HomeMy WebLinkAboutOrdinance 2894 ORDINANCE NO. ,2 9 AN ORDINANCE PROVIDING FUR THE SUBMISSION TO THE QUALIFIED ELECTORS WHO OWN TAXABLE PROPERTY IN THE CITY OF FORT WORTH, TEXAS, AND WHO HAVE DULY RENDERED THE SAME FOR TAXATION A PROPOSITION FOR THE REVOCATION OF THE AUTHORITY TO ISSUE SIX HUNDRED THOUSAND DOLLARS (W,000.00) IN BONDS, BEING THE REMAINING AND UNISSUED PORTION OF AN AUTHORIZED ISSUE OF ONE MILLION, FOUR HUNDRED THOUSAND DOLLARS (31,400,000.00) IN MAIN ARTERIAL THOROUGHFARE BONDS; AND CALLING A SPECIAL ELECTION FOR THE PURPOSE, TO BE HELD IN THE CITY OF FORT WORTH, TEXAS, ON TUESDAY, THE 11TH DAY OF SEPTEICER, A. D. 1951. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That a special election be held in the City of Fort Worth, Texas, on Tuesday, the llth day of September, A. D. 1951, at the polling places hereinafter described, between the hours of seven o'clock A. M. and seven o'clock P. M., at which election the following proposition shall be submitted to the qualified electors who own taxable property in said City and who have duly rendered the same for taxation: Shall the City Council of the City of Fort Worth be empowered to cancel and revoke the authority to issue Six Hundred Thousand Dollars (W,000.00) in Main Arterial Thoroughfare Bonds, being the remaining and unissued portion of an issue of One Million, Four Hundred Thousand Dollars (31,400,000.00) authorized at an election duly held the 24th day of November, 19.25, and which proposition then read as follows: °Shall the City of Fort Worth, through its City Council, issue its negotiable coupon bonds, running from five (5) to forty (40) years, in the principal sum of One Million, Four Hundred Thousand (81,400,000.00) Dollars, for the purpose of constructing, improving and extending its system of streets and thoroughfares by constructing, improving and extending a new main ar- terial street and thoroughfare running north and south and a new main arterial street and thoroughfare extend- ing east and west through said City, including in such permanent improvements grade separation, bridges, drain- age and the purchase of right of way, the first of said bonds being payable at the expiration of five (5) years from the date thereof, and serially thereafter as may be determined by the said City Council, so that the last maturing bonds shall become payable within forty (40) years from the date thereof, bearing interest at a rate not to exceed five per cent (5%) per annum from the date thereof, payable semi-annually, and levy a suf- ficient tax to pay the interest on said bonds and create a sinking fund sufficient to redeem said bonds at the maturity thereof?"? SECTION 2. Parker 12 31-E Handley SECTION 3• Said election shall be held under the provisions of the Charter of the City of Fort Worth, Texas, and the Constitution and laws of said State insofar as same may be applicable, and qualified voters who own taxable property in said City and who have duly rendered the same for taxation shall be allowed to vote upon said proposition, and all electors shall vote in the election precinct of their residence. SECTION 4. All voters who favor the proposition to cancel and revoke the authority to issue Six Hundred Thousand Dollars ($600,000.00) in Main Arterial Thoroughfare Bonds, being the remaining and unissued portion of the original issue of One Million, Four Hundred Thousand Dollars ($1,400,000.00), shall have written or printed upon their ballots the words, "FUR the revocation of bonds," and those opposed shall have written or printed upon their ballots the words, "AGAINST the revocation of bonds." SECTION 5. The way and manner of holding this election, the notice to be given therefor, the polling places, the personnel of the officers who are to hold the same, and all details connected with the holding of the elec- tion shall be determined and arranged by the City Council, and proper notice of such matters shall be given in a proclamation by the Mayor, provided that such notice and proclamation shall only be cumulative of and in addition to the statutory notice of such election as herein pro- vided, and an omission or irregularity in the publication of such proc- lamation, or in the signing of the same, shall not in any way affect or invalidate such election. SECTION 6, The City Secretary is hereby ordered and directed to prepare bal- lots and stamp same "Official Ballot," on which ballots shall be printed the proposition as set forth above. SECTION 7. That the City Secretary shall furnish election officials said bal- lots, together with any other forms or blanks, in accordance with the Charter of the City of Fort Worth, Texas, and the laws of the State of Texas insofar as same are applicable. SECTION 8. This ordinance shall constitute the election order for such special election, a substantial copy of which shall serve as the notice of the election. SECTION 9, The City Secretary is hereby authorized and directed to cause notice of said election to be given by posting a substantial copy of the election order in each of the election precincts of said City, and also at the City Hall. The notice of said election shall also be pub- lished on the same day in each of two successive weeks in a newspaper of general circulation published within said City, the date of the first publication to be not less than fourteen (14) days prior to the date set for said election, and the City Secretary shall see that proper pub- lication is made and proper notice of this election is given, in full conformity with the Charter of the City of Fort Worth, Texas, and the general laws of the State of Texas applicable thereto. SECTION 10. This ordinance shall take effect and be in full force and effect from and after the date of its passage and it is so ordained.
