HomeMy WebLinkAboutOrdinance 594 ORDINANCE No J`!9 AN ORDINANCE granting to the Northern Texas Traction Company, a corporation, and its sucoessors and assigns, the right, privilege and franchise to construct, equip, maintain and operate by electricity or some motive power other than steam, a line of street railway over and upon certain streets in the City of Fort Worth, and to erect and maintain poled and overhead trolley and other necessary wires thereon BE IT ORDAINED BY THE BOARD OF COMUSSIONERS OF THE CITY OF FORT WORTH: Section 1: That in consideration of the stipulations and agreements hereinafter contain&, to be kept and performed by the Northern Texas Traction Company, its assigns and successors, the City of Fort Worth, a municipal corporation, has given and granted, and does hereby give and grant unto the said Northern Texas Traction Company, a corporation domiciled in Fort Worth, Tarrant County, Texas, and its sucoessors and assigns, the right, license and franchise to construct, equip, maintain and operate a line of single or double track street railway for the carriage of passengers and freight, together with all necessary turnouts, Y's, frogs, and connections to present existing tracks at or near that portion of the street hereinafter designate&, and all poles, wires and other fixtures, appurtenances or appointments requisite, convenient or necessary for the construction, operation and main- tenance of a line of street railway on and over the following streets in the City of Fort Worth, as an extension of and conned z tion with the present line of street railway owned and operated by said grantee, Northern Texas Traction Company, on and over certain portions of Commerce Street in• said City, to-wit; Beginning at a point of connection with the present line of street railway and tracks of the Northern Texas Traction Company at the intersection of Eighth Street and Commerce Street in the City of Fort Worth; thence northward and over said Commerce Street to a point of connection with its present line of tracks at the intersection of Seventh and commerce Streets. This franchise and grant of the right to extend said line of street railway over the street just above mentioned is to be subject to and run concurrent With the original franchise heretofore granted by the City of Fort Worth to the Northern Texas Traction Company and its assigns or successors, to maintain and operate its said line of street railway tracks over certain portions of dommerce Street in said city. Section 2; All tracks laid under the provisions of this ordinance, except the turnouts and connections to and with present existing lines and tracks at the intersection of said Seventh and Commerce Streets and Eighth and Commerce Streets in said City, shall be laid and kept as nearly as practical in the middle of the streets whereon said track is to be laid and said connections made with existing lines of track as aforesaid, 3 and the top of each rail of each and every part of said track and the spaces between the rails shall be kept level with the streets alongside; and the tracks, wires,poles and all other equipment shall be all of standard quality and so constrizoted and maintained that travel on said street shall not be anaeo• essartly obstructed or endangered at any place; and all matters of constriction and maintenance shall be subject to the approval of the city engineer and the city electrician and the Board of - City Commissioners; all tracks on said street or portions r thereof that are now or shall hereafter be paved shall be of first-class rails of such kind as shall be designated by the City Engineer and shall be laid in such manner as to make the least possible obstruction to vehicles and shall be maintained in that condition. Section 3; Said Northern Texas Traction Company, or its assigns, shall at its or their cost and expense pave and repave or otherwise surface and re-surface and keep constantly in good order and condition with the same material with which the street on the outside is paved and surfaced, all that part of each street or streets occupied by it or that which lies between the rails of said tracks and for eighteen inches on each side thereof as .may be laid under this franchise, and said Northern Texas Traction Company, or its assigns and successors shall conform its or their tracks or any part thereof to the proper grade of each street, and change the lever of said tracks as often and whenever the grade of 4 ' any such street is changed, so that every part of each track shall always be kept at the duly established grade line, or as near there- to, as the surface of the grade of the street outside thereof will permit, Section 4; Said Northern Texas Traction Company, its sac• cessors and assigns, do hereby agree to indemnify and hold the City of port Worth harmless because of, and promptly to pay off and discharge,or repay to the said City, all damages, claims, judgments, attorneys fees and other costs and expenses rendered against , or incurred, or paid out by the said City of port Worth by reason of injuries either to persons or property occasioned as the proximate result of anything done or permitted or in any way proximately arising oat of the construction, operation or maintenM ante upon the above streets and thoroughfares, tracks, poles and wires of said company. City Section 5; The/Bngineer shall direct and point out the places at which poles erected under this ordinance shall be set, provided always that no poles shall be set in violation of any City ordinance. Section 6. All the limitations, provisions and conditions contained in the ordinance or ordinances referred to granting the franchise on Commerce Street, shall continue in force and shall govern and control in addition to the provisions of this ordinance the ope-•ation and construction of the contemplated extension of the pr_ sent line as hereby granted, r 8 Section 7, This ordinance shall take effect and- be in force from and after its passage. I hereby certify that the above and foregoing ordinance was duly presented and unanimously passed and adopted by the board of commissioners of the city of Fort Wort,_ Texas, at a regular meeting of said board held Tuesday, 1917.
