ORDINANCE NO. }3 OFFICIAL RECORD ORDINACH STREETNCE EXTENSION�AND PUBLICPLAACESTS NIN THETION OF CIITY OF FORT CITY SECRETARY WORTH, TEXAS, DECLARING THE CONTRACT WITH TEXAS BIUTLITHIC FT. WORTH, T . COMPANY FOR THE CONSTRUCTION OF SAID DIPROVE4MTS FULLY COMPLETED AND PERFORMED, DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS, AND DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE OCMPLETE ORDINANCE IN THE APPROPRIATE ORDINANCE RECORDS OF THE CITY. WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract with Texas Bitulithic Company for the making and construction of certain improvements on the hereinafter described portions of streets, avenues and public places in said City, to wit: BEACH STREET EXTENSION (A PART OF WHICH IS ALSO PRESENTLY KNOWN AS HAWKINS STREET): From the northeasterly line of Mitchell Boulevard northerly across Lot 13, Block 61, to Avenue I; thence northerly across Avenue I and continuing northerly along the street presently known as Hawkins Street to the northerly line of East Rosedale, known and designated as Unit No. 2; BEACH STREET EXTENSION (PRESENTLY KNOWN AS HAWKINS STREET:) From the northerly line of East Rosedale to the northerly line of East Vickery Boulevard, known and designated as Unit No. 3; BEACH STREET EXTENSION (PRESENTLY KNOWN AS HAWKINS STREET:) From the northerly line of East Vickery Boulevard to the northerly line of Camilla Avenue, known and designated as Unit No. 4. and, WHEREAS, by sundry proceedings heretofore passed by the City Council of the City of Fort Worth, Texas, including Ordinance No. 3991, a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 4181; and, WHEREAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby accepted; and the —1— contract with reference thereto be, and it is hereby, found and declared fully completed and performed, The Layer be, and he is hereby, dirocned to issue and execute in the na.e of the City, certificates in evidence of the special assessments levied against abuttinZ property and the owners theredf for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of she City, all in accoruance with the proceedinZs relating to such improvenents and assessments. The certificates shall be numbered, shall describe We property against which the assez6went has been levied, shall, where known, state the name or -names of true owners of the respective parcels of property assessed and shall be issued in an amount equal to she difference between the principal amount of the assessment and the amounts of any credit issued thereon. fhe numbers of the certificates, with the property descriptions to be shown on the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any, which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: III. The contractor has completed the construction in accordance with the plans and specifications at a final contract'�cost of $335,352.38 with the property owners portion being $35,522.04 and the City's portion being $299,830.34.
