AN ORDINANCE APPROVING THE REPORT OF THE PUBLIC WORKS DEPARTMENT, AWARDING THE CONTRACT FOR THE DMVEMENT OF A PORTION OF BEACH STREET EXTENSION IN THE CITY OF FORT MORTH, TEXAS, AND AUTHORIZING ITS EXECUTION: HARING APPROPRIATION FOR THE INDEBTEDNESS INCtRRED THEREBY: Aim DIRECTING THE CITY ENGINEER TO PREPARE ESTIMATES. WMMS, on the 28th day of September, 1955, by Ordinance passed and approved by the City Council of the City of Fort Worth, being Ordinance No. 3388, the City determined the necessity for and ordered the improvement of a portion of Beach Street Extension, to-wit: BEACH STREET EXTENSION: From the southeasterly line of Belknap Street to the southerly line of Galves Avenue, known and designated as Unit No. 1. WHEREAS, subsequent to the passage and approval of said ordins e, plans and specifications for said improvements were submitted by the Public Works Director and said plans and specifications were approved and adopted by the City Council; and, WH RFAS, notice to bidders was given as required by the City Charter; and, WHEREAS, the bid of Texas Bitulithic Company, was found to be the lowest and best bid for the making and construction of said improvements, to-gait: Excavation of present street and placing lop compacted flexible base course with combined curb and gutter and necessary appurtenances, and placing lip Hot Mix Asphaltic Concrete Surface on 31m Hot Mix Asphaltic Concrete Binder, all as provided by said plans and specifications: Now, ARE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the work of making and constructing such improvements and contract therefor is hereby awarded to Texas Bitul.ithie Company, at and for the prices stated in the proposal of the said company and as reported and recommended by the Public Works Department. The Mayor and City Secretary are hereby directed to execute the said contract in the name of the City of Fort Worth, Texas, and to impress the corporate seal of the City thereon, the said Contract embracing tberein, among other things, the prices for the work. SECTION 2. That to provide for the payment of the indebtedness incurred by the City of Fort Worth by said Contract, there is hereby appropriated out of available funds which have been set aside for said purpose, an amount sufficient to pay said indebtedness so incurred. SECTION 3. That the Public Works Director of the City of Fort Worth be and he is hereby ordered and directed to file with the City Council estimates of the cost of such improvements in accordance with the terms of the powers and provisions of Chapter 106 of the acts of the First called session of the Fortieth Legislature of the State of Texas, now shown as Article 1105b of Vernon's Civil Statutes of the State of Texas, Annotated, which law has been adopted as an amendment to and made a part of the Charter of the City of Fort Worth.
