WHEREAS, the City of Fort Worth (CITY) and Dunaway Associates, L.P. ,
(ENGINEER) made and entered into City Secretary Contract No. 36513, (the
CONTRACT) which was authorized by the City Council by M&C C-22600 on the
8th day of January, 2008 in the amount of $726,110 .00; and subsequently
revised by Amendment Number 1 which was administratively authorized by
the City on the 19th day of March, 2009 in the amount of $7, 757. 00;and
subsequently revised by Amendment Number 2 which was authorized by the
City Council on the 9th day of March, 2010 (M&C C-24123) in the amount of
$110,428. 00;
WHEREAS, the Contract involves engineering services for the following
project:
East First Street from Beach Street to Oakland Boulevard;
WHEREAS, it has become necessary to execute Amendment No. 3 to said
Contract to include an increased scope of work and revised maximum fee;
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement,
which amends the Contract:

Article I of the Contract is amended to include the additional
engineering services specified in the proposal letter dated August 18,
2011, copies of which are attached hereto and incorporated herein. The
cost to City for the additional design services to be performed by
Engineer total $25,524 .00.
2 .
Article II of the Contract is amended to provide for an increase in
the maximum fee to be paid to Engineer for all work and services
performed under the Contract, as amended, so that the total fee paid by
the City for all work and services shall not exceed the sum of
$869,819.00 .

All other provisions of the Contract, which are not expressly amended
herein, shall remain in full force and effect.

Mr. Weiss:
This letter constitutes our request for supplemental authorization for tasks outside the scope of
services of our current contract. The additional work includes the following tasks (see attached Level
of Effort Spreadsheet):
7.0 ROW/Easement Services
7.2 ROW Preparation—Additional effort was required to modify ROW acquisition documents
after they were submitted to the City. The owner of Parcel 8 subdivided the property into
2 separate lots and sold of one of the lots to a new owner. Revised documents were
prepared for new Parcels 8A and 8B.
9.0 Permitting
9.2 Environmental Services—
Between the time the most recent environmental document was submitted for TxDOT
review on 11/9/10 and review comments were received (approx. 9 mths.), TxDOT has
required use of new traffic projections. Because the projected traffic volumes are used in
the analysis of air quality and noise, the Traffic Noise Model (TNM) must be revised and
the portion of the environmental document that addresses air quality and noise must be
updated.
In addition, the environmental document must now include a description of the early
ROW acquisition process performed by the City that was not started until January 2011.
approximately 3 months after the environmental document was submitted for review.
These descriptions must be in conformance with Chapter 18 of the TxDOT
Environmental Affairs Division— Standards of Uniformity for Categorical Exclusions, and
must include every parcel obtained to date (see attached document for detailed
description of required information).
9.4 TxDOT
This item is to provide for additional meetings and coordination with TxDOT that were not
anticipated in the original scope of services. The majority of this additional coordination
was in response to TxDOT changes in review staff for the environmental document.

Since the initial submittal of the environmental document, 3 different reviewers have been
assigned to this project, which resulted in the need for additional meetings to acquaint
each new reviewer with the project issues.
