APPROVING THE SALE OF CERTAIN REAL PROPERTY UNDER SECTION
34.05 OF THE TEXAS PROPERTY TAX CODE
WHEREAS, property located at 1050 Savage Drive was struck off to Everman
Independent School District ("ISD") for $7,725.46 at a tax foreclosure sale on April 5,
2005;
WHEREAS, the total due under the judgment is $6,110.05;
WHEREAS, the appraised value of the property on the date of the judgement was
$10,019.00, and the current appraised value is $8,712.00;
WHEREAS, an offer has been made by Highland Hills Missionary Baptist Church,
to purchase the property for the sum of Six Hundred and 00/100 Dollars ($600.00) for
judgment years 1993-2003;
WHEREAS, Section 34.05 of the Texas Property Tax Code authorizes the ISD to
conduct a direct sale of tax-foreclosed property to a buyer; however, Section 34.05(i)
requires any amount less than the amount due for taxes and fees be approved by all
taxing entities before conveying the property;
WHEREAS, the ISD is requesting the City of Fort Worth ("City") approve the
sale of this property;
WHEREAS, it is in the best interest of the City and its taxpayers to return this
property to a productive use;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FORT WORTH, TEXAS:
1 . That the City approves the sale of that certain tract of real estate identified as
ABSTRACT 1198, TRACT 1C01, OLDHAM LEIGH SURVEY LOCATED IN
EVERMAN ISD, COUNTY OF TARRANT
ACCOUNT NUMBER: 04595289; ALSO KNOWN AS 1050 SAVAGE DRIVE,
FORT WORTH, TX 76134
acquired at the above described tax sale for the sum of $600.00 to Highland
Hills Missionary Baptist Church as authorized by Section 34.05, Texas
Property Tax Code. The liens foreclosed by the judgment are extinguished by

2. That the City Manager or his designee is authorized to execute appropriate
instruments to transact the sale.

RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached resolution authorizing the Everman Independent School District to conduct the direct sale of a tax-foreclosed property
located at 1050 Savage Drive for a total cost of$600.00 to Highland Hills Missionary Baptist Church, in accordance with Section 34.05 of the
Texas Property Tax Code;and
2. Authorize the City Manager or his designee to execute appropriate instruments to transact the sale.
DISCUSSION:
The property located at 1050 Savage Drive was struck off to Everman Independent School District("ISD")for$7,725.46 at a tax foreclosure sale
on April 5,2005. The total due under the judgement is$6,110.05, The appraised value of the property on the date of the judgement was
$10,019.00, and the current appraised value is$69,696.00. A bid packet was submitted in the amount of$600.00 by Highland Hills Missionary
Baptist Church to purchase the property. In accordance with Section 34.05 of the Texas Property Tax Code,the ISD is authorized to conduct a
direct sale of tax-foreclosed property to a buyer. Section 34.05(i)requires any amount less than the amount due for taxes and fees be approved
by all taxing entities before conveying the property. Thus,the ISD is requesting the City approve the sale of this property.
