P. , (ENGINEER) made and entered into City Secretary Contract No. 36513, (the CONTRACT) which was authorized by the City Council by M&C C-22600 on the 8th day of January, 2008 in the amount of $726, 110 . 00; WHEREAS, the CONTRACT was subsequently revised by: Amendment Number 1 which was administratively authorized by the City on the 19th day of March, 2009 in the amount of $7, 757 . 00, Amendment Number 2 which was authorized by the City Council on the 9th day of March, 2010 (M&C C- 24123) in the amount of $110, 428 . 00, Amendment Number 3 which was administratively authorized by the City on the 30th day of September, 2011 in the amount of $25, 524 . 00; WHEREAS, the Contract involves engineering services for the following project: East First Street from Beach Street to Oakland Boulevard; WHEREAS, it has become necessary to execute Amendment No. 4 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the Contract: 1 . Article I of the Contract is amended to include the additional engineering services specified in the proposal letter dated April 12, 2012, copies of which are attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer total $155, 902 . 00. 2 . Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $1, 025, 721 . 00. City of Fort Worth Transportation&Public Works Department Fort Worth, Texas 76102 Reference: Amendment No. 4 East First Street from Beach Street to Oakland Boulevard City Project No.00145 Mr.Weiss: This letter constitutes our request for supplemental authorization for tasks outside the scope of services of the current contract and amendments. This request is based upon the following items: 1.0 Project Management To date there have been two coordination meetings (2 persons at 0.75 hr each per meeting- 3 hrs) held with Texas Department of Transportation (TxDOT)to define the overall scope of the required changes and issues associated with plans accommodating bicycles, It is foreseeable that one additional meeting will be necessary with TxDOT to address the changes once the plans are updated (2 person at 1 hr-2 hr). Additionally, at the request of the City of Fort Worth, Dunaway has coordinated with the Fort Worth Mountain Bike Association (FWMBA) regarding the mountain bike trail network at Gateway Park. To date, Dunaway has been involved in a meeting at Gateway Park (1 person at 2 hr-2hr)and several phone conversations with or regarding FWMBA-2hrs. It is foreseeable that an additionally meeting (1 person at 2 hr- 2hr) at Gateway Park with FWMBA will be necessary as well has some design work -5 hrs by Dunaway. Also, some survey work by the Dunaway MIWBE sub- consultant Gorrondona to show the FWMBA's networks new connection to existing East 1 st Street will be needed at a cost of$600.00. Finally, Dunaway believes the expected effort to adjust and resubmit the plans will require an additional 75 calendar days (11 weeks) be added to the contract schedule for resulting in 33 hr of project management. Additional Dunaway material costs for resubmitting the 90% plan set(assuming 2 sets to the City of Fort Worth and 7 sets to TxDOT @ approx. $250 per set) is approximately $2,250.00 in materials and 3 hr. Amendment No. 4 April 12, 2012 Page 2 2.0 Bicycle Accommodation After the most recent plan documents were submitted to the City of Fort Worth and to TxDOT for 90% review and the review comments were received, TxDOT required that the project be redesigned to accommodate bicycle traffic. The City of Fort Worth has agreed. Modifications to the street section between Beach Street to Haltom Road include the following, for further clarification see attachment: • Maintaining a 12' Median, while modifying the two 12' inside lanes to 11'. • Modifying the two I V outside lanes to 14' to accommodate shared use with bicycles. • Modifying the 10' minimum parkway on either side of the roadway to 8'. • Maintaining an 80' minimum ROW. Approximately 67 hrs of work outside of scope has been done to date in researching, development of concepts, creating exhibits, and coordination on accommodating bicycles with TxDOT and the City of Fort Worth. Additional work from the above includes the following changes: • Typical Sections sheets will be updated—2 hrs. • Removal Plan sheets will be updated—8 hrs. • Roadway Plan & Profile sheets will be updated to reflect the widening of the pavement and sidewalk placement—25 hrs. • The intersection layout at Beach Street, Elliot Avenue, and Haltom Road will need to be modified to show the new roadway and sidewalk-36 hrs. • Thirteen driveways will need to be revised, regraded, and the removal limits updated—36 hrs. • Nine inlets will need to be relocated resulting in line A and B needing minor redesign. Revisions will need to be made to the storm drain plan & profile sheets for line A and B, drainage area sheets, and drainage calculation sheets. This work is being done by Dunaway sub-consultant STV who estimates it will cost $20,908.00. • The seeding limits will need to be modified and sheets updated to reflect the proposed changes. This work is being done by Dunaway sub-consultant STV who estimates it will cost$2,608.00. • Storm Water Pollution Prevention Plan sheets will be updated. This work is being done by Dunaway sub-consultant STV who estimates it will cost $7,401.00. • Signing & Pavement Markings sheets will be updated. Dunaway MIWBE sub-consultant Aguirre-Fields who estimates their efforts will cost$4,644.00. • Cross sections will be updated. This work is being done by Dunaway sub- consultant STV who estimates it will cost $6,588.00, • Traffic Control Plan typical sections and plan sheets will need to be updated. The Traffic Control Signal Plans will also need to be updated, sub-consultant AECOM estimates their efforts will cost $3,156,90. • Utility adjustment details be included in the East 1st Street paving construction plan set- 51 hrs. • Summary and Quantity sheets will be updated, Dunaway estimates 18 hrs for its efforts. 3.0 Illumination The City of Fort Worth has also requested that safety lighting on the roadway be added to the plan set. Work related to this item will be done by Dunaway M/INBE sub-consultant Aguirre-Fields who estimates their efforts will cost$14,401.00. The electrical aspects of the illumination design will be designed by Dunaway sub- consultant Summit who estimates their efforts will cost$7,000.00. 4.0 Utilities Additionally, the City of Fort Worth Water Department asked Dunaway to include the following items in this addendum: • As a result of the widening of East 1 st Street to accommodate bicycles, previous utility design work on valves, hydrants, meters and clean outs will need to be redesigned and resubmitted.The Water Department has request that the redesign include cross sections, with notes and call out depths at the main and details from City of Fort Worth's Buzzsaw site for all water and sewer service locations detailing their installation to avoid conflicts and/or exposure when the future paving construction is preformed- 56.5 hrs. • Design of SS L-3030*from Sta 0+47 to 3+62 to increase depth of cover from the lower than existing proposed East 1st Street profile. This section was excluded from previous scope due to its young age (see attached exhibit) - 33 hrs. • Design adjustments to the existing elevated 90" sanitary sewer manholes in Gateway Park-31 hrs. • Realignment of the water line in East 1st Street and Haltom Road from a previously approved alignment(see attached exhibit) - 54.5 hrs. 5.0 Survey i As a result of the widening of East 1st Street to accommodate bicycles, utility conflicts will need to be re-verified and the SUE sheets updated. Dunaway M/WBE sub-consultant Gorrondona estimated their effort will cost$270.00. 6,0 Environmental Services The TxDOT environmental reviewer has requested a tree survey be conducted in anticipation of possible questions being raised by TxDOT Environmental Division in Austin. DISCUSSION: The 2004 Capital Improvement Program (CIP)approved funding for the design and construction of this project. This contract amendment is needed for the design of bicycle lanes, streetlights, environmental investigations and water and sewer improvements for the project. City Council authorized the City Manager to execute Engineering Services Contract No. 36513 with Dunaway Associates, L.P., for the design of East First Street from Beach Street to Oakland Boulevard as a four lane divided roadway. Staff considers this fee to be fair and reasonable for the scope of services to be performed for the design for bicycle lanes, streetlights, environmental investigations and water and sewer improvements for the project. In the concept and preliminary plans, the City intended to use a shared outside lane for the bicycles and cars, however, TxDOT's new policy requires separate bike lanes to be constructed. The design of new streetlights was not included in the original design contract. Dunaway Associates, L.P., is in compliance with the City's M/WBE Ordinance by committing to an additional 18 percent MNVBE participation on this Amendment No. 4. The City's goal on this amendment is 10 percent. This project is located in COUNCIL DISTRICT 4, Mapsco 64S, 64T, 64U, and 64V.
