resumed until said Commissioner is satisfied that adequate precautions have been or will be taken for protection of life or property; otherwise to continue the work will constitute a violation of this ordinance and persons doing such work shall upon conviction in the Corporation Court be fined in any sum not exceeding Two Hundred ($200.00) Dollars for every day that such work is in progress. SECTION II That all Ordinances and parts of Ordinances heretofore passed by the City Council of the City of Fort Worth that are in conflict with the foregoing provisions of this Ordinance shall be void and of no further force and effect.
