AN ORDINANCE APPENDING SECTION 22-3 OF BUILDING CODE
ORDINANCE #1399, PERTAINING TO PROJECTIONS BELOW
SIDEWALK GRADES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH:
SECTION I
That Section 22-3 of Chapter 22, Building Code Ordinance
#1389 of the City of Fort Worth, shall hereinafter read
as follows:

Section 22-3
PROJECTIONS BELOW SIDEWALK GRADE
Paragraph 22-3-1 Vaults.
The size and extent of vaults extending beneath
public sidewalks, streets, or alleys, will be a matter
of special determination in each case except that in
na "se shall the outside walls of such vaults be
nearer than three (3) feet to the street side edge of the
curb on public streets and in no case shall the outside
of walls of vaults be nearer than two and one-half (22)
feet to the center line of a public alley.
A special permit shall be issued for the occupancy
of public space by vaults. Such permits are subject to
revocation by the City Council of the City of Fort Worth
at any time when the space occupied is needed for public
use or improvement, or whenever the City Council finds
that revocation of such hermit is .to the best interest
of the public.
The application for a vault in public space must be
accompanied by a written agreement, upon official blank
furnished for the purpose, signed by the owner of the
abutting property, c ntracting to release and relinquish
the vault space and(to remove, free of expense to the
City of Fort Worth, all structural parts of the vault
when so ordered by the Board of Councilmen. Also plans

vault, the depth and proposed construction, together with
the proposed location and size of all openings into same.
Vaults shall not be used for public entrances to
basements nor for the housing of boilers.

In existing buildings where it is proposed to install
fuel oil &LPPUatus, the 100Ation of said apparatus and tanks
necessary to same shall be a matter of special determination,
and shall meet with the requirements of the Building Com—
missioner.
Vaults must be roofed over within a reasonable time or
within the time fixed by the Building Commissioner. Whenever
the grade is changed, the vault must be changed and repaved,
at the expense of the owner of the abutting property, to com—
ply with the new grade.
Vaults shall not be constructed so as to interfere with
sewers, water pipes, manholes, gas pipes, lamp posts, trees,
or other public work or improvement, nor with any electric
conduit carrying fire alarm or police alarm wires.
Owners of abutting property shall notify the public
utility companies concerned where the removal or relocation
of any underground construction is made necessary by the
construction of a vault.
SECTION II.
That all Ordinances and parts of Ordinances heretofore
passed by the Cityl0ouncil of the City of Fort Worth, that
are in conflict with the foregoing provisions of this
Ordinance shall be void and of no further force and effect.
SECTION III.
This Ordinance shall be in full force and effect
immediately after giving of such notice as is required by
Law.
