Butler Street and Y.C. Shamblee Drive, Fort Worth, TX. This letter and the attachments are a Notice of Establishment (NOE) of a quiet zone under 49 CFR 222.39(a)(1)and Appendix A to Part 222.As required by the Federal Railroad Administration under 49 CFR 222.43, the following information is provided to you and other parties. EFFECTIVE DATE OF QUIET ZONE—222.43(d)(1)(i) Routine use of the locomotive horn at the crossings listed below shall cease effective November 23, 2019. LIST OF GRADE CROSSINGS WITHIN THE QUIET ZONE—222.43(d)(2)(i) All public, private, and pedestrian grade crossings to be included within the proposed quiet zone are: Crossing ID Street Name Location on Street Improvements 765264J E. Shamblee Dr 3400 Block SSM Channelization The City plans to implement a quiet zone at these crossings with the proposed improvements described below: E. Butler Street(SSM-Channelization) E. Butler Street is an existing two-lane highway. The crossing is equipped with flashing lights and gates, constant warning time circuitry, and power-out indicators. The City has installed 100 feet of channelization on both approaches.The proposed channelization qualifies as a Supplemental Safety Measure(SSM).The existing lights and bells are adequate for pedestrian warning and the diagnostic team had no further recommendations. The City has installed all signs and pavements markings per Texas Manual on Uniform Traffic Control Devices (TXMUTCD), including "No Train Horn" signs as required by the FRA Train Horn Rule. Y. C. DIAGNOSTIC TEAM REVIEW-222.43(d)(2)(iii) A diagnostic team review is not required for this quiet zone under 222.39(b), 222.25, or 222.27. However, the agency did invite State agency representatives, all affected railroads, and the FRA to attend a diagnostic team review that was conducted on October 27, 2010. TIME PERIOD FOR HORN RESTRICTION -222.43(d)(2)(iv) The quiet zone shall restrict the routine sounding of locomotive horns 24 hours a day. EXISTING GRADE CROSSING INVENTORY FORMS-222.43(d)(2)(v) Accurate and complete grade crossing inventory forms for each public, private, and pedestrian grade crossing within the quiet zone that reflects conditions existing at the crossings before quiet zone improvements were made are provided in Attachment C. QUIET ZONE GRADE CROSSING INVENTORY FORMS-222.43(d)(2)(vi) Accurate and complete grade crossing inventory forms for each public, private, and pedestrian grade crossing within the quiet zone that reflects SSMs in place upon establishment of the quiet zone are provided in Attachment D. NOTICE OF INTENT—222.43(d)(2)(vii) A Notice of Intent to Establish a New Quiet Zone at the above listed location was sent, by certified mail — return receipt requested, to all railroads operating over the public grade crossings within the proposed quiet zone,the State agency responsible for grade crossing safety, and the State agency responsible for highway and road safety on April 9, 2013. Butler Street and Y C Shamblee Drive (COUNCIL DISTRICTS 8 and 9) RECOMMENDATION: It is recommended that the City Council authorize the execution of a Notice of Quiet Zone Establishment for two locations—Union Pacific Railroad Crossings at E. Butler Street and Y C Shamblee Drive. DISCUSSION: The Transportation and Public Works Department proposes to create quiet zones, which will allow trains to proceed through street crossings without sounding their horns thereby reducing noise levels in the surrounding residential areas. These quiet zones will be implemented pursuant to the Federal Railroad Administration (FRA) Train Horn rule at the two crossings listed below: Union Pacific Railroad at E. Butler Street (Council District 8) Union Pacific Railroad at Y C Shamblee Drive (Council Districts 8 and 9) The residents adjacent to these two crossings have contacted the Transportation and Public Works Department to request the implementation of quiet zones at these crossings. The construction activities at these two crossings have been completed as part of the 2017 Railroads Project, City Project No. 100751-2017. Upon receiving Council approval, the City will execute and submit the Notice of Establishment to the FRA and railroad. Upon approval from FRA, the quiet zones could be established as early as June 2019.
