ORDINANCE NO. I r
AN ORDINANCE DECLARING CERTAIN FINDINGS; PROVIDING FOR
THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY
OF FORT WORTH, TEXAS, AND THE ANNEXATION OF CERTAIN
TERRITORY CONSISTING OF 1.158 SQUARE MILES OF LAND,
WHICH TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT
BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS; PRO-
VIDING THAT THE TERRITORY ANNEXED SHALL BEAR ITS PRO
RATA PART OF TAXES; PROVIDING THAT THE INHABITANTS
THEREOF SHALL HAVE ALL THE PRIVILEGES OF ALL CITIZENS
OF FORT WORTH, TEXAS; PROVIDING THAT THIS ORDINANCE
SHALL AMEND EVERY PRIOR ORDINANCE IN CONFLICT HEREWITH;
PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF
ALL PRIOR ORDINANCES NOT IN DIRECT CONFLICT; PROVIDING
A SEVERABILITY CLAUSE; AND NAMING AN EFFECTIVE DATE.
WHEREAS, a public hearing before the City Council of the City of
Fort Worth, Texas, wherein all interested persons were provided with an oppor-
tunity to be heard on the proposed annexation of the territory hereinafter
described, was held in the City Council Chamber in the City Hall of Fort Worth,
Texas, on the 27th day of October, 1969, which date is not more than twenty (20)
nor less than ten (10) days prior to the institution of annexation proceedings;
and
WHEREAS, notice of such public hearing was published prior thereto
in a newspaper having general circulation in the City of Fort Worth, Texas, and
in the hereinafter described territory on the 15th day of October, 1969, which
date was not more than twenty (20) and not less than ten (10) days prior to the
date of the opening of such public hearing; and
WHEREAS, the population of the City of Fort Worth, Texas, is in
excess of 400,000 inhabitants; and
WHEREAS, the corporate area of the City of Fort Worth, Texas, was
198.222 square miles on the 1st day of January, 1969; and
WHEREAS, the hereinafter described territory lies within the exclusive
extraterritorial jurisdiction of the City of Fort Worth, Texas; and
WHEREAS, the hereinafter described territory contains approximately
1.158 square miles of land; and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH:
SECTION I
THAT the following described land and territory lying adjacent to
and adjoining the City of Fort Worth, Texas, is hereby added to and annexed
to the City of Fort Worth, Texas, and said territory hereinafter described
shall hereafter be included within the boundary limits of the City of Fort
Worth, Texas, and the boundary limits of said City, at the various points
contiguous to the area hereinafter described, are altered and amended so as
to include said area within the corporate limits of the City of Fort Worth,
Texas, to wit:
Being portions of the L. G. Tinsley Survey, Abstract
No. 1628; A. C. Warren Survey, Abstract No. 1686; John
Lynch Survey, Abstract No. 942; E. S. Elliott Survey,
Abstract No. 476; John Akers Survey, Abstract No. 24;
G. B. Stanley Survey, Abstract No. 1369; H. P. Tuggle
Survey, Abstract No. 1513; W. R. Reeder Survey, Abstract
No. 1303; William Norris Survey, Abstract No. 1166; and
Hugh F. Largent Survey, Abstract No. 960, situated about
6 miles northeasterly from the Courthouse of Tarrant
County, Texas, and being more particularly described by
metes and bounds as follows:
Commence at a point for corner which is the
point of beginning of the common boundary line
between Fort Worth and Haltom City as said common
boundary line was ordered, adjudged and decreed by
the District Court of Tarrant County, Texas, 48th
Judicial District, in Cause No. 48832-C, on the
18th day of December, 1967 (no writ history), said
point of beginning and common boundary line being
described as follows:
"BEGINNING at a point in the center line
of Big Fossil Creek at its intersection with the
north line of the William Norris Survey, Abstract
No. 1166, Tarrant County, Texas, such point of
beginning being also the common point of inter-
section of the corporate boundary lines of the
City of Haltom City, the City of Richland Hills
and the City of Fort Worth;"
THENCE along and with the said common boundary
line as described in the judgment as follows:
"THENCE in a southerly direction along
and with the meanders of the center line of Big
Fossil Creek to a point for corner at the inter-
section of such center line of Big Fossil Creek
with the southeasterly right-of-way line of the
Chicago, Rock Island and Gulf Railway Co.;
"THENCE in a southwesterly direction along
and with the southeasterly right-of-way line of
the Chicago, Rock Island and Gulf Railway Company
a distance of approximately 2,600 feet to a
point in the corporate boundary line of the City
of Haltom City, Texas, as said corporate boundary

line was established by the Charter of the City
of Haltom City, Texas, which charter was duly
and legally adopted by the electorate of the City
of Haltom City, Texas, at a special election called
for such purpose on the 3rd day of December, 1955,
and in which Charter of the City of Haltom City
there is contained an 'Exhibit A-Boundaries of
the City of Haltom City as of September 1, 1955' ;"
and in the description of the boundaries of the City of
Haltom City contained in Exhibit A is a reference to said
point of intersection of the line being described herein
and the charter boundary line of the City of Haltom City
as follows:
"THENCE North 62 degrees-45 minutes East,
137.8 feet to the Northeast corner of the 20
acre Sewage Treatment Plant Site herein referred
to as 'Plant Site' ;"
THENCE along and with the corporate boundary line of
the City of Haltom City as described in Exhibit A of
its Charter as follows:
"THENCE in a Southerly direction, in a line of
said Plant Site 460.6 varas to a one inch pipe with
cap on top in the South boundary line thereof for
corner;
"THENCE in a Westerly direction along the said
South boundary line of such tract crossing the new
channel of the Little Fossil Creek, 293.2 varas to
the Southwest corner of said Plant Site, said
corner being now marked by a twisted iron stake
driven in the North bank of Little Fossil Creek;
"THENCE north along the west line of the 20
acre Haltom City Sewage Treatment Plant Site to
its intersection with the north line of the H. P.
Tuggle Survey, Abstract No. 1513;
"THENCE west along the north line of said
survey to its intersection with the west line of
the R. Kingsbury Estate Tract, marked 3-A on the
Haltom City map;
"THENCE south along the west line of the
R. Kingsbury Estate Tract marked 3-A on the Haltom
City map to a point for corner in the South line
of the Garden of Eden Addition;
"THENCE westerly along the south line of the
Garden of Eden Addition to the west right-of-way
line of Carson Street;
"THENCE south along the west right-of-way
line of Carson Street to a point for corner in
the north right-of-way line of Elliott-Reeder
Road, which point for corner is the same point
of intersection described and fixed by the calls
in City of Fort Worth Ordinance No. 4700, which
ordinance was duly and legally adopted on August
13, 1962;

"THENCE in a westerly direction along the north
right-of-way line of Elliott-Reeder to a point for
corner in the east right-of-way line of Haltom Road;
"THENCE south along the east right-of-way line
of Haltom Road to a point for corner in the north
right-of-way line of Wheeler Street, said point for
corner and intersection being in the common boundary
line of the City of Fort Worth and the City of
Haltom City as hereby fixed, determined and estab-
lished;"
THENCE Westerly along and with the north right-
of-way line of Wheeler Street to a point for corner
at its intersection with the west line of Haltom
Road produced north, said point for corner being in
a Fort Worth City Limit Line as established by
Ordinance No. 2379 (particularly described in Amend-
ment No. V thereof), adopted on December 17, 1964;
THENCE along and with the Fort Worth City Limit
Line as established by Ordinance No. 2379 (Amendment
No. V) westerly and southerly along and with the
westerly line of Haltom Road to a point for corner,
being the north corner of the tract annexed to the
City of Fort Worth by Ordinance No. 5920 (FIRST
TRACT), adopted April 8, 1968;
THENCE South along and with the east line of
the tract annexed by Fort Worth Ordinance No. 5920
to a point for corner in the South right-of-way
line of East First Street, being in a Fort Worth
City Limit Line as established by Fort Worth Charter
Amendment on December 11, 1924;
THENCE East along and with said City Limit Line,
being along and with the South right-of-way line of
East First Street approximately 750 feet to a point
for corner at its intersection with the center line
of the twenty-five (25) foot wide permanent easement
for the Connecting Outfall Main Sanitary Sewer between
the Riverside Sewage Treatment Plant and the Village
Creek Sewage Treatment Plant;
THENCE along and with the centerline of the
said easement in a northerly, easterly and south-
easterly direction, with its meanders, to a point
for corner at its intersection with the west right-
of-way line of Carson Street produced South, said
point for corner being approximately five hundred
(500) feet east from the west line of the W. R.
Reeder Survey, Abstract No. 1303;
THENCE North to and along the west right-of-way
line of Carson Street and along said line produced
north to a point for corner at its intersection
with the north right-of-way line of Elliott-Reeder
Road;
THENCE East, along and with the north right-of-
way line of Elliott-Reeder Road 2,640 feet (one-half
mile) to a point for corner;

THENCE North 1,320 feet (one-quarter mile) to
a point for corner;
THENCE East approximately 2,400 feet to a
point for corner in the centerline of Big Fossil
Creek;
THENCE northeasterly along and with the center-
line of Big Fossil Creek, with its meanders, to a
point for corner at its intersection with the South
line of the William Norris Survey, Abstract No. 1166;
THENCE East along the south line of the William
Norris Survey, Abstract No. 1166, approximately
3,400 feet to a point for corner at its intersection
with the east line of the Texas Electric Service
Company right-of-way;
THENCE North along the Texas Electric Service
Company right-of-way to a point for corner in the
present Fort Worth City Limit Line;
THENCE, along the present Fort Worth City Limit
line, West, South, West, North and westerly to the
place of beginning and containing 1.158 square miles
of land.
SECTION II
THAT the above described territory and the area annexed shall be a
part of the City of Fort Worth, Texas, and the property so added hereby shall
bear its pro rata part of the taxes levied by the City of Fort Worth, Texas,
and the inhabitants thereof shall be entitled to all of the rights and priv-
ileges of all the citizens and shall be bound by the acts, ordinances, reso-
lutions and regulations of the City of Fort Worth, Texas.
SECTION III
THAT this ordinance shall and does hereby amend every prior ordinance
in conflict herewith, but as to all other ordinances or sections of ordinances
not in conflict herewith this ordinance shall be and is hereby made cumulative.
SECTION IV
THAT it is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of this ordinance
are severable, and if any phrase, clause, sentence, paragraph or section of
this ordinance shall be declared void, ineffective, or unconstitutional by the
valid judgment or final decree of a court of competent jurisdiction, such
unconstitutionality shall not affect any of the remaining phrases, clauses,
sentences, paragraphs and sections hereof, since the same would have been

enacted by the City Council without the incorporation herein of any such void,
ineffective or unconstitutional phrase, clause, sentence, paragraph or section.
SECTION V
THAT this ordinance shall be in full force and effect from and after
the date of its passage on first reading and publication and its passage on
second reading as provided for in Section 40 of Chapter XXVIII of the Charter
of the City of Fort Worth and it is so ordained.

At the regular meeting of April 4, 1969, the City Plan Commission recommended
that the 4.4 square mile area (bounded by the Fort Worth city limit line on
the west and south, I-820 on the east and the Fort Worth-Haltom City limit
line and Richland Hills on the north) be annexed, with the time schedule to
be administratively determined. The first portion of this 4.4 square mile
area to be considered for annexation consists of 1.158 square miles and is
generally described as lying south of Haltom City and Richland Hills, extend-
ing south to a line north of the Trinity River, and bounded on the east and
west by Fort Worth. (Detailed area information is contained under separate
cover in the Report on Proposed Annexation of Area South of Haltom City.)
Nature of Existing Development
Most of this area is vacant or pasturage, however, a portion contains resi-
dential dwellings (many of which are substandard) , a landfill area, gravel
pits, and a few light industrial and commercial establishments.
Municipal Services
All City services can be furnished by the City of Fort Worth as needed. Street
maintenance, sewer and water services w4_11 require expenditure of additional
manpower and funds.
Need for Annexation
The potential of this area with the possibility of the construction of the
Trinity River Canal dictates immediate annexation to improve existing condi-
tions and effect land use control.
Recommendation
It is recommended that the City Council adopt a resolution setting
October 27, 1969, at 9.30 a.m. as the time for public hearing on the con-
templated annexation and authorizing and directing the City Secretary to
publish the required notices.
