HomeMy WebLinkAboutOrdinance 494 %,wow ORDINANCE NO. _-�' • AN ORDINANCE REGV7*)IING THE STORAGE AND HANDLING OF GASOLENE OR OTHER VOLATILES, WITHIN THE CITY OF F,9RT WORTH AND e G�x PROVIDING PENAIaTIESl/"�— BE IT ORDAINED BY THE BOARD OF COMISSIONERS OF THE CITY OF FORT WORTH: Section 1. It shall be unlawful for any person, firm or corporation to keep, store or handle gasolene or other volatiles except upon compliance by the said person, firm, association or corporation, with the following provisions of this ordinance. Section. 2. A permit to store and handle gasolene or other volatiles may be issued by the Chief of the Fire Department of the City Fire Marshall upon a written application giving in detail the following information; (a) Name and address of the applicant; (b) Location of peemises; (c) Nature of construction of the building, and other purposes, if any, for which the building is used; (d) Description and maximum quantity of volatile inflammable oil to be stored. Section 3. Each application for a permit to store and handle gasolene or other volatiles shall be accompanied with a detail plan of the premises. Section 4. (a)A11 tanks shall be installed outside of the building under ground, and not less than two feet below the surface entire- ly surrounded by earth well tampped in place, bottom of tank to set on not less than six inches of concrete, and the top of the tank must be below the level of the lwwest pipe line in the building used in connection with the equipment. (b) If impracticable to locate storage tanks outside of buildings they may be buried two feet below the level of the basement floor imbedded in the earth, and covered by at least two feet of earth and concrete. (c) All tanks of 560 gallons capacity shall be made of at least twelve (12) gauge galvanized steel or J inch black open hearth tank steel. All tanks of 275 gallons capacity shall be made of at least fourteen (14) gauge galvanized steel or 3/16 inch black open hearth tank steel. All tanks of 120 gallons capacity shall be made of at least sixteen (16) gauge galvanized steel or 3/18 inch black open hearth tank steel. at All tanks mace of galvanized steel must be carefully rivited and soldered and coated on the outside with tar or other rust resisting material. All tanks made of bl-cIz steel must be carefully rivited and caulked and coated on the outside with tar or other rust resisting material. No tanks shall have openings or pipe connections except on the top thereof and shall be properly vented and shall not be connected either directly or indirectly with any public or private sewer drain, Catch-basin or pit. (d) Filler pies must be made of galvanized iron pipe two inches or more in diameter, entering at the top of the tank and extending to the bottom of the same. The upper end of said filler pipe must terminate in a screw cap securely locked. Where tanks are located undef the building the filler pipe Faust run to the outside of the building on a gradient and terminate in a screw cap; same to be secure- ly looked.Where filler runs to the sidewalk or to an alley or public way, it must terminate in a screw cap securely locked and protected by a cast iron filler box, the same to flush with the sidewalk, alley or public way. The cover of the said filler box to be securely locked. (e) The vent pipe shall be at least one inch in diameter, shall run from the tank to the open air at least four feet above the roof of the building in which or in front of which gasolene is stored, and shall be at least ten feet from the nearest wall of any adjoining building, and well braced in position and shall be provided with a double gooseneck spark protector, both openings of which must be covered with a brass wire screen of at least thirty mesh. (f) Pipe connecting the tank with the pump lust be of galvanized iron and must enter top of tank. Said pipe must be buried at least eighteen inches below the surface and any exposed portion there- of must be thoroughly and properly protected. This connection pipe mustnbe lower at any point than where same leaves the tank. Section 5. All gasolene must be drawn from tank by means of an improved suction pump or pumps which shall have a shutoff valve with ground key on the nozzle, and an automatice dheckvalve between the pump and the nozzle. In no case shall there be a return of waste pipe to the tank. Section 6, where gasolene or other volatiles are stored or handled the lighting shall be done by incandescent electrio lights, with all electric switches and cutoffs permakently located at least twelve inches above the floor. Section 7.No gasolene or other volatiles shall be kept in any building except when stored or handled in self-closing safety con- tainers or in portable filling tanks. (b) When self-closing safety containers are used for the storing or handling of gasolene, or other volatiles, not more than Five (5) gallons of gasolene or other volatiles shall be kept in any building, and the self-closing containers must be made of metal and must be of approved construction, and must be of a capacity not to exceed five gallons. (c) when filling tanks are used for the storing or handl- ing of gasolene or other volatiles, the containers must be of a Go capacity not to exceed fMW gallons and must be of at least 3/16 inch steel, and must be of approved construction. The said 1portable tank shall be supported on all steal wheels, not less than thirty inches in diameter,the wheels being equipped with rubber tires, The tank must be provided with an approved all metal suction pump., the same to be provided with a hose atta#ohment. The hose must not exceed eight feet in length. The pump must be equipped with an improved ground key shut-off cock where hose is attached to pump, also with improved ground key shut-off cock at end of hose. Pump must be equipped with a lock, and the same kept locked when not in use. Section 8. There shall be kept at all times receptacles filled with sand to be used in absorbing waste oil and in addition to this there shall be kept in a convenient place a hand-scoop to be used for fire extinguishing purposes only. Section 9. Dry cleaning and dry dyeing establishment. It shall be unlawful for any person, firm or corporation to maintain or operate a dry cleaning or dry dyeing establishment within the City of Fort Worth, without a permit from the Chief of the Fire Department or the Fird Marshal. Section 10. A permit to maintain and operate a dry cleaning and dry dyeing establishment may be issued by the Chief of the Fire Departmet or Fire Marshal upon a written application giving in detail the following information; (a) Name and address of the applicant; (b) Location of premises; (a) Nature of construction of the building, and other purposes, if any, for which the building is used; (d) Descrittion and maximum quantity of inflammable volatiles to be stored. Section. 11. Each application for a permit to maintain and operate a dry cleaning or dry dyeing establishment shall be accompanied with a detail plan of the premises. Section 12. No permit to maintain and operate a dry cleaning or dry dyeing establishment shall be issued for any building- (a) In which the compartment wherein the volatile in- flammable oil is used is situated within fifty feet of the nearest wall of ZWbuilding occupied aS a school, hospital, theatre, or other places of public amusement or assembly; (b) Which is occupied as a tenement house or hotel; (o) Which is of wooden construction; (d) In which the comparttm ent wherein the volatile in- flammable oil is used is artifically lighted by any means other than electricity; (e) Where drugs, cigars, cigarettes or tobaccos are kept for sale; (f) Where paints, varnished or lacquers and manufactured, stored, or keptfor sale. (g) Where matches, rosin, turpentine, hemp, cotton, or any explosives are stored or kept. #5. 4 Section 13. The operation of a dry cleaning or dry dyeing estab- lishment shall be continously under the care and supervision of a competent person. Section 14. No permit to maintain and operate dry cleaning or dry dyeing establishments shall be issued for any premises Which are not equipped with an approved storage system for storing and handling all volatile inflammable oil and liquids stored or used in such establish- ments. Section 15. No system for the storage of volatile inflammable oils shall be installed in any building used as a dry cleaning or dry dyeing establishment, unless it be for which a certificate of approval shall have been issued by the Chief of the Fire Department or Fire Marshal. / Section 16. Each storage tank shall be coated on the outside with tax or other rust-resisting ma.teri4, shall rest upon a solid foundation and shall be embedded in and surrounded by at least eight inches portland cement cooncrets, composed of two parts cement, three pasts sand and five parts crushed stone or washed gravel. Section 17. Each storage tank shall be so set that the top, or highest point thereof, shall be at least two feet below the level of the lowest cellar floor of any bmilding within a radius of ten feet from the tank. Section 18. Each storage tank shall be equipped with a filling pipe, a drawing-off pipe, and a vent pipe; provided, however, that no storage tank installed as part of nhydraulic or pressure storage system shall be required to have a vent pipe. Section 19. The filling pipe shall be at least two inches in diameter, and shall be layed at a descending grade from filler pipe outside of the building to the tank. Section 20. The intake of the filling pipe whall be located in a heavy metal box, which shall be sunk flush with the outside surface 1 f 7 � level, and fitted with a heavy metal cover which shall be kept locked when the filling pipe .is not in use. Section 21. The filling pipe shall be closed at the intake by a cock or valve fitted with a coupling for attaching to the hose of a barrel wagon, and with a screw cap to close the opening when not in use. Section 22. Each filling pipe shall be provided with a screen made of two thicknesses of twenty-mesh brass wire gauze, placed gust below the filling cock or valve. S ection 23. The vent pipe shall be at least one inch in diameter and shall run from the tank to the outer air at least four foot above-- the roof of the building, and at least ten feet from the nearest wall of any other building and shall be well braced in position. Section 24. The vent pipe shall be capped with a double goose- neck hood or oowl, 'and provided with a screen made of one thickness twenty mesh wire gauze. Section 25. Each room or compartment wherein a "wasting tank" is located shall be equipped with an approved steam fire extinguish- ing system, the supply valve for which shall be placed on the out- side of the w.59hing room with one valve so arranged that the steam can be easily turned on. Section 26. Each room or compartment wherein a "washing tank" is located shall be properly ventilated, and shall be equipped with fire proof doors and windows that can be easily opened from the out- side. Section 27. At the close of each day, all volatile inflammable oils remaining in the "washing tanks" shall be transfered through eontinous piping to a settling tank; and each settling tank shall be installed and equipped in the same manner as prescribed in this � V_�_ ar for a storage tank. Section 28. All volatiles inflammable oils which has been used in the process of dry cleaning or dry dyeing shall be settled, filtered a or distilled in a machine or appartus of a type approved by the Chief of the Fire Department or the Fire ]Marshal. Section 29. It shall be unlawful for any person firm or cor- poration to discharge any volatile inflammable oil into a public drain or surer. Section 30. No system of artificta.l lighting other than incandes- cent electric lights shall be installed in any room or compartment wherein volatiles inflammable oil is stored or used. All incandescent lights shall be fitted with keyless sockets, and all electric switches and plugs shall be placed at four feet above the floor. Section 31. No stove, forge, torch, boiler, furnace, flame or fire, and no electric or other appliance that is likely to produce an exposed sparks, shall be installed in any room or compartment in VIA-?--LZ4- f which�i4ifJA ,e oil%is stored or used. Section 32. Each premises in which dry cleaning or dry dyeing establishment is located shall be equipped with fire buckets filled with sand for use in extinguishing fire. The number of buckets of sand to be kept for such use to be stated in the permit. Section T83. Sponging. A permit to conduct the business of sponging may be issued by the Chief of the Fire Department or the Fire Ms.rshal upon a written application giving in detail the following information; (a) Name and address off the applicant; (b) Location of premises; (c) Nature of construction of building; (d) Nature of the business in Which the applicant is engaged in such building. Section 34. The holder of a permit to maintain and operate a dry cleaning or dry dyeing establishment shall not be required to obtain a permit to conduct the business of sponging. Section 35. Not more than two gallons of volatile inflamable oil may be stored or kept in any premises covered by a permit for sponging, and must be kept in an approved can or container. Section 36. Section 36 It shall be unlawful for any person to conduct sponging operations within tan feet of a fire or open flame. section 37. It shall be unlawful for any person to smoke or to carry a lighted cigar, cigarette or pipe into any room or compartment in which volatile inflammable oil is stored or used. Sectionz��ttll5�. It shall be unlawful for any, person, firm„ corporation, or association in charge of any compartment or room in which any gasolene or other volatile inflammable Oil is kept, stored or used, to permit any person to smo4e or to carry a lighted cigar, cigarette or pipe into any such room or compartment; and a notice bearingf in letters not less than 14 inches in height the words) "SMOKING UNLAWFUL" shall be conspicuously posted in any such room or compartment. Section3� Unless otherwise herein especially provided, all words, terms and phrases of a more or less technical meaning shell be given that which is consistent with the ordinary 4Ccept- ation of the term or terms as commonly used. In so far as the purpose of this ordinance is concerned, however, the following definitions shall be applied to the foliowing words, terms and phrases; (a) A PERMIT is the written authority of the Chief of The Fire Department or of the Fire Marshal, issued pursuant to these regulations. (b) A SPECIAL YMMIT is the written authority of the Chief of the Fire Department or of the Fire Marshal (1) to conduct a given business occupation, trade or industry in a manner not specifically provided for in these regulations when the circumstances and 9 conditions surrounding such business, trade or industry make it impracticable to comply with the general regulations otherwise appli- cable thereto; or (2) to store, keep, transport, sell or use a given article or think in excess of the quantity specified in these re- guln,tions. The term "Special Permit" shall also include certificates of fitness and certificates of approval. Such permits may be issued by the Chief of the Fire Department or by the Fire Marshall only upon the approval of the Board of City Commissioners. u (c) A CERTIFICATE OF APPROVAL is a written statement issued b.* the Chief of the Fire Department or by the Fire Marshal, certifying that the type, class or kind of article or thing mention- e#herein has been examined and approved by the said Chief of the Fire Department or by the Fire Marshal in conformity with these re- gulations, and that it is authorized to be stored, transported, sold or used in The City of Fart Worth. (d) By the term VOLATILE INFLAMMABLE OIL is meant any, oil or liquid that will generate an inflammable vapor at a temperture below 100 degrees Fahrenheit when tested either in the open air or in the closed pyrometer of Giuseppe Tagliabue. (e) By the team DRY CLEANING or DRY DYEING is meant the act or process of washing or immersing in vahtile inflammable oil or liquid a garment, fabric, fiber, substance or article, for ghe purpose of cleaning or dyeing the same. (f) By the term SPONGING "is meant the act or process of applying volatile inflammable oil or liquid to a garment, fabric, fiber or article, for the purpose of removing spots or stains there- from. (g) The term,, Chief of the Fire Department or Fire Marshal" shall include any officer, member off' inspector of the Fire Department specially deputized by the Chief of the Fire Department of Fire Mar- shallto act for him. Section 46. The Board of Commissioners shall have the power OL by resolution to fix a fee for the issuance of a permit, special permit or certificate of approval as required by the provisions of this Ordinance; provided, however, that no fee shall be charged in any one case in excess of $1.00. Section 41. AZy person, firm, corporation or association violating any :ofD the provisions of this ordinance shall be guilty of a misdemeanor, and upon confiction thereof, shall be fined in any sum not less than $5.00 nor more than $200.00. Section 4�_ All ordinances and parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 43. Any provisiong. section4 or part of a section of this ordinance which may be declared invalid shall not have the effect of impairing the force of other provisions hereof. Section 4 The object, purpose and end of this ordi- nance is hereby declared to be the prevention of firee and designed to protebt the life and property, and. the passage of same is hereby declared to be imperatively necessary for a the immediate preservation of the public e, hel th and safety of the lives and property of the citizens of the City of Fort Worth, and shall be in force and in effect from and after its passage and five days publication as required by law.
